PETITION TO WAIVE PERSONAL SERVICF AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney, Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition to Waive Personal Service of which following is a statement: 1. Petitioner is the Cumberland County Tax Claim Bureau an Agency of Cumberland County, created pursuant to the Real Estate Tax Sale Law. (72 P.S. §5860.101 et. seq. ) 2. Respondents are Sarah J. Creelman and Laurie Creelman, adult individuals, having a mailing address of 9 West Springville Road, South Middleton Township, Cumberland County, Pennsylvania. Sarah J. Creelman resides at 12 Shirley Lane, Boiling Springs, PA 17007. Laurie Creelman resides at 9 West Springville Road, Boiling Springs, PA 17007. 3. The within action concerns the sale for taxes of the property situate in South Middleton Township and known as 9 West Springville Road, South Middleton Township, Pennsylvania 17007, identified as Cumberland County tax parcel no.: 40- 28-2100-089. 4. The within action concerns the sale at "Upset Tax Sale" pursuant to Section 601 of the Real Estate Tax Sale Law. Petition to Waive Personal Service - Creelman Page 1 of 5 5. Section 601(a)(3) of the Real Estate Tax Sale Law provides that for owner occupied property personal service by the Sheriff or his deputy must be made at least 10 days prior to the date of sale. The provision further provides that: "If such personal notice cannot be served within twenty five (25) days of the request by the Bureau to make such personal service, the Bureau may petition the Court of Common Pleas to waive the requirement of personal notice for good cause shown." 6. Petitioner believes, and therefore avers, that Respondent, Laurie Creelman who occupies the subject premises is intentionally avoiding service of process and therefore Petitioner has good cause for the waiver of the personal service requirement. 7. Attached as Exhibit "A" is a copy of the Sheriff's return showing attempts to serve Laurie Creelman as follows: "Attempted service on 10/7, 10/9, 10/18, 10/30, & 10/31. Defendant was inside on 10/18, but would not answer door per Deputy Kell." Accompanying said Sheriff's return at Exhibit "A" attached hereto is the Notice of Public Tax Sale to be held on November 14, 2001 which was attempted to be served. 8. The Petitioner has made good faith efforts to serve the Respondents and Respondents have actual notice of a pending tax sale of their property, as follows: (a) A Notice of Return and Claim pursuant to Section 308 of the Real Estate Tax Sale Law was posted on the property by the Cumberland County Sheriff on October 27, 2000 a copy of the Sheriff's return, a computer print-out of the information for the subject property, and a copy of the form of notice which was posted and which had been completed with the information for the subject property, is attached hereto as Exhibit "B." This notice was posted by the Sheriff because the certified mail notice of Return and Claim was refused by the owner. Petition to Wa/ye Personal Service - Creelman Page 2 of 5 (b) The Cumberland County Tax Claim Bureau sent a reminder notice, although not required by statute, on January 4, 2001 by regular mail. A copy of said reminder notice is attached hereto as Exhibit "C." The said reminder notice was not returned as undeliverable by the Post Office. (c) The Cumberland County Tax Claim Bureau sent a second and Final Reminder Notice on April 16, 2001, although not required to do so, by regular mail. A copy of the Final Reminder Notice is attached hereto as Exhibit "D." The said Final Reminder Notice was not returned as undeliverable by the United States Mail. (d) The Cumberland County Tax Claim Bureau sent a Notice of Public Tax Sale by certified return receipt mail pursuant to Section 602(e) of the Real Estate Tax Sale Law on July 20, 2001. A copy of the return receipt cards, one signed by Sarah J. Creelman and the other signed by Laurie Creelman, a computer print-out showing the information for this notice for the subject property, and a copy of the form which was mailed to the Creelmans with the information filled in for the subject property, is attached hereto as Exhibit "E." (e) Cumberland County Tax Claim Bureau published notice of the scheduled Upset Tax Sale of this property in The Sentinel, The Patriot News, The Shippensburg News-Chronicle, and the Cumberland Law Journal. A copy of proofs of publication, including the portion of the advertisement showing the listing for the Creelmans is attached hereto as Exhibit "F." This notice was mailed pursuant to Section 602(a) or the Real Estate Tax Sale Law. (f) Notice of the pending Upset Tax Sale was posted on the property on August 16, 2001 as evidenced by the Sheriff's return attached hereto as Exhibit "G." Petition to Waive Personal Service - Creelman Page 3 of 5 (g) The preceding notices concerned an Upset Tax Sale scheduled for this property on September 27, 2001. Because the Sheriff was not able to personally serve the co-owner who occupies the premises, Laurie Creelman, the sale of this property was continued to the continued sale date of November 14, 2001 pursuant to Section 601(a) which provides, inter a/ia. as follows: "The Bureau shall schedule the date of sale no earlier than the second Monday of September and before October 1, and the sale may be adjourned, re-adjourned or continued. No additional notice of sale is required when the sale is adjourned, re-adjourned or continued if the sale is held by the end of the calendar year...." (h) By first class United States mail, postage pre-paid, the Cumberland County Tax Claim Bureau sent a notice that the property would be sold on November 14, 2001, separately to Laurie Creelman and Sarah J. Creelman. A copy of each said notice is attached hereto as Exhibit "H." The envelope was not returned undeliverable by the United States mail. (i) Staff of the Cumberland County Tax Claim Bureau personally posted the subject premises with a Notice of Public Tax Sale, including the sale date and time, on November 6, 2001. A copy of the Notice which was posted, with the affidavit of the employee of the Tax Claim Bureau on the reverse thereof, is attached hereto as Exhibit 'T" 9. Petitioner believes, therefore avers, that Respondents have actual notice of pending sale of their property on November 14, 2001 at 2:00 p.m. on the second floor of the old Cumberland County Courthouse.
