THIS AGREEMENT made December 15, 2003, by and between Lobar Associates of the
Pennsylvania (hereinafter called the "Contractor"), and PNC BANK, NATIONAL
ASSOCIATION.
WHEREAS, a contract dated December 15, 2003, has been entered into between the parties
hereto pursuant to which the Contractor agrees to furnish all the material and to perform all the
work shown on the drawings and specifications being made a part of said contract, and do
everything required by said contract and the drawings and specifications made a part thereof on
the aforesaid property of the Owner, all of which is situated on Camp Hill, PA.
NOW THIS AGREEMENT WITNESSETH: That in consideration of the signing of said
contract and the terms and conditions thereof, it is hereby covenanted and agreed between the
pa~ies hereto that no Mechanics' Lien or Liens shall be entered or filed against the properties of
the Owner herein above described or referred to for work done and/or labor and materials
furnished thereto under the said contract, by the Contractor, or by any subcontractors, laborers or
materialman, or any other persons whomsoever, for work and/or labor done, and/or materials
furnished upon and to said properties or upon the credit thereof under said contract, or laborers
on said work shall look to and hold the Contractor exclusively liable for the said contract and/or
labor on a and/or materials furnished on or to said work or job.
