PETITION TO PROCEED IN FORMA PAUPERIS
PURSUANT TO PA. R. C. P. 240
Petitioner, Robert L. Horrocks, Pro se, requests this court to permit him
to proceed in forma pauperis and in support therefof avers the following:
1. Petitioner in incarcerated at the State Correctional Institution at
Frackville, Pennsylvania.
2. Petitioner is indigent with no assets.
3. Petitioner is unemployed except for low paying prison wages.
4. Petitioner cannot afford to pay for filing fees and other costs.
5. Petitioner's affidavit in support of this petition is attached.
WHEREFORE, petitioner requests this court to enter an order permitting
him to proceed in forma pauperis.

FOR LEAVE TO PROCEED IN FORMA PAUPERIS
1. I am the petitioner in the above matter and because of my financial
condition am unable to pay the fees and costs of prosecuting the action.
2. I am unable to obtain funds from anyone, including my family and
associates, to pay the costs of litigation.
3. I represent that the information below relating to my ability to pay
the fees and costs is true and correct:

PETITION FOR WRIT OF HABEAS CORPUS
TO THE HONORABLE JUDGES OF SAID COURT:
Petitioner, Robert L. Horrocks, Pro se, respectfully requests this Court
to issue a writ of Habeas Corpus, and represents:
1. Petitioner is currently incarcerated at the State Correctional
Institution at Frackville, Pennsylvania. His mailing address is SCI
Frackville, 1111 Altamont Blvd., Frackville, PA 17931.
3. Respondent, Robert Shannon, is the Warden of the State Correctional
Institution at Frackville. His mailing address is SCI Frackville, 1111
Altamont Blvd., Frackville, PA 17931
4. On July 30, 2002, this Court sentenced petitioner to a period of
imprisonment of not less than 9 months nor more than 24 months for Theft by
Unlawful Taking or Disposition, a period of imprisonment of not less than 112
months no more than 24 months for Theft by Unlawful Taking or Disposition, and
a period of imprisonment of not less than 4 months nor more than 24 months for
Bad Checks. These sentences were ordered to "commence on [July 30, 2002], and
shall run concurrently with each other, and concurrently with any other
sentence presently being served." (See Attachment A-3).
5. On this same date defendant was sentenced to a tern of imprisonment of
not less than 8 months nor more than 24 months for Forgery. This sentence was
ordered to "run consecutive to the sentences imposed herein and consecutive to
any other sentence presently being served by Defendant." (See Attachment A-3).

6. At the time of petitioner's sentencing hearing, he was already serving
a sentence of 5 years in the Connecticut Department of Corrections for
Larceny, Second Degree, which began on February 27, 2001 and expired on
February 27, 2006. (See Attachment B).
7. According to this Court's sentence, petitioner's Theft and Bad Check
sentences ran concurrently with the Connecticut sentence, expiring on July 30,
2004.
8. According to this Court's sentence, petitioner's Forgery sentence ran
consecutive to the Connecticut sentence, becoming effective on February 28,
2006 and expiring on February 28, 2008.
9. Petitioner's initial SENTENCE STATUS SUMMARY, issued by the
Pennsylvania Department of Corrections ('DOC'), reflected petitioner's
accurate maximum sentence date of February 28, 2008. (see Attachment C).
10. On January 10, 2008, petitioner was informed by the records
department at SCI Frackville, that his "sentence structure has changed" and
that his new maximum date was February 28, 2010. This change was recorded on
a revised SENTENCE STATUS SUMMARY which the DOC issued to petitioner. (See
Attachment D).
11. This new SENTENCE STATUS SUMMARY fails to recognize that petitioner's
Theft and Bad Check sentences were ordered to run concurrently with
petitioner's Connecticut sentence and that the sentence became effective on
July 20, 2002.
12. The DOC, by miscalculating the this Court's sentence, is extending
petitioner's sentence by two years.
13. Without intervention by this Court, in the form of a writ of habeas
corpus, petitioner will be wrongfully incarcerated for a period of two years.

by Unlawful Taking or Disposition, a misdemeanor of the
first degree, and Count 1-C Theft by Unlawful Taking or

At number 02-0816 Criminal Term, Count 1-A,
Theft by Unlawful Taking or Disposition, the Defendant is
sentenced to pay the costs of prosecution, and undergo
imprisonment in a State Correctional Institution for a
period of not less than 9 months nor more than 24 months.
At number 02-0816 Criminal Term, Count 1-C;
Theft by Unlawful Taking or Disposition, the Defendant is
sentenced to pay the costs of prosecution, and undergo.a
period of imprisonment in, a State Correctional Institution
of not less than 12 months nor more than 24 months.
At number 02-0816 Criminal Term, Count 3,
Forgery, the Defendant is,sentenced to pay the costs of
prosecution, and make restitution in the amount of
$1,750.00 to Cathy McKee, and to undergo imprisonment in a
State Correctional Institution for a period of not less
than 8 months nor more than 24 months.

Bad Checks, the Defendant is sentenced to pay the costs of
prosecution,-and-make restitution in the amount of $635.73

SUGGESTION OF MOOTNESS
Respondent, by and through his attorney, Timothy A. Holmes, Assistant
Counsel for the Pennsylvania Department of Corrections, requests that the Court
dismiss the Petition for Writ of Habeas Corpus as moot. The following is averred
in support of this Suggestion of Mootness:
Parties:
1. Petitioner, Robert Horrocks was incarcerated in the State
Correctional Institution at Frackville when he filed his Petition. See Petition, 11.
2. Respondent is Robert Shannon, the Superintendent for the State
Correctional Institution at Frackville. See Petition, 12.
Procedural History:
3. Petitioner filed his Petition with the Court on March 3, 2008.
Nature of the Claim:
4. On February 27, 2001, Petitioner received a five year sentence in
Connecticut for Larceny. See Petition, ¶ 6.
5. While Petitioner was serving the Connecticut sentence, the Honorable
J. Wesley Oler, Jr. of the Cumberland County Court of Common Pleas on July 30,
2002, sentenced Petitioner to serve nine to twenty-four months of incarceration for
Theft. The sentence was to run concurrently with any sentence Petitioner was
serving. See Petition, ¶ 4.
6. On this same day, Judge Oler also sentenced Petitioner to serve eight
to twenty-four months for Forgery. The sentence was to run consecutively to any
sentence Petitioner was serving. See Petition, ¶ 5.
7. When Petitioner filed his Petition, the Department of Corrections staff
did not calculate his Forgery sentence as running concurrently with his Connecticut
sentence; therefore, he had a maximum release date of February 28, 2010. See
Petition, Attachment D-1.
8. As relief, Petitioner sought to have the Court order his release from
prison. See Petition, Wherefore Clause.

Reason for Petition being Moot:
9. Department employees have re-calculated Petitioner's maximum
release date to be February 28, 2008 as Petitioner requested. See DC 16E, page
1, attached hereto as "Exhibit A".
10. Petitioner has been released from the care, custody, and control of
the Department of Corrections. See Inmate Query - Summary, Sentence
Status/Date attached hereto as "Exhibit B"
WHEREFORE, Respondent respectfully requests that the Court dismiss
the Petition for Writ of Habeas Corpus as moot.
