Latchford, Jr. Defendant CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE And now comes First Horizon Home Loans, a Division of First Tennessee Bank, National Association, by its attorneys, Zucker, Goldberg & Ackerman, LLC, and files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff, First Horizon Home Loans, a Division of First Tennessee Bank, National Association, which has its principal place of business at 4000 HORIZON WAY, IRVING, TX 75063. 2. The Defendant, Chester A. Latchford, Jr., is an individual whose last known address is 148 Henry Road, Township of East Pennsboro, Enola, PA 17025. Zucker, Goldberg & Ackerman, LLC XFP-99638 3. On or about January 27, 2006, Chester A. Latchford, Jr. executed a Note in favor of Nations Home Mortgage Corporation in the original principal amount of $142,709.00. 4. On or about January 27, 2006, as security for payment of the aforesaid Note, Chester A. Latchford, Jr. made, executed and delivered to Mortgage Electronic Registration Systems, Inc. as nominee for Nations Home Mortgage Corporation a Mortgage in the original principal amount of $142,709.00 on the premises hereinafter described, with said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on February 2, 2006, in Mortgage Book Volume 1939, Page 631. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "A", attached hereto and made a part hereof. 5. The aforesaid Note and Mortgage was assigned by Mortgage Electronic Registration Systems, Inc. as nominee for Nations Home Mortgage Corporation to First Horizon Home Loans, a Division of First Tennessee Bank, National Association, plaintiff herein, pursuant to an assignment of mortgage to be recorded. 6. Defendant is the record and real owner of the aforesaid mortgaged premises. 7. Defendant is in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due. S. § 1680.403 (c) (Homeowners' Emergency Mortgage Assistance Act of 1983, - Act 91 of 1983), prior to commencement of this action for the reason that the aforesaid Mortgage is insured by the Federal Housing Administration under Title II of the National Housing Act (12 U.S.C. §§1707- 1715(z) - 18) [35 P.S. §1680.401(a)(3).]. 9. The amount due and owing Plaintiff by Defendant is as follows: Principal $ 140,252.38 Interest through 03/07/2008 $ 5,522.44 Attorneys' Fees $ 1,250.00 Title Search & Costs $ 2,500.00 Late Charges $ 258.71 Escrow $ 282.97 Miscellaneous $ 113.94 Pro Rata MIP/PMI $ 15.00 Total $ 150,195.44 plus interest on the principal sum ($140,252.38) from March 7, 2008, at the rate of $788.92 per diem, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises. WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due of $150,195.44, with interest thereon at the rate of $788.92 per diem from March 7, 2008, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises.
