COMPLAINT
1. Plaintiff is Barbara 1. Salisbury, who currently resides at 3 Woodland
Drive, Newville, Cumberland County, Pennsylvania,
2, Defendant is James A. Salisbury, who currently resides at 3 Woodland
Drive, NeWVille, Cumberland County, Pennsylvania,
3. The Plaintiff and Defendant have been bona fide residents in the
Commonwealth for at least six (6) months immediately previous to the filing of this
Complaint.
4. The Plaintiff and Defendant were married on December 17, 1972,
COUNT I - DIVORCE
5, Paragraphs I through 4 of this Complaint are incorporated herein by
reference as though set forth in full.
6, There have been no prior actions of divorce or for annulment between the
parties.
7, Divorce is sought pursuant to the provisions of the Divorce Code, * *
3301 (a)(2), 3301 (a)(6), 330l(c), and 330l(d), in that:
a, The Defendant committed adultery.
b, The Defendant offered such indignities to the Plaintiff as to render
Plaintiff's condition intolerable and life burdensome,
c, The marriage is irretrievably broke,
26, 2004, and continue to do so, l
d. Plaintiff and Defendant have lived separate and apart since January
8. Plaintiff has been advised that counseling is aVailable and that Plaintiff may
have the right to request that the court require the parties to PartiCipate in such
counseling,
9, Plaintiff requests that the court require the parties to Participate in counseling,
pursuant to **330l(c) and 330l(d) of the Divorce Code.
10, The Plaintiff in this action is not a member of the Anned forces,
WHEREFORE, the Plaintiff requests the Court to enter a decree of Divorce.
11, Paragraphs 1 through 9 of this Complaint are incorporated herein by reference
COUNT II - EOUlTABLE DISTRIBUTION
as though set forth in full.
12, Plaintiff and Defendant have acquired property, both real and personal,
during their marriage, which property is "marital property",
I The Parties have lived separate and apart since January 26, 2004, For months prior to the filing of this
Complaint, the parties have lived separate social lives and their living arrangements have been more akin to
that of roommates than marital-mates, The Superior Court has established that separate and apart means
the existence of separate lives, not separate roofs, Mackev v, Mackel, 545 A.2d. 362 (Pa, Super, 1988),
13, Plaintiff and Defendant may have owned, prior to marriage, property
which has increased in value during the marriage andlor which has been exchanged for
other property, which has increased in value during the marriage, all of which property is
"marital property",
14, Plaintiff and Defendant have been unable to agree as to an equitable
division of said property prior to the filing of this Complaint.
WHEREFORE, the Plaintiff requests this Honorable Court to equitably divide
all marital property,
COUNT III - ALIMONY PENDENTE LITE AND ALIMONY
15, Paragraphs 1 through 13 of this Complaint are incorporated herein by
reference as though set forth in full.
16, Plaintiff lacks sufficient income to provide for her reasonable means,
17, Plaintiff requires reasonable support to maintain herself adequately in
accordance with the standard of living established during the marriage,
WHEREFORE, Plaintiff requests this Honorable Court to enter an award of
alimony pendent lite until final hearing and thereafter to enter an award for alimony,
COUNT IV - COUNSEL FEES AND COSTS
18, Paragraphs 1 through 16 of this Complaint are incorporated herein by
reference as though set forth in full.
19, Plaintiff has retained Stephanie E, Chertok and John C, Porter, Attorneys
at Law, but is unable to pay the necessary and reasonable attorney's fees for said counset
20. Plaintiff may need to hire experts to appraise the marital property but she
lacks the funds to pay the necessary and reasonable fees,
WHEREFORE, Plaintiff requests this Honorable CoUrt to enter an award of
interim counsel fees, costs and expenses and to order such additional Silins hereafter as
may be deemed necessary and appropriate, and at final hearing to award such additional
counsel fees, costs and expenses as are deemed necessary and appropriate.

