Defendant : CIVIL ACTION - LAW COMPLAINT AND NOW, comes Plaintiff, R. F. Fager Company, by its attorneys, Kundrat & Associates, and states the following cause of action: 1. Plaintiff, R. F. Fager Company, is a Pennsylvania corporation authorized to do business in Pennsylvania with offices and/or a place of business situate at 2058 State Road, Camp Hill, Cumberland County, PA 17011 2. Defendant Hoffman Mechanical, Inc., is a Pennsylvania corporation with offices and/or a place of business situate at 3 Keystone Drive, Mechanicsburg, Cumberland County, Pennsylvania 17011. 3. Plaintiff is, and at all relevant times was, a wholesale distributor of building supplies. 4. Defendant is, and at all relevant times was, a contractor. 5. Between January 7, 2003 and February 28, 2003, various products, goods, supplies, and materials (hereinafter collectively referred to as "products") were ordered by Defendant from Plaintiff. Plaintiff sold and provided the products ordered by Defendant, the same being represented by the invoices which are too numerous to be attached hereto however, upon request, shall be supplied to Defendant prior to trial. 6. The prices charged for the products sold to Defendant were the fair, reasonable, and market prices of the products, and the prices that Defendant agreed to pay. 7. The invoices represent products sold by Plaintiff and purchased by Defendant pursuant to Defendant's account with Plaintiff. 8. Defendant has not objected to any of these invoices and has accepted the products provided thereby, but has failed to pay Plaintiff despite demand pursuant to its open account, all to the damage of Plaintiff. 9. Plaintiff has maintained a statement of account keeping an accurate and running amount of debits and credits for the sale of products sold to Defendant by Plaintiff. 10. Plaintiff has submitted to Defendant a monthly statement of account accurately showing all debits and credits for transactions with Defendant, the most recent statement of account dated November 30, 2003 shows an amount owing to Plaintiff of $34,694.49. A copy of the statement of account is attached hereto and made a part hereof and collectively referred to as Exhibit "A". Defendant has made payments in the amount of $2,457.45 leaving a balance due of $32,237.04. 11. Pursuant to the terms and conditions of sale contained on the credit application which terms and conditions were agreed to by Plaintiff and Defendant, and as further stated on the invoices, Plaintiff is entitled to receive a finance charge of 1.5% per month on past due amounts. 12. Any and all conditions precedent to the bringing of this action has been performed by Plaintiff. 13. The amount in controversy is not within the jurisdictional amount requiring compulsory arbitration. WHEREFORE, Plaintiff R. F. Fager Company respectfully requests that judgment be entered in its behalf and against Defendants in the amount of $32,237.04 plus interest at the rate of 1.5 per month from November 30, 2003, plus the costs of this action, and such relief as the court deems just and proper. PRELIMINARY OBJECTIONS TO COMPLAINT AND NOW comes the Defendant, Hoffman Mechanical, Inc., by and through its attorneys, Reidenbach, Henderson & Pecht, who file Preliminary Objections to Plaintiff's Complaint as follows: 1. Paragraph 11 of Plaintiff's Complaint sets forth that the "terms and conditions of sale contained on the credit application which terms and conditions were agreed to by Plaintiff and Defendant ... . 2. Plaintiff is in part basing its right to pursue the litigation on the existence of the credit application which terms and conditions were allegedly agreed to by Defendant. 3. Pennsylvania Rule of Civil Procedure 1019(i) sets forth that when any claim or defense is based upon a writing the pleader shall attach a copy of the writing. 4. Although monthly statements are attached to Plaintiff's Complaint, the actual basis for the Complaint., the credit application specifying the terms and conditions agreed to by Plaintiff and Defendant, is not, nor is alleged to be an oral agreement. 5. Inasmuch as Plaintiff's Complaint fails to attach the credit application, Plaintiff's Complaint is in violation of Pennsylvania Rule 1 of Civil Procedure 1019(1). 6. Pennsylvania Rule of Civil Procedure 1028(a)(2) allows for a Complaint to be stricken for failure of the pleading to conform to a rule or law of court. 7. As a result of Plaintiff failing to comply with Pennsylvania Rule of Civil Procedure 1019(i) in failing to attach a copy of the credit application upon which Plaintiff relies in justifying its cause of action in general and specifically its entitlement of a finance charge of 1.50 per month, Plaintiff's Complaint violates the Pennsylvania Rules of Civil Procedure and should be stricken. WHEREFORE, Defendant, Hoffman Mechanical, Inc., prays that this Honorable Court grants its Preliminary Objections and dismiss Plaintiff's Complaint with prejudice or, in the alternative, direct Plaintiff to file a Complaint in compliance with the Rules of Civil Procedure. The prices charged for the products sold to Defendant were the fair, reasonable, and market prices of the products, and the prices that Defendant agreed to pay. 7. The invoices represent products sold by Plaintiff and purchased by Defendant pursuant to Defendant's account with Plaintiff. 8. Defendant has not objected to any of these invoices and has accepted the products provided thereby, but has failed to pay Plaintiff despite demand pursuant to its open account, all to the damage of Plaintiff. 9. Plaintiff has maintained a statement of account keeping an accurate and running amount of debits and credits for the sale of products sold to Defendant by Plaintiff. 10. Plaintiff has submitted to Defendant a monthly statement of account accurately showing all debits and credits for transactions with Defendant, the most recent statement of account dated November 30, 2003 shows an amount owing to Plaintiff of $34,694.49. A copy of the statement of account is attached hereto and made a part hereof and collectively referred to as Exhibit "B". Defendant has made payments in the amount of $2,457.45 leaving a balance due of $32,237.04. 11. Pursuant to the terms and conditions of sale contained on the invoices and statements which terms and conditions were orally agreed to by Plaintiff and Defendant. Plaintiff is entitled to receive a finance charge: of 1.5% per month on past due amounts. 12. Any and all conditions precedent to the bringing of this action has been performed by Plaintiff. 13.
