Plaintiff Schneider Training Academy Inc. is a corporation which owns and operates commercial driving schools, and maintains offices at 911 Glory Road Green Bay WI 54304. 2. Defendant FOUAD MASSOUDI, Jr. is a citizen of the Commonwealth of Pennsylvania residing at 8 DULES DRIVE W APT. 4H CAMP HILL, PA 17011. 3. On or about March 1, 2006, Defendant entered into a Tuition Installment Contract with Plaintiff . A copy of the Tuition Installment Contract is attached hereto as Exhibit "A". 4. Defendant failed to pay Plaintiff in accordance with and is in default of the Tuition Installment Contract. 5. In accordance the Tuition Installment Contract, upon default, Plaintiff is entitled to attorneys fees and costs of collection. 6. Defendant owes $4,133.79, reasonable attorney's fees of $500.00, plus costs. COURT OF COMMON PLEAS COUNTY OF CUMBERLAND TRIAN DIVISON CIVIL ACTION 7. Defendant filled out an application for training with Plaintiff "on-line," on or about February 8, 2006. 10. On or about February 11, 2006, Plaintiff's agent or employee telephoned Defendant, telling him that Plaintiff would review the application and would call Defendant the next day. 11. Plaintiff's agent or employee telephoned Defendant the next day to advise him of the necessity of obtaining a driver's permit, to schedule a training class, and to expect a contract by fax to be sent to him. 12. Defendant received a blank contract consisting of three pages by fax, filled out the parts of the contract with his information, and faxed it back to the Plaintiff. 13. At no time, relevant to these proceedings, did Defendant receive either one or two documents, separate from the contract, entitled "Customer's Right to Cancel," or any variation thereof, advising Defendant of his right to cancel the said contract. 14. At no time relevant to these proceedings, did Defendant receive a contract that contained language required by 73 P.S. Section 201-7(b)(1). i.e. language in immediate proximity to Defendant's signature, in bold-face, ten-point font, dated, and characterized as "Notice of Cancellation." 15. After a period of training, both in the classroom and over the road, and after successful testing, both in a simulator and on the road, Defendant began to work for the Plaintiff hauling freight to different parts of the country, without incident, for a period of three to four months. 16. In July, 2006, Defendant was involved in a minor accident while on the job in Texas. 17. Defendant continued to work for the Plaintiff for approximately one more week, when he was retested, allegedly due to the accident, in Plaintiff s Indianapolis terminal. 18. Defendant was told that he failed the test and was terminated in mid-July. 19. During this re-testing, Plaintiff s agent asked the Defendant questions about his national origin and his reasons for being in the United States, all of which was insulting to the Defendant. 20. Defendant believes, and therefore avers, that he was discriminated against in this re-testing, and did not fail any test given to him for any legal or appropriate reason, and should not have been terminated. 21. Defendant was told, during the course of his training and work for the Plaintiff, that he would receive a bonus of $1,000 for each referral he made to the Plaintiff. 22. Defendant made three (3) referrals to the Plaintiff and should have received bonuses totaling three thousand dollars ($3,000). 23. As a result of his improper and discriminatory termination, Defendant lost net wages in the approximate amount of Two Thousand Dollars ($2,000) per month for eight months, for a total loss of Sixteen Thousand Dollars ($16,000). 24. Had Defendant not been improperly terminated, Defendant would have been able to fulfill his one-year contract with the Defendant and would not owe Plaintiff anything. AFFIRMATIVE DEFENSES 1. Recission - Unfair Trade Practice & Consumer Protection Law 25. Paragraphs 1-24 are incorporated herein by reference hereto. 26. The installment contract between the Plaintiff and Defendant was contracted as a result of, or in connection with, a contact with Defendant at his residence by telephone. 27. The installment contract was for services with a value in excess of Twenty-Five Dollars ($25.00). 28. Pursuant to 73 P.S. Section 201-7(a) Defendant has the right to rescind the installment contract within three (3) days following the day on which the contract was made or the day on which he received duplicate "Notices of Cancellation," as required by 73 P.S. Section 201-7(b)(2). 29. The services Defendant received, in training by the Plaintiff, were no greater, and may have been less than, the profit that Plaintiff derived by means of Defendant's employment with Plaintiff. 