Home My WebLink About02-13-08 FAMILY SETTLEMENT AND FINAL RELEASE IN THE ESTATE OF PAULINE E. KECK ESTATE NUMBER 21-07-1073 KNOW ALL MEN BY THESE PRESENTS, that: WHEREAS, Pauline E. Keck, late of Cumberland County, Pennsylvania, died testate on November 6,2007, having first made her last Will and Testament which was duly executed on December 12, 2006; and, WHEREAS, the said last Will and Testament named Cindy A. Keck, Executrix of her last Will and Testament; and, WHEREAS, Letters Testamentary were duly issued by the Register of Wills of Cumberland County, Pennsylvania to Cindy A. Keck on November 21, 2007; and, WHEREAS, the Executrix has gathered the assets of the estate of the said decedent and the assets consisted of a money market account and various other small financial assets and refunds, to a total value of $83,474.22 , as set forth in the Statement of Account of Executrix which has been attached hereto as "Exhibit A"; and, WHEREAS, the debts and deductions of principal, including the payment of Pennsylvania Inheritance Tax in the said estate, and a reserve for possible expenses which have yet to be incurred by the estate, have been made leaving a balance for distribution of $68,375.56 as set forth in "Exhibit A" attached hereto; and, WHEREAS, the balance for distribution has been reduced to cash and is available for distribution in accordance with the terms of the last will ancHestamer\.t"of ___ c-'=' -T; rTl co the said decedent; and, v..J E'; ...:- - - :.:, ~ en u:. WHEREAS, the "Reserve for Contingencies" of $4,000.00 shall continue to be held by the Executrix until such time as the Pennsylvania Inheritance Tax return is approved by the Department of Revenue, and all Federal, State and Local taxes have been paid and the accountant has been paid therefor, and thereafter the funds remaining in the reserve shall be distributed according to the terms of the decedent's Last Will and Testament. NOW, THEREFORE, KNOW YE, we do hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, we agree that no account is necessary and we do hereby agree that we do consent to distribution being made in accordance with the Statement of Proposed Distribution which is attached hereto as "Exhibit B," without the filing of an account and schedule of distribution, the same to be with the same force and effect as if they had been filed and confirmed by the Orphans' Court Division of the Court of Common Pleas of Cumberland County; THEREFORE, we do hereby covenant and agree that should any liability come due to the estate of the said decedent after the signing of this agreement, we covenant and agree that we will pay any legally enforceable claims, demands, suits, or causes of action which may be successfully prosecuted against the said estate or the aforesaid personal representative after the signing, sealing and delivery of this family settlement agreement and final release.
