PENNSYLVANIA 156 CREEKSlDE DRIVE, ENOLA CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, KRISTI L. TOOHEY, the OWNER of the real estate described below, has or is about to execute a contract with SCOTT LOUDON, whose principal business address is 134 HILL LANE, MECHANICSBURG, PA to construct a dwelling upon lands situate at 156 CREEKSlDE DRIVE, ENOLA, CUMBERLAND County, Pennsylvania, and more particularly bounded and described on Exhibit "A" attached hereto and made a part hereof; and, NOW, THEREFORE, this ~.~- day of D~t,-,J~, 2003, before any authority had been given by SCOTT LOUDON to commence work on said facilities, or purchase materials for same, in consideration of making of the above-described Contract with KRIST] L. TOOHEY, Owner, and in further consideration of One ($1.00) Dollar paid to the general contractor by KRISTI L. TOOHEY, Owner, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be fired or maintained against the Owner's facilities and the land above-described, or upon KRISTJ L. TOOHEY, the Owner, by the general contractor, or any of its subcontractors, or by any of the materialman or workmen, or any other person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for, towards, in or about the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities, the land above-described, and KRISTI L. TOOHEY, the Owner, being hereby expressly waived by the general contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under them. WITNESS: ATTEST: OWNER: ,,~TR ,CTO _~..~ SCOTT LOUDON EXHIBIT "A" ALL THAT CERTAIN tract of land with the improvements thereon erected situate in East Pennsboro Township, Cumberland County, Pennsylvania, bounded and described as follows: BE:GINNING at a point in the centerline of 33.00 feet wide Creekside Drive, on the northwestern corner of Lot No. 4 on the hereinafter mentioned Plan of Lots; thence along the letter, South 67 degrees 19 minutes 00 seconds East, a distance of 292.00 feet to a point on the western side of the Conodoguiet Creek; thence along the latter, North 22 degrees 41 minutes 00 seconds East, a distance of 100.00 feet to a point on the line of Lot No. 2 on said Plan; thence along the latter, North 67 degrees 19 minutes 00 seconds West; a distance of 292.00 feet to a point in the centerline of said road; thence along the latter, South 22 degrees 41 minutes 00 seconds West, a distance of 100.00 feet to a point, the place of BEGINNING. CONTAINING 29,200.00 square feet according to a Subdivision Plan by Pennis R. Moore, R.S., dated November 9, 1979, recorded in the Office of the Recorder of Deeds for Cumberland County, Pennsylvenia, at Plan Book 37, Page 20 and being designated as Lot No. 3 thereon and improved with a 1 1/~. story dwelling. SUBJECT, HOWEVER, to an easement for the repair and maintenance of a water line from the residence located at 160 Creekview Drive, Enola, which water line runs from the well located on the above described property to :[60 Creekside Drive. SUBJECT, ALSO, to the rights of the owners of 160 Creekside Drive to use the water and pump from the well at the above.described property in common with the owners of the above-described property. HAVING thereon erected a residential dwelling known as 156 Creekside Drive, Enole, PA 17025. ASSESSMENT #09-17-10a*2-003B