PETITION FOR EMERGENCY RELIEF
I, Plaintiff is Barbara J, Salisbury, who currently resides at 3 Woodland Drive,
Newville, Cumberland County, Pennsylvania,
2, Defendant is James A. Salisbury, who currently resides at 3 Woodland Drive,
Newville, Cumberland County, Pennsylvania.
3. This Divorce Action was commenced on February 4, 2004,
4, In her Divorce Complaint Plaintiff included a Count requesting the equitable
division of marital property,
5, Since the filing of the Complaint the parties have lived under the same roof,
with the Plaintiff attempting to conduct an II th hour reconciliation.
6. Defendant has refused to reconcile and has continued and intensified his
course of indignities directed towards the Plaintiff.
7, On the weekend of April lOth and II th the Plaintiff began removing items of
marital property from the marital home without Plaintiffs permission.
8, Included in these items were objects with both sentimental and monetary
value to the Plaintiff, items the Plaintiff had acquired before the marriage,
10. Plaintiff cannot continue to live under the same roof as the Defendant, but has
no where else to go to live,
I I. Plaintiff feels emotionally and physically uneasy in her current situation,
12. Within the past week Plaintiff has feared for her safety, believing that the
Defendant desired to cause her physical harm,
13, Concurrence in this Petition was sought from Defendant's Counsel of record,
M. Teri Hall Stiltner, Esquire, however Attorney Stiltner was unavailable for
purposes of comment.
WHEREFORE, the Plaintiff requests the Court to schedule an emergency hearing to
determine:
I, Whether Plaintiff should be awarded, temporarily or permanently, sole
possession of the marital home and Defendant the hunting cabin located at Ridge Runner
Road, WardensviIIe, West Virginia, in which the Salisbury's have a part ownership
interest;
2, To determine a temporary award of alimony pendente lite; and
3. To determine whether Plaintiff should be awarded interim counsel fees, costs,
and expenses.

February 4,2004,

equitable distribution of marital property,

Complaint, the parties have lived under the same roof. It is denied that Plaintiff has attempted a
reconciliation,

reconciled with Plaintiff due to Plaintiffs course of indigniti~:s toward Defendant. It is denied
that Defendant has engaged in a course of indignities directed toward Plaintiff.

from the household, By way of further response, Plaintiff removed several of Defendant's

and counsel, the appointment of the Master is vacated and
counsel can conclude the proceedings by the filing of a
praecipe to transmit the record with the affidavits of consent
of the parties so that a final decree in divorce can be
entered.

THE MASTER:
Today is Friday, May 12, 2006.
This is the date set for a conference in the above-captioned
divorce proceedings. Present in the hearing room are the
Plaintiff, Barbara J. Salisbury, and her counsel Andrew H.
Shaw, and the Defendant, James A. Salisbury, and his counsel
M. Teri Hall Stiltner.
Today's date was scheduled for a conference;
however, the Master has been advised that after continuing
negotiations, the parties have reached a comprehensive
agreement with respect to grounds for divorce and the
economic issues raised.
The complaint in divorce was filed on
February 4, 2004, raising a number of grounds for divorce
and the economic claims of equitable distribution, alimony,
alimony pendente lite, and counsel fees and costs.
With respect to grounds for divorce, the
parties have provided the Master affidavits of consent and
waivers of notice of intention to request entry of divorce
decree. The affidavits and waivers will be filed by the
Master's office. They are dated May 12, 2006. The divorce
can conclude under Section 3301(c) of the Domestic Relations

Code.
Counsel are going to place on the record the
agreement regarding the settlement dealing with the economic
claims of equitable distribution, alimony, and counsel fees
and costs. The agreement as stated on the record will be
considered the substantive agreement of the parties, not
subject to any changes or modifications except for
correction of typographical errors which may be made during
the transcription. The parties and counsel are going to
return later this morning to review the draft of the
agreement and make any correction of typographical errors
which may have been made during the transcription. After
counsel and the parties have reviewed the agreement and any
typographical corrections have been made, the parties will
sign the agreement affirming their terms of settlement as
stated on the record. Upon receipt by the Master of two
copies of the agreement, the Master will prepare an order
vacating his appointment. It is specifically understood,
however, that when the parties leave the hearing room today,
they are bound by the terms of the agreement even though
there is no subsequent signing of the agreement affirming
the terms of the settlement as stated on the record. Ms.
Stiltner.
MS. STILTNER:
1. With regard to property to be received by Mrs.
Salisbury, she shall receive $25,000.00 in cash from the

