(') 1./ - G'()iL~€a....~ Plaintiffs, MERLE R. and NANCY A. EPPLEY Defendants. CIVIL COMPLAINT I. Plaintiff David M. Trexler is the parent and natural guardian of the minor David C. Trexler (d.o.b. 12/30/85), both current residing at 108 Sarkuni Avenue, Harrisburg, Dauphin County, Pennsylvania, 17110. 2. Plaintiff David C. Trexler is an adult individual currently residing at 108 Sarkuni Avenue, Harrisburg, Dauphin County, Pennsylvania, 17110. 3. Defendants Merle R. and Nancy A. Eppley are husband and wife currently residing at 1165 Rhoda Boulevard, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 4. On August 23, 2002 Minor Plaintiff David C. Trexler, was driving a 2002 Ford Taurus owned by Aero Corporation, t/d/b/a Budget Rental Car ("Budget"). 5. On the aforesaid date, Nancy A. Eppley was the driver and Merle R. Eppley was the owner of a 1998 Ford Explorer SUV. 6. On the aforesaid date, Minor Plaintiff David C. Trexler was driving the aforementioned 2002 Ford Taurus and was stopped at a traffic light at the 200 block of North York Street in Mechanicsburg, Cumberland County, Pennsylvania. f. operating her vehicle in careless disregard for the safety of persons and/or property in violation of75 Pa.C.S.A., 9 3714 and applicable law; g. failing to keep her vehicle under proper and adequate control so as not to expose other users to unreasonable risk of harm; h. failing to maintain her vehicle to insure it properly operates; 1. operating her vehicle at a speed greater than would permit her to bring her vehicle to a stop within the assured clear distance ahead in violation of 75 Pa.C.S.A., 9 3361 and applicable law; J. operating her vehicle at a speed greater than is reasonable and prudent under the conditions with regard to the hazard existing in violation of 75 Pa.C.S.A., 9 3361 and applicable law; k. following too closely in violation of 75 Pa.C.S.A., S 3310 and applicable law; I. failing to stop for backed-up traffic; m. striking another vehicle in the rear, propelling it into Plaintiffs vehicle; n. failing to slow or stop and failing to obey traffic control signals III violation of75 Pa.C.S.A., 9 3112 and applicable law; o. failing to familiarize herself with the roadway; p. not paying attention to her surroundings; q. driving her vehicle in reckless disregard for the safety of persons and or property in violation of75 Pa.C.S.A., 9 3736 and applicable law; and r. failing to obey traffic control devices in violation of 75 Pa.C.S.A., S 3111 and applicable law. 12. Pursuant to attaclunent, page 2 of 5 of his contract with Budget, Plaintiff David M. Trexler was aware that the Ford Company would not accept the 2002 Ford Taurus back with more than two-thousand dollars ($2,000.00) worth of damages sustained. 13. The 2002 Ford Taurus sustained more than $2,000.00 in damage as a result of Defendant Nancy EpplC;Y's negligence. 294407 -I 3 , 14. Further this contract was for a long term lease and Plaintiff David M. Trexler did not select the additional insurance coverage through Budget at the time he rented the vehicle. 15. In addition, pursuant to paragraph four of the contract, Plaintiff David M. Trexler was responsible for all loss of and damage to the vehicle, regardless of fault and any reduction in value of the vehicle after repair, actual towing from the storage impound and other related expenses, plus Budget's loss of use and administrative charge for expenses associated with processing the loss and damage claim. 16. As a result of the negligence of Defendants and Ford's refusal to take back the 2002 Ford Taurus, the vehicle was sold at auction for a net amount of Nine Thousand One Hundred Twenty-Nine Dollars and Fifty Cents ($9,129.50): Blue Book value of vehicle if not wrecked: $15,111.46 Amount received for vehicle at auction on January 22,2003: $9.129.50 16. Additionally, Budget claimed a loss of use of the vehicle in the amount of Two Thousand Fifty-One Dollars and Forty-Four Cents ($2, 051.44), calculated based upon Nine- Nine Dollars and Ninety-Five Cents ($49.95) a day for a period of sixty four (64) days. 17. As a direct and proximate result of the collision and the negligent, careless and reckless conduct of Defendant Nancy A. Eppley, Plaintiff David M. Trexler was forced to pay to Budget the sum of $8,033.40 for the following damages: 294407-] 4 Loss of use for 8/24/02 through 9/30/02 $ 2,051.44 Diminished value of wrecked vehicle: Blue Book value of vehicle ifnot wrecked: $15,111.46 Amount received for vehicle at auction on January 22,2003: $9,129.50 5.981.96 TOTAL: $ 8,033.40 18. Plaintiff David M. Trexler was contractually liable to Budget for the damages for the vehicle pursuant to the rental agreement. 19. The damages to the 2002 Ford Taurus were due to the sole fault and negligence of Defendants. 