is three (3) percent [72 P.S. 39116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero (0) percent
[72 PS. 39116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an
adoptive parent, or a stepparent of the child is zero (0) percent [72 PS. 39116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) percent, except as noted in
72 P.S. 39116(1.2) [72 PS. 39116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 PS. 39116(a)(1.3)]. A sibling is defined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

of my estate to my four children, JAMES GRUSCHOW, ROBERT GRUSCHOW,
MATTHEW GRUSCHOW and RUTH ANN GERDES in equal shares.
SIXTH: Without limitation of the powers which are now or
may hereafter be conferred by law upon my Executor with respect to my
estate and each other fund (whether composed of principal or
accumulated income) held or administered hereunder, shall have the
following powers, which shall be exercisable at any time and from
time to time until final distribution and settlement of my estate
shall have been completed.
A. To sell at public or private sale, to exchange for
other property of any kind and to lease for any term or terms any
property, real or personal, owned by me at the time of my death or
any time received or held hereunder, for such considerations, in cash
or on credit, secured or unsecured upon such other terms and
conditions as it shall deem proper; and to accept and retain as a
proper investment hereunder whether or not it be of the character

SEVENTH: No beneficiary may assign or transfer his or her
interest hereunder and no person with a claim against a beneficiary
may reach any such interest until it is distributed to the
beneficiary.
EIGHTH: Any beneficiary, under this Will and Testament,
who dies at the same time as I, within fifteen (15) days of me or
under circumstances wherein it shall be difficult or impossible to
determine who died first, shall be deemed to have predeceased me for
the purposes of this Will.
NINTH: I hereby appoint my beloved husband, FRANCIS HOWARD
GRUSCHOW, as Executor of this Will.
TENTH: In the event that FRANCIS HOWARD GRUSCHOW does not
act or continue to act as Executor, I appoint JOHN JOHNSON as
Substitute Executor, with the same powers and duties.
ELEVENTH: I direct th~t said Executor or substitute
Executor, shall serve without bond or security.
TWELFTH: I further state that my husband and I hereby make
mutual wills in favor of one another with the understanding and on
the condition that neither of us will revoke the last will and
testament by us, this day, duly made and executed or change any of
the provisions herein contained, without the written consent of the
other.
