Timonty K. and Rekha J. McHugh of Camp Hill, PA is about to execute contemporaneously herewith, a contract, with of for the erection of a two story dwelling house Pennsylvania. Haubert Homes, Inc. Pennsylvania, building upon a lot ofland situate and known as Lot 42, Fairwinds, Phasep~, recorded in Plan Book 87, Page 11, Hampden Township, Cumberland County,/more fully described on Exhibit A, attached hereto and made part hereof NOW. January 5 18~x2004. at the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by the said Timothy K. and Rekha J. McHugh to the said Haubert Homes, Inc. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Timothy K. and Rekha J. McHugh and the further consideration of One Dollar. to Haubert HOmes, Inc. paid by Timothy K. and Rekha J. McHugh , it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to lile such liens being expressly waived. LEGAL DESCRIPTION FAIRWINDS PHASE 4 - LOT 42 ALL THAT CERTAIN piece or parcel of land situated in the Township of Hampden, County of Cumberland, Commonwealth of Pennsylvania, being more fully bounded and described as follows: BEGINNING at a point located on the southerly right-of-way line of Inverness Drive, Twenty-five Feet (25') from the centerline of the same and being a front property ~orner of Lot 41; THENCE along said Lot 41, South 00 Degrees 02 Minutes 02 Seconds West (S00°02'02"W) a distance of 143.32 feet to a point, said point being on line of Lot 2; THENCE along said Lot 2 and Lot 1, South 89 Degrees 35 Minutes 55 Seconds West (S8~]°35'55"W) a distance of 126.94 feet to a point, said point being a corner of Lot 43; THENCE along said Lot 43, North 14 Degrees 26 Minutes 10 Seconds East (NI4°25'10"E) a distance of 160.33 feet to a point on said southerly right-of-way; THENCE along said southerly right-of-way, by a curve to the left having a radius. · .of 350.00 feet an arc distance of 87.98 feet being subtended by a chord of South B2 Degrees 45 Minutes 54 Seconds East (S82'45'54"E) a clistance of $7.75 feet to a point, said point being the POINT OF BEGINNING. BEING all of Lot 42, Phase 4, Fairwinds, as shown on a plan titled "Fairwinds, Final Phase 4", as prepared by Melham Associates PC, dated February 26, 2003. SUBJECT TO the following: The owner(s) of this Lot shall be responsible for the maintenance of the swale in the drainage easement located at the rear of Lot.