20. Therefore, the damages sustained by Plaintiff David M. Trexler were foreseeable contractual damages caused by the negligence of Defendants. WHEREFORE, Plaintiffs David M. Trexler, as Parent and Natural Guardian of Minor Plaintiff David C. Trexler, and David M. Trexler, in his own right, demand judgment in their favor and against Defendants Merle R. and Nancy A. Eppley for the aforesaid damages in an amount which does not exceed the limits of compulsory arbitration in Cumberland County, Pennsylvania, plus interest and/or damages for delay and cost ofprosecution. R.C.P. 1038,1 I. Plaintiff David M. Trexler is the parent and natural guardian of the minor David C. Trexler (d.o.b. 12/30/85), both current residing at 108 Sarkuni Avenue, Harrisburg, Dauphin County, Pennsylvania, 17110. 2. Plaintiff David C Trexler is an adult individual currently residing at 108 Sarkuni Avenue, Harrisburg, Dauphin County, Pennsylvania, 17110. 3. Defendants Merle R. and Nancy A. Eppley are husband and wife currently residing at 1165 Rhoda Boulevard, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 4. On August 23, 2002 Minor Plaintiff David C Trexler, was driving a 2002 Ford Taurus owned by Aero Corporation, t/d/b/a Budget Rental Car ("Budget"). 1 5. On the aforesaid date, Nancy A. Eppley was the driver and Merle R. Eppley was the owner of a 1998 Ford Explorer SUV. 6. On the aforesaid date, Minor Plaintiff David C. Trexler was driving the aforementioned 2002 Ford Taurus and was stopped at a traffic light at the 200 block of North York Street in Mechanicsburg, Cumberland County, Pennsylvania. 7. On the aforesaid date at approximately 3:45 p.m. Defendant Nancy A. Eppley failed to stop the 1998 Ford Explorer she was driving, struck another vehicle in the rear, causing that car to rear-end the Minor Plaintiffs vehicle, subsequently causing the Minor Plaintiffs vehicle to rear-end a vehicle immediately in front of his vehicle, which was also lawfully stopped at the traffic light (the "Accident"). 8. Plaintiff David M. Trexler was contractually obligated for the use and rental of the Ford Taurus as is set forth in Exhibit "A" attached hereto (the "Contract"). 9. Defendant Nancy A. Eppley owed a duty to other lawful users of the roadways in the Commonwealth of Pennsylvania to operate her vehicle in such a way as not to cause hann or damage to said other persons and to Plaintiffs in particular. 10. Defendant Nancy A. Eppley breached her duty to Plaintiffs which caused Plaintiffs Property Damage only, but did not cause Bodily Injury. 11. Pursuant to attachment, page 2 of 5 of his contract with Budget, Plaintiff David M. Trexler was aware that the Ford Company would not accept the 2002 Ford Taurus back with more than two-thousand dollars ($2,000.00) worth of damages sustained. 12. The 2002 Ford Taurus sustained more than $2,000.00 in damage. 13. The Contract was for a long term lease and Plaintiff David M. Trexler did not select the additional insurance coverage through Budget at the time he rented the vehicle. 2 ] 4. In addition, pursuant to paragraph four of the Contract, Plaintiff David M. Trexler was responsible for all loss of and damage to the vehicle, regardless of fault and any reduction in value of the vehicle after repair, actual towing from the storage impound and other related expenses, plus Budget's loss of use and administrative charge for expenses associated with processing the loss and damage claim. ] 5. After Ford refused to take back the 2002 Ford Taurus, the vehicle was sold at auction for a net amount of Nine Thousand One Hundred Twenty-Nine Dollars and Fifty Cents ($9, ]29.50). ] 6. The "Blue Book" value of the vehicle at the time of the auction sale, had it not been involved in the Accident, was $] 5,] ] 1.46. ] 7. Pursuant to the Contract, Budget charged Plaintiff, David M. Trexler for loss of use of the vehicle in the amount of Two Thousand Fifty-One Dollars and Forty-Four Cents ($2,051.44), calculated based upon Forty-Nine Dollars and Ninety-Five Cents ($49.95) a day for a period of sixty four (64) days. ]8. Plaintiff David M. Trexler did pay to Budget the sum of $8,033.40 for the following Property Damage: Loss of use for 8/24/02 through 9/30/02 $ 2,05].44 Diminished value of wrecked vehicle: Blue Book value of vehicle ifnot wrecked: Amount received for vehicle at auction on January 22, 2003: $]5,]] 1.46 $9.129.50 5,981.96 TOTAL: $ 8,033.40 3 19. Plaintiff David M. Trexler was contractually liable to Budget for the damages for the vehicle pursuant to the Contract. 20. Any Property Damage to the 2002 Ford Taurus was due to the sole fault and negligence of Defendants. 21. Plaintiff suffered no Bodily Injury as a result of the Accident and/or due to the negligence of Defendants. 22. Diminished value of the vehicle, as calculated by the Defendant is $3,723.91, the actual repair cost based upon an estimate provided to Defendant. Plaintiff claims entitlement to the Diminished value which he paid to Budget in the amount of$5,981.96. 23. Loss of use, as calculated by the Defendant is $660.00, making Defendants' calculation of Property Damage $4,383.91. 24. The issue before the Court is what obligation Defendant has to Plaintiff with respect to Property Damage, and the dispute centers upon the amount of $3,649.49 (8,033.40- 4,383.91). 25. Defendant has paid Plaintiff the sum of $1,025.72 towards the Judgment to be entered in this case without prejudice to either party, and the Parties agree that this payment be credited against any Judgment entered against Defendant. 26.
