1N RE: CONDEMNATION OF EASEMENT AND RIGHT-OF-WAY CONSISTING OF 828 SQUARE FEET OF LANDS OF OWNERS UNKNOWN : IN THE BOROUGH OF MOUNT HOLLY: NO. 2004 - SPRINGS, CUMBERLAND COUNTY, : PENNSYLVANIA BY THE BOROUGH : OF MOUNT HOLLY SPRINGS FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A BRIDGE AND ROADWAY ON EAST PINE STREET OVER MOUNTAIN CREEK IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION - LAW IN REM (EMINENT DOMAIN) DECLARATION OF TAKING AND NOW, the BOROUGH OF MOUNT HOLLY SPRINGS, a governmental unit created and existing under the laws of the Commonwealth of Peunsylvania, hereby files this Declaration of Taking and declares as follows: 1. The Condemnor is the BOROUGH OF MOUNT HOLLY SPRINGS, having is principal office at 200 Harman Street, Mount Holly Springs, Cumberland County, Pennsylvania. 2. This Declaration of Taking is filed pursuant to the authority of the Borough Code, Act of February 1, 1966, P.L. (1965) --, No. 581, Section 101, et seq. (53 P.S. ~ 45101, et seq.) specifically Section 1501 (53 P.S. § 46501), as amended and supplemented. 3. This Declaration of Taking is made and authorized by virtue ora Resolution duly adopted by the Borough Council of the Borough of Mount Holly Springs at a public meeting held on January 12, 2004 at the Office of the Borough of Mount Holly Springs identified in Paragraph 1, above. The record of said public meeting, being the minutes thereof and the original Resolution may be examined at the office of the Borough Secretary, Municipal Building, 200 Harman Street, Mount Holly Springs, Pennsylvania, a copy of said Resolution being attached hereto and marked "Exhibit 1" and incorporated herein by reference thereto. 4. The purpose of this condemnation and Declaration of Taking filed incidental thereto is to acquire and secure an easement and right-of-way in lands in, under, on and through said lands for purposes presently and perpetually thereafter to erect, construct, install, operate, maintain and repair a bridge and/or roadway, together with all appurtenances, parts and structures associated or to be associated thereon and therewith, and to otherwise use and maintain said premises within and as part of the public roadway system of the Borough. 5. Attached hereto marked "Exhibit 2" and incorporated herein is documentation which contains the description and designation of the land situated in the Borough of Mount Holly Springs, necessary to be obtained for the purposes aforesaid, which land consists of 828 square feet and is designated "Required Right of Way Area" thereon. A copy of said documentation mentioned in the said Exhibit will be filed as of the date of the filing hereof in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania at the Cumberland County Courthouse in Carlisle, Pennsylvania in accordance with Section 404 of the Eminent Domain Code, Act of June 22, 1964 (Special Session), P. L. 84, Article IV, as amended. 6. The nature and extent of the easement and right-of-way in, under, on and through the lands is for the purposes of erecting, constructing, installing, operating, maintaining and repairing a bridge and associated roadway and all appurtenances, parts and structures associated therewith as more fully set forth in Section 2 of the said Resolution ("Exhibit 1 "), which said Section is incorporated by reference herein. 7. The names and addresses of the Condemnees and therefore the owners of the land which is subject to the Declaration of Taking are unknown, there being no ascertainable title owner of said land, the majority of which lies in the bed of the stream of Mountain Creek. -2- 8. An unknown person or persons are the owners in fee simple of the land being taken, appropriated and condemned. 9. A Plat describing and showing the condemned land may be inspected at the office of the Borough of Mount Holly Springs, 200 Harman Street, Mount Holly Springs, Pennsylvania, 17065. 10. The Borough of Mount Holly Springs, as Condemnor, files contemporaneously herewith its Bond, without surety, pursuant to Section 403(a) of the Eminent Domain Code aforesaid, which Bon secures just compensation to any Condemnee. WHEREAS, the Borough of Mount Holly Springs (hereinafter the "Borough") is a governmental unit created and existing under the laws of the Commonwealth of Pennsylvania situated in Cumberland County, Pennsylvania; and WHEREAS, the Borough desires to replace the existing bridge on East Pine Street crossing over Mountain Creek and the corporate authorities of the Borough, the Borough Council, believes replacement of the aforementioned bridge is in the best interest of the public safety and welfare of the residents of the Borough and persons who travel on the roadways within the Borough; and WHEREAS, it is necessary that the Borough acquire and secure the necessary and appropriate lands for purposes of replacing the bridge on East Pine Street crossing over Mountain Creek; and WHEREAS, the Borough has identified certain land in the Borough of Mount Holly Springs which is necessary for the replacement of the bridge on East Pine Street, which land consists of 828 square feet and is more