JURY TRIAL DEMANDED
COMPLAINT
AND NOW, here come Plaintiffs by and through their attorneys, Wix,
Wenger & Weidner, and set forth the following:
1. The Plaintiffs are adult individuals residing at 200 N. Middlesex Road,
Carlisle, Pennsylvania 17013.
2. The Defendant is an adult individual residing at 1309 Grass Ct. SE.,
Olympia, Washington 98513-6635.
3. The facts and occurrences hereinafter related took place on or about
February 10, 2002 on Route 11 S. Carlisle Pike, Silverspring Township,
Pennsylvania.
4. At the time and place aforesaid, Plaintiffs were the owners of a white 1997
Grand Caravan which was then and there being operated by Stewart Bevins.
5. At the time and place aforesaid, Defendant was operating a 2001 Pontiac
Sunfire which his wife had rented from National Rent-A-Car.
6. At the time and place aforesaid, Plaintiffs were traveling South on Route
11, in the left hand lane, when the Defendant abruptly entered the left hand lane
from the right lane, cutting off the Plaintiffs causing the vehicles to collide.
7. The aforesaid accident and damages resulting thereform were caused by
Defendant's negligence in that he:
(a) Failed to keep a proper lookout for other vehicles;
(b) Failed to operate his vehicle in a safe manner; and
(c) Left his lane of travel when it was not safe to do so.
8. Solely, as a result of Defendant's negligence Plaintiffs sustained damages
in the amount of Two Thousand Seven Hundred Ninety-Three and 44/100
($2793.44) Dollars for repairs to their vehicle.
WHEREFORE, Plaintiffs demand judgment in their favor and against
Defendant not in excess of mandatory arbitration limits, together with interest and
costs.