proceeds of the sale of the marital residence. She will
receive the West Virginia hunting camp and her Garthmore
IRA, her Nationwide plan IRA account, and the National Plan
IRA account. She will receive her Mountz retirement
account, the 1995 GMC Jimmy, any and all personal property
currently in her possession, including her jewelry. Mrs.
Salisbury will also receive by way of a QDRO $85,000.00 from
Mr. Salisbury's Teamster's retirement plan. She will
receive the cemetery plots, the Virginia timeshare, and the
Florida timeshare.
2. Mr. Salisbury shall receive $8,772.00 or the balance of
the proceeds from the sale of the marital residence by way
of a cash disbursement, the mountain land in Cumberland
County, the Clinton County cabin. He will receive all of
his Members's 1st accounts, any accounts at Arkansas Best
Federal Credit Union. He will receive the First Trust IRA
account and the balance of his Teamster's retirement plan.
He will also receive his Teamster's defined benefit plan and
his ABF 40l(k) plan. Mr. Salisbury will receive the 1994
K1500 truck, the GMC conversion van, and any and all
personal property currently in his possession. He will also
receive his Garthmore IRA account.
3. This agreement takes into consideration credits given
to Mr. Salisbury for post-separation expenses, payment of an
overdraft of a joint account, and post-separation payments
for the Florida and Virginia timeshares and the cabin ("
payments. ~~ 9'U~
4. The parties own an investment property in Winding U:I/ 4~
Investment Properties. That shall remain in the joint names ~'
of the parties and any future proceeds shall be divided on a
SO/50 basis until such time as that investment has been
depleted.
5. The disbursement of the $85,000.00 transfer of
husband's Teamster's retirement plan to wife will be
transferred to an account of her choosing. It is intended
that she will rollover the funds into a 40l(k) account
which wife will establish and there will be no tax
consequences to either party with regard to this transfer.
In order to effectuate the terms of this agreement, wife's
counsel shall prepare a deed for the West Virginia hunting
camp, a QDRO for wife's rollover of husband Teamster's
retirement plan, any documents relating to the transfer of
cemetery plots, and any and all documents necessary to
transfer the Virginia timeshare and the Florida timeshare.
Deeds shall be presented to husband's counsel for any
property within Pennsylvania within ten (10) days of this

date and any deeds for property outside the state of
Pennsylvania shall be presented to husband's counsel within
thirty (30) days of this date.
Husband's counsel shall be responsible for
preparing a deed for transferring the mountain land and any
and all documents necessary to effectuate wife's waiver of
husband's Teamster's defined benefit plan and his ABF
40l(k). Deeds shall be delivered to wife's counsel with
regard to the mountain land and the Clinton County cabin
property within ten (10) days of this agreement and the
Teamster's defined benefit plan and the ABF 40l(k) plan
shall be delivered within sixty (60) days.
Wife's attorney shall present to husband's
attorney a QDRO to effectuate the transfer of the Teamster's
retirement rollover within sixty (60) days of this
agreement.
6. This settlement agreement is based on assets and values
that will be submitted in Joint Exhibit No. 1 which
memorializes the settlement between the parties.
7. Wife and husband hereby waive all right, claim, title
or interest they may have in alimony pendente lite, alimony,
and counsel fees and costs and expenses as part of this
agreement.
8. With regard to the distribution of the net proceeds of
the sale of the marital residence, checks shall be delivered
to husband's counsel within ten (10) days of the date of
this agreement. Those proceeds are currently in the control
of Mr. Shaw and are being held in an escrow account and he
will have the authority, by this agreement, to make
disbursements as indicated in the agreement.
9. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the other as a result of the marital
relationship including without limitation, statutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, and right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims.

I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by signing below I
ratify and affirm the agreement previously made and intend
to bind myself to the settlement as a contract obligating
myself to the terms of settlement and subjecting myself to
the methods and procedures of enforcement which may be
imposed by law and in particular Section 3105 of the
Domestic Relations Code.