fully described and depicted on the "Required Right of EXHIBIT 1 Way.Area" on the Plat attached hereto and incorporated by reference herein as "Exhibit A"; and WHEREAS, the land being subject to the proceeding is owned by a pei'son or persons unknown, there being no ascertainable recorded deed or instrument noting ownership of or claim of ownership to the subject land; and WHEREAS, pursuant to the Borough Code, Act of February I, 1966, P. L. (1965) --, No. 581, Section 101, et seq. (53 P.S. § 45101, et seq.) specifically Section 1501 (53 P.S. § 46501), the Borough is authorized and empowered to acquire, secure and appropriate such lands or property according to the proceedings set forth in the law governing eminent domain; NOW THEREFORE, on motion duly made, seconded and duly passed by the Borough of Mount Holly Springs, through the Borough Council, it is hereby RESOLVED: SECTION 1: The foregoing title, preamble and paragraphs are incorporated herein by reference thereto. SECTION 2: The Borough hereby selects, condemns and appropriates those premises described and set forth on Exhibit A hereto as the "Required Right of Way Area" and consisting of 828 square feet, said premises being owned by person or persons unknown. The nature and extent of the title and interest to be acquired under this Section 2 is a right of way or easement in, under, on and through the premises for the purposes presently and perpetually thereafter to erect, construct, install, operate, maintain and repair a bridge and/or roadway, together with all appurtenances, parts and structures associated or to be associated thereon and therewith, and to otherwise use and maintain said premises within and as a part of the public roadway system of the Borough. -2- · SECTION 3: The Borough, its Council and its proper officers are hereby authorized to fil~ such Declarations of Taking and other such papers, documents and/or proceedings, including the entry of such bond as may be necessary or desirable, and to do and perform all other acts necessary and requisite to carry out the purposes of this Resolution, and said officers and the Borough's employees and agents are authorized and empowered to enter on the premises to be taken, condemned and appropriated in order to make studies, surveys, tests and appraisals. SECTION 4: The institution of such proceedings, including the entry of such bond as may be necessary or desirable, and any damages which may be awarded to the owner or owners of the premises or lands shall be paid from such funds which may become available and from time to time appropriated by Council for such purposes. This condemnation was initiated in preparation for the replacement of the vehicle and footbridge over Mountain Creek on East Pine Street in the Borough of Mount Holly Springs. 6. The property which is subject to this condemnation consists of 828 square feet, the majority of which is located in the bed and bank of Mountain Creek and is described as "required right of way area" on the plat attached hereto and incorporated by reference herein as '*Exhibit 7. A diligent search of the deeds and records in the Office of the Recorder of Deeds of Cumberland County as well as a survey of the subject area revealed no ascertainable owners of the area of land subject to this condemnation proceeding. 8. Notice to the condemnees of the filing of the Declaration of Taking as required by Section 405 of the Eminent Domain Code (26 P.S. {} 1-405) was given by posting of the subject property on January 23, 2004 and by publication in the .Cumberland _[,.aw _Journal on January 30, 2004 and The .Sentinel on February 14, 2004. Section 407(a) of the Eminent Domain Code (26 P.S. § 1-407(a)) provides, inter alia, that the condemnor shall be entitled to possession or right of entry upon payment of just compensation by the condenmor. 10. Section 522 of the Eminent Domain Code (26 P.S. § 1-522) provides, inter alia, that if the party entitled to the estimated just compensation cannot be found or for any other reason the same cannot be paid to the party entitled thereto, the court upon petition of the condemnee may direct payment thereof and costs into court as the court may direct in full satisfaction thereof. 11. The estimated just compensation for the permanent right-of-way area condemned as determined by the Pennsylvania Department of Transportation and as estimated by the Condemnor is $3,000.00. 12. Section 522 of the Eminent Domain Code further provides that the Condemnor shall give twenty days notice of the presentation of the petition, including a copy of the schedule of the proposed distribution, to all parties in interest known to the condemnor in such manner as the court by general rule or special order may direct. A copy of the proposed Notice with a Schedule of Proposed Distribution is attached hereto and incorporated by reference herein as "Exhibit C". WHEREFORE, Petitioner requests this Court to: A. Issue a Rule directed upon all parties in interest to show cause, if any they should have, why the Court should not direct payment of estimated just compensation by Condemnor into Court; B.
