Stoneroad, of Keystone Guardianship Services, of the above-captioned incapacitated individual, petitions as follows: 1. Claire R. Weldon is presently a resident of the Sarah" A. Todd Memorial Home, located at 1000 West South Street, Carlisle, Cumberland County, Pennsylvania. 2. Claire R. Weldon is receiving a monthly social security payment paid directly to the representative payee, Sarah A. Todd Memorial Home in the amount of $545.00 toward her care and housing. 3. Keystone Guardianship Services was appointed Guardian for Claire R. Weldon, an alleged incapacitated person by the Cumberland Count~y Orphans Court by order dated August 6, 2007. 4. There is no burial reserve set up for the funeral expenses of Claire R. Weldon. There is a life insurance policy held with ING ReliaStar Life Insurance Company with a cash surrender value of $3,415.10 as of April 19, 2007. Page 1 of 5 Pages \' I "-1:, Estate Claire R. Weldon An Incapacitated Person 5. At the time of Keystone Guardianship Services' appointment there was a pending Appeal with the Department of Welfare for denied SSI benefits. The Appeal was initiated by Claire Weldon's son, Roy Willoughby. Many hours were spent to investigate, doing research, correspondence (in person, by telephone, faxes, letters, memos and e-mails) compiling reports and responses. (see copy of report to Department of Welfare attached as Exhibit "1"). 7. At the time of Keystone Guardianship Services' appointment Claire Weldon was the owner of the Goldring & Lipman, Inc. Corporation, serving as the President, Secretary and Treasurer of the same. The purpose of said Corporation being to manage the Weldon Cafe and conduct all lawful business therein. 8. Claire R. Weldon is the sole owner of the Real Estate located at 523 S. 19th Street, Harrisburg, Dauphin County, Pennsylvania which houses the Weldon Cafe. 9. At the time of Keystone Guardianship Services' appointment there was a pending sale of the real estate known as 523 S. 19th Street, Harrisburg, Dauphin County, Pennsylvania, (a/k/a "The Weldon Cafe") deeded to Claire Weldon; the equipment, and Pennsylvania Liquor License owned by Goldring & Lipman, Inc. 10. The Guardian is presently waiting for the clearance and payment of citation written by the Liquor Control Board to complete the transfer of the liquor license and transfer of the real estate for the payment of the same as per the agreement of sale dated August 22, 2007. Upon the conclusion of the real estate and PA Liquor License transfers, it is anticipated that the estate will receive a gross amount of $140,000.00. 12. The anticipated costs and expenses of the sale of the real estate and Pa Liquor License the net amount will be approximately $90,000.00. 13. In view of the work involved In this Guardianship administration, Keystone Guardianship Services is respectfully requesting the Court allow the payment of the fees and costs relative to the work preformed paid from the proceeds of the sale of the Pennsylvania Liquor License, equipment and the Real Estate know as the Weldon Caf~ in the amount of $2,730.21 (see attached statement attached as Exhibit U2") 14. The Guardian has evidence that Janice Young and her fianc~, Eugene M. Gingrich, managed and operated the Weldon Caf~ from December 10, 2003 to December 31, 2007, deposited their personal funds into the corporation Goldring & Lipman, Inc., to bring the Weldon Caf~ to a standard to be reopened by the Department of Health and to assure the security of the Pa Liquor License. The funds deposited have been reviewed by Keystone Guardianship Services and appear to be of a necessary and an ordinary nature for the operation and maintenance of The Weldon Caf~. (see copy of list of expenses and evidence of payment of the same and amount paid back by the Corporation attached as Exhibi t "3") Page 3 of 5 Pages 15. Keystone Guardianship Services is respectfully requesting the Court allow the reimbursement to Janice Young and Eugene M. Gingrich from the proceeds of the sale of the Pennsylvania Liquor License, equipment and the Real Estate know as the Weldon Cafe in the amount of $11,206.63. 16. Claire R. Weldon has an outstanding claim from Sarah A. Todd Memorial Home dated 2/12/2008 in the amount $97,114.78, (see copy of statement attached as Exhibit "4"). 17. Claire R. Weldon has a Statement Savings Account held by Sara a. Todd Memorial Home in the amount of $4,375.67. (see copy of statement attached as Exhibit "5"). 18. It is the intent of Keystone Guardianship Services to pay funds remaining after the settlement of all of the affairs regarding the Goldring & Lipman Corporation (a/k/a The Weldon Cafe) to the Sarah A. Todd Memorial Nursing Home toward the Wards cared. Keystone Guardianship Services has begun the process of filing for assistance through Department of Welfare for payment expenses for the Ward relative to her care at the Sarah A. Todd Memorial Nursing Home. the of WHEREFORE, the aforementioned guardian respectfully requests this Honorable Court enter an Order directing the following: 1. It only met the code regarding a bar. 5. Mr. Maxwell is not aware of any gifts out of the business. He entered the sale of Mrs. Weldon's residence as income and expense only. I OTHER INFORMATION I HA VE HEARD OR FOUND 1. There is a life insurance police which Sara Todd Memorial has a copy of information regarding. Janice is paying $35.00 a month to keep it going. We will try to contact the company to have a change of beneficiary or see if it has a cash surrender value to pay for a prearranged prepaid funeral. 2. I am working with Janice to obtain receipts for the bills that were paid by Janice and Mike for the Weldon Cafe. 3.