QUALIFIED DOMESTIC RELATIONS ORDER
Upon consideration of the pleadings in the above-captioned matter, it is on this
'J~ day of ~ ,2006, ORDERED that:
1. State Domestic Relations Law. This Order is made pursuant to the
domestic relations laws of the Commonwealth of Pennsylvania and relates to the division
of pension plan benefits between former spouses in an action for dissolution of marriage.
This Order is intended to qualify as a "Qualified Domestic Relation Order" ("QDRO")
under Section 414(p) of the Internal Revenue Code of 1986, as amended (the "Code") and
Section 206(d)(3) of the Employee Retirements Income Security Act of 1974, as amended
("ERISA").
2.
Pennsylvania
Identitv of the Plan. The plan to which this Order applies is the Central
Teamsters Retirement Income Plan 1987 (the "Plan"), a defined
contribution pension plan. The Plan Administrator is the Board of Trustees of the
Teamsters - Joseph Samolewicz .
3. Identitv of the Particinant. The participant in the Plan to which this
Order applies is James A, Salisbury (the "Participant"), Social Security Number 198-30-
0303, whose last known mailing address is
4. Identitv of the Alternate Payee. This Order creates the right for an
Alternate Payee, Barbara J. Salisbury, Social Security Number 197-40-6839, whose last
known mailing address is 404 Franklin Street, Carlisle, PA 17013, to receive a portion of
the pension benefits payable with respect to the Participant under the Plan. The Alternate
Payee is the former spouse of the Participant.
5. Amount of Payments to Alternate Payee. This Order assigns to the
Alternate Payee a separate interest in the Participant's pension benefit. The Alternate
Payee's separate interest shall be Eighty Five Thousand and 00/100 ($85,000.00) Dollars.
6, Allocation of Basis. The amounts assigned to the Alternate Payee under
Paragraph 5 above shall be deemed to be attributable to elective deferral contributions,
after-tax contributions, nonelective contributions, rollover contributions, and earnings on
all such contributions on a pro rata basis in the same proportions as the Participant's
interest in the Plan determined as ofthe valuation date referred to in Paragraph 5.
7. Investment of Assets. As soon as practicable after this Order IS
determined to be qualified by the Plan Administrator, the amounts assigned to the
Alternate Payee under Paragraph 5 above shall be withdrawn from the investment funds
in the Participant's account on a pro rata basis and invested in a separate account under
the Plan maintained for the benefit of the Alternate Payee. On and after the date such
account is established, the Alternate Payee shall have the same ability to designate the
investment of those amounts as the Participant would otherwise have had with respect to
those amounts. All amounts assigned to the Alternate Payee will separately share in the
gains and losses and forfeitures of the Plan in accordance with the terms of the Plan
beginning on the date the Alternate Payee's account is established until the date of
payment of such assigned amounts to the Alternate Payee.
8. When Payments Will Be Made to Alternate Payee. A distribution to
the Alternate Payee of the amount determined in this Order shall commence to be paid by
the Plan upon the Alternate Payee's application on or after the date this Order is
determined to be qualified by the Plan Administrator, but not later than the latest date
permitted by Code Section 401(a)(9). The Alternate Payee's benefit shall be distributed
in a single lump sum distribution.
9. What Hannens if the Particinant Predeceases the Alternate Payee.
The assignment of an interest in Participant's accrued benefit to the Alternate Payee, as
provided herein, shall not be reduced, abated or terminated as a result of the death of the
.
Participant. With respect to the portion of the Participant's accrued benefit under the
Plan not otherwise assigned to the Alternate Payee in Paragraph 5 of this Order, the
Alternate Payee shall be treated as the Participant's surviving spouse for the purposes of
any benefits attributable to such portion that are payable upon the Participant's death, in
accordance with the Code and ERISA.
10. What Happens if the Alternate Payee Predeceases the Participant. If
the Alternate Payee predeceases the Participant before distribution of the Alternate
Payee's share to the Alternate Payee, to the extent permitted by the Plan and Code
Section 414(p), the Alternate Payee may designate a beneficiary to receive payment ofthe
Alternate Payee's interest in the Plan.
II. ERISA and Code Reauirements. Nothing contained in this Order shall
be construed to require the Plan to provide: (a) any type or form of benefit, or any option,
not otherwise provided under the terms of the Plan; (b) increased benefits (determined on
the basis of actuarial value) not otherwise provided for under the terms of the Plan; or (c)
payments of benefits to the Alternate Payee which are required to be paid to another
alternate payee under another order previously determined by the Plan to be a Qualified
Domestic Relations Order pursuant to Section 206(d)(3) of ERISA and Section 414(p) of
the Code.
12. Cooperation Reauired. The Participant and Alternate Payee shall
cooperate in executing the assignment of the interest in Participant's pension by keeping
the Plan apprised of their current mailing addresses, and by providing such information
that the Plan shall deem necessary for the proper administration of the Plan in accordance
with this Order.
13. Mailinl! Reauired. Copies of this Order shall be sent to the Plan via first
class mail from counsel for the Alternate Payee, as the authorized representative of the
Alternate Payee.
14. Continuinl! Jurisdiction of the Court. The Court shall retain jurisdiction
so that this Order may be amended as necessary in order to comply with the requirements
of a Qualified Domestic Relations Order pursuant to Section 206(d)(3) of ERISA and
Section 4l4(P) of the Code, as determined by the Plan.

