CRIDER and DONNA M. CRIDER, ) NO. 2008 - /Ys-Z ??•-- Defendants ) COMPLAINT AND NOW comes the Plaintiff, Hempt Bros., Inc., by and through its counsel, Michael L. Bangs, Esquire, and in support thereof files the following Complaint: 1. Plaintiff, Hempt Bros., Inc., is a Pennsylvania corporation with its principal place of business at 205 Creek Road, Camp Hill, Cumberland County, Pennsylvania (hereinafter referred to as "Hempt"). 2. Defendants Richard D. Crider and Donna M. Crider are adult individuals and husband and wife who reside at 47 Fleisher Road, Marysville, Perry County, Pennsylvania (hereinafter referred to as "Guarantors"). 3. Guarantors were the principals of Crider Excavating, Inc. 4. Guarantors provided a personal guarantee for a credit account opened for Crider Excavating, Inc. with Hempt, which is attached hereto and marked as Exhibit A. 5. Crider Excavating, Inc. purchased certain materials from Hempt at certain times in the quantities indicated on the attached statement of account which is marked as Exhibit B and incorporated herein by reference. 6. The outstanding balance owed by Crider Excavating, Inc., to Hempt is $22,009.68. 7. Per the terms of the invoices, Hempt is entitled to receive interest at the rate of one (I%) percent per month for all outstanding invoices due over thirty (30) days. 1 8. Hempt recently received notice that Crider Excavating, Inc., filed for bankruptcy protection. 9. Under the terms of the guarantee, the Guarantors have personally guaranteed the payment of all outstanding amounts due and owing by Crider Excavating, Inc. 10. As a result of the failure of Crider Excavating, Inc., to pay the outstanding balance due, the Guarantors are jointly and severally liable for the outstanding balance due and owing to Hempt. 11. Guarantors are also obligated to Hempt for all costs and expenses incurred by Hempt, including its reasonable attorney's fees, which are incurred for enforcement of this guarantee. 12. Hempt has engaged Michael L. Bangs, Esquire, at the rate of $195.00 per hour to pursue collection of the outstanding balance due under the guarantee and Guarantors are obligated to pay any and all attorney's fees incurred by Hempt. 13. Guarantors owe Hempt the amount of $22,009.68 plus its reasonable attorney's fees, plus interest at the rate of one (I%) percent per month for all outstanding invoices due over thirty (30) days, to be calculated until the time of judgment in this case, plus costs of suit. WHEREFORE, Hempt demands judgment in the amount of $22,009.68, plus attorney's fees at the rate of $195.00 per hour calculated up to the time of judgment in this case, plus 2 HBI CRIDER COMPLAINT / DISK 120 / FEBRUARY 18. 2008 interest at the rate of one (I%) percent per month for all outstanding invoices due over thirty (30) days, to be calculated until the time of judgment in this case, plus costs of suit.
