WHEREAS, RACE KANE and ALLISON ANN MINER, (MARRIED-HUSBAND AND WlFEI of 67 LINDA
DRIVE, MECHANICSBURG, PENNSYLVANIA 1'/050, is about to execute contemporaneously herewith a
contract with HARRY L. SMITH AND SONS, INC. of , for the erection of e -~FLO0
story building upon a lot of land situate
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PURPOSES
NOW, DECEMBER 30, 2003, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to
commence work on the said building, or purchase materials for the same in consideration of the making of
the said contract with OWNER and the further consideration of one Dollar, to CONTRACTOR paid by
OWNER it is agree that no lien shall be filed against the building by the contractor, or any subcontractor,
nor by any of the material men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

LEGAL DESCRIPTION
ALL THAT CERTAIN tract of land situate in Silver Spring Township,
Cumberland County, Pennsylvania, more particularly bounded and described as
follows:
BEGINNING at a point in the middle of a public road known as Linda Drive
leading from the Wertzville Road to U.S. Traffic Route #11, at lands now or formerly of
S. M. Lehmer; thence North 55 degrees 19 minutes 42 seconds West 39.1 feet to a point;
thence still along lands now or formerly of S. M. Lehmer South 15 degrees 44 minutes 5
seconds East 6.0 feet to a point; thence still along lands now or formerly of S. M. Lehmer
North 69 degrees 32 minutes 10 seconds West 193.5 feet to a point, at lands now or
formerly of C. G. Bowman; thence along said last mentioned lands North 12 degrees 1
minute 27 seconds West 13.1 feet to a point; thence still along lands now or formerly of
C. G. Bowman North 83 degrees 45 minutes 32 seconds West 821.3 feet to a steel pin;
thence along lands now or formerly of W. W. Kelly North 12 degrees 59 minutes 57
seconds West 455.8 feet to a steel pin at lands now or formerly of Lawrence Vogelsong;
thence by lands now or formerly of Lawrence Vogelsong North 82 degrees East 404.6
feet (erroneously recited to be 519.6 feet in prior deed) to a steel pin; thence South 14
degrees 38 minutes 09 seconds East 401.59 feet to a steel pin; thence North 84 degrees 02
minutes 05 seconds East 523.6 feet to the center of said public road known as Linda
Drive; thence along the center of said public road South 13 degrees 30 minutes 11
seconds East 391.4 feet to a point, the place of beginning, containing approximately 8.11
acres.
HAVING THEREON ERECTED a two-story flame dwelling house and other
out-buildings.