In order to effectuate the terms of this agreement, wife's
counsel shall prepare a deed for the West Virginia hunting
camp, a QDRO for wife's rollover of husband Teamster's
retirement plan, any documents relating to the transfer of
cemetery plots, and any and all documents necessary to
transfer the Virginia timeshare and the Florida timeshare.
Deeds shall be presented to husband's counsel for any
property within Pennsylvania within ten (10) days of this

date and any deeds for property outside the state of
Pennsylvania shall be presented to husband's counsel within
thirty (30) days of this date.
Husband's counsel shall be responsible for
preparing a deed for transferring the mountain land and any
and all documents necessary to effectuate wife's waiver of
husband's Teamster's defined benefit plan and his ABF
401(k). Deeds shall be delivered to wife's counsel with
regard to the mountain land and the Clinton County cabin
property within ten (10) days of this agreement and the
Teamster's defined benefit plan and the ABF 401(k) plan
shall be delivered within sixty (60) days.
Wife's attorney shall present to husband's
attorney a QDRO to effectuate the transfer of the Teamster's
retirement rollover within sixty (60) days of this
agreement.
6. This settlement agreement is based on assets and values
that will be submitted in Joint Exhibit No. 1 which
memorializes the settlement between the parties.
7. Wife and husband hereby waive all right, claim, title
or interest they may have in alimony pendente lite, alimony,
and counsel fees and costs and expenses as part of this
agreement.
8. With regard to the distribution of the net proceeds of
the sale of the marital residence, checks shall be delivered
to husband's counsel within ten (10) days of the date of
this agreement, Those proceeds are currently in the control
of Mr. Shaw and are being held in an escrow account and he
will have the authority, by this agreement, to make
disbursements as indicated in the agreement.
9. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the other as a result of the marital
relationship including without limitation, statutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, and right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims.

this divorce proceeding?

THE MASTER: And you understand that when you
leave the hearing room today, even though there is no final
signing of the agreement, you are bound nevertheless by the
terms?
MS. SALISBURY: Yes.
THE MASTER: Mr. Salisbury, you've been
present during the statement of the agreement on the record?
MR. SALISBURY: Yes.
THE MASTER: Do you understand the agreement
as stated?
MR. SALISBURY: Yes.
THE MASTER: Do you have any questions about
it?
MR. SALISBURY: No.

agreement as a final settlement of all claims in the divorce
action?
MR. SALISBURY: Yes.
THE MASTER: And you understand that when you
leave the hearing room today you are bound by the agreement
even though there may subsequently be no signing affirming

MR. SALISBURY: Yes.
I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by signing below I
ratify and affirm the agreement previously made and intend
to bind myself to the settlement as a contract obligating
myself to the terms of settlement and subjecting myself to
the methods and procedures of enforcement which may be
imposed by law and in particular Section 3105 of the
Domestic Relations Code.