30. At the time of contract, Defendant was entitled to receive a fully completed copy of the installment contract showing the date of the transaction, the name and address of the seller, and, in immediate proximity to the space for Defendant's signature, in bold-face, ten-pont type font, the language required by 73 P.S. Section 201- 31. Defendant's contract was incomplete when he received it in that it did not contain the language required by 73 P.S. Section 201-7(b)(1). 32. Plaintiff's failure to provide Defendant with two (2) copies of a "Notice of Cancellation" at any time relevant to these proceedings violates Pennsylvania's Unfair Trade Practices and Consumer Protection Law, 73 P.S. Section 201-7. 33. Since the period of cancellation does not begin to run until the proper "Notices" have been received, Defendant retains the right to rescind the contract, which, by his verification of this Answer, by expressing his desire to do so herein and by mail directed to Plaintiff and counsel, (attached hereto as Defendant's Exhibit "A") does hereby rescind this contract. WHEREFORE, Defendant demands that Plaintiff's Complaint be dismissed with prejudice and judgment entered for the Defendant. II. Impossibility of Performance 34. Paragraphs 1-33 are incorporated herein by reference hereto. 35. Defendant could not complete his obligation on the contract with Plaintiff, i.e. to work for one year and be excused from payment of the contract sales price, because Plaintiff improperly terminated his contract of employment. WHEREFORE, Defendant demands that Plaintiff's Complaint be dismissed with prejudice and judgment entered for the Defendant. III. Breach of Contract 36. Paragraphs 1-35 are incorporated herein by reference hereto. 37. Plaintiff breached the Installment Contract with the Defendant by terminating his employment improperly and failing to cancel his obligations under the contract. 38. Plaintiff breached the contract with the Defendant by failing to pay him the bonuses he had earned. WHEREFORE, Defendant demands that Plaintiff s Complaint be dismissed with prejudice and judgment entered for the Defendant. COUNTERCLAIMS I. Unconscionability 39. Paragraphs 1-38 are incorporated herein by reference hereto. 40. In terminating Defendant's contract without good cause and in a discriminatory manner, Plaintiff acted unconscionably. 41. In seeking the full amount of the contract versus Plaintiff s actual liquidated damages, Plaintiff s claims amount to an unconscionable penalty prohibited by law. 42. Said discrimination and penalty are unconscionable and have caused Defendant pain and suffering in an unliquidated amount of at least One Thousand Dollars ($1,000). WHEREFORE, Defendant demands judgment against Plaintiff in an unliquidated amount of One Thousand Dollars ($1,000), within the amount required for referral to Arbitration. II. Unfair Trade Practices and Consumer Protection Law 43. Paragraphs 1-42 are incorporated herein by reference hereto. 44. Plaintiff s attempt to collect this debt, knowing that said contract was improperly terminated and the debt therefore was not due, violates Pennsylvania's Fair Credit Extension Uniformity Act at 73 P.S. Section 2270.4(b)(5)(ii), and Pennsylvania's Unfair Trade Practices and Consumer Protection Law, 73 P.S. Section 201-1 et.seq. 45. Said attempt also violates the Unfair Trade Practices and Consumer Protection Law in that Plaintiff failed to comply with the written guarantee of employment for the duration of the contract, absent violation of the Rules and Regulations, (73 P.S. Section 201-2(4) (xiv); and, in a fraudulent and deceptive manner, improperly terminated Defendant's contract for reasons unrelated to his driving skills. 201-2(4)(xxi). 46. Defendant suffered actual damages in the total amount of $16,000 representing loss of income for 8 months. 47. Plaintiff further misrepresented that Defendant would receive a bonus of $1000 per referral, resulting in actual damages to Defendant in the amount of $3000 (201-2(4)(xxi). 48. Plaintiff is liable to Defendant for statutory damages pursuant to 73 P.S. 201-9.2 and dismissal of its case for its willful and deliberate conduct. WHEREFORE, Defendant demands judgment against Plaintiff in the total amount of $19,000, requiring submission to Arbitration, and dismissal of Plaintiff's Complaint, with prejudice. III. Breach of Contract 49. Paragraphs 1-48 are incorporated herein by reference hereto. 50. In terminating Defendant's contract with the Plaintiff for reasons other than Defendant's actual performance, Plaintiff has breached the said contract as to the Defendant. 51. In failing to reward Defendant for sending three referrals to the Plaintiff, Plaintiff has breached the contract as to the Defendant. 52. As a result of said breach, Defendant has been damaged by the Plaintiff in the total amount of $19,000. WHEREFORE, Defendant demands that judgment be entered in his favor and against the Plaintiff in the total amount of $19,000 requiring submission to compulsory arbitration.
