NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402). Smith; thence by said land now or formerly of Jeanne M. Smith, North 82 degrees 06 minutes 22 seconds East, 68.87 feet to an existing p.k. nail in the centerline of Newburg Road (SR 0696); thence in and along the centerline of Newburg Road (SR 0696), South 07 degrees 41 minutes 44 seconds East, 208.45 feet to an existing railroad spike in the centerline of Newburg Road (SR 0696); thence crossing Newburg Road (SR 0696), South 38 degrees 34 minutes 54 seconds West, 11.81 feet to a point at the eastern most corner of Lot No. 20; thence by said Lot No. 20, North 86 degrees 38 minutes 30 seconds West, 135.68 feet to a point on the cul-de-sac of Pike Court; thence in and along the right of way line of Pike Court, by a curve to the left on a circle having a radius of 60.00 feet, for an arc distance of 67.74 feet, the chord of which is North 28 degrees 59 minutes 02 seconds West, 64.20 feet to a point on the right of way line of Pike Court, the place of BEGINNING. THE ABOVE DESCRIPTION was taken from a final subdivision plan for North Middle Spring Estates by Eric L. Diffenbaugh, PLS, which plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 91, page 61.
