HomeMy WebLinkAbout04-0535IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY PENNSYLVANIA INRE: Christopher Michael Morris, a minor PETITION FOR EMANCIPATION OF A MINOR Filed by Christopher Michael Morris PETITION FOR EMANCIPATION OF A MINOR AND NOW, comes the Minor Petitioner, with the following Petition for Emancipation ora Minor. 1. Christopher Michael Morris, is a minor and is petitioning this court to become an emancipated minor. 2. Christopher Michael Morris, requests an expedited hearing to address the urgent matter of my transfer to another school system without parental consent so that I may remm to school in the dis~ct in which I reside. Fac~: a. I state that my name is Christopher Michael Morris and that I seek emancipation for the purpose of living on my own in a healthier environment than the one provided for me by my current guardian and to actively direct my education to my own benefit. I was bom on October 15, 1987, in Patuxem River, in St. Mary's County, Maryland. The name and last known address of my mother was: Deborah Ann Schreffier, 3085 Spring Rd., Carlisle, PA 17013. The name and last known address of my father was: Walter Eugene Morris, Street Address Unknown, Baltimore City, Maryland 21230. I currently reside at 149 A Street, Apartment 3, Carlisle, PA 17013 and have resided at this residence since February 1, 2004. Respectfully Submitted, Affidavit To: Whom It May Concern Re: Letter of Support for the Petition for Emancipation of Christopher Morris To Whom It May Concern: The purpose of this letter is to support the emancipation of a minor, Christopher Morris. I, Brad Haywood, of 149 A Street, #3, Carlisle, PA, feel that I have a firm understanding of the situation at hand. Christopher Morris seeks emancipation from his legal guardian (his mother) because she is unfit as a mother. There is a history of documented abuse and anger issues in Christopher's family. As a child, Chris was molested at gunpoint for two-and-a-half years by his now incarcerated former stepfather. The facts of this case are rather disturbing. It is regrettable, also, that no investigation was undertaken into the competency of Chris's mother as a parent because she was present in the residence during most of the occurrences and oblivious to her children's well being for such a long period. During another incident last year, Chris's mother and stepfather forcibly restrained him and attempted to cut of his hair moments before his school bus was to arrive because his hair looked too "Black." Chris's and my understanding of this statement lead us to believe they were racially motivated towards Chris, who is bi-racial, by his Caucasian mother. Chris also reported cuts on his hands from the scissors. Chris's mother is also incapable of conversing with Chris. Chris describes her as neglectful and always being too angry or selfishly motivated to pay attention to the details of Chris's life. Every family member of Chris's attended therapy for a negligible period of one year following the molestation incident. The issue is rarely discussed after that, if ever. Such a traumatic event has left Chris with very little faith in his mother to look out for him or to make appropriate decisions for his future and well-being. Chris has also barely maintained a relationship with his biological father. Chris tells me the last time they spoke, almost two years ago, that it ended in argument. Chris's mother's parenting has proven lack luster with her other children. Chris cites their bouts with substance abuse and their anger problems. Chris has previously attempted through other means to free himself from his mother's hold. He has for several years continuously spoken about his familial issues with coaches, teachers, administrators, and counselors. Help in emancipating himself has not been forthcoming. Sexual abuse and the resulting emotional trauma must be addressed persistently or the friction that has resulted will occur. For no other reasons other than Cbxis's mother's inability to address these issues plus the unacceptable and negligent role she played in the most traumatic events of Chris's life leaves me to believe he would be much better offaway from the source of his continuing trauma and frustration. Chris, as an individual, continues to impress me. At Carlisle High School he tells me he obtained straight A's. He is also a student athlete with strong relationships with teachers, administrators and peers. He worked very hard for those grades, and used to spend long hours at the library studying. The long hours recently ceased and his grades have since dropped slightly. His mother recently remarried for an extraordinary third time and moved to a house in the Cumberland Valley School System. Chris describes his new living situation as unacceptable and dangerous and he is unwilling to return there at any point. His bedroom consists of an unfinished basement with leaking pipes over head. He says their family dog regularly urinates and defecates in this basement. The windows are also exceptionally small and provide little light. The clothes drier vents plainly into the stagnant basement air, lint and all, rendering the air quality rather poor. There is no insulation rendering the space cold and damp with bare floors. Chris is also grounded from the library he so desires to spend time at because his parents think he spends too much time there. Chris tells me that he has no place to study and wishes to return to his success at Carlisle High School where he has obtained most of his academic success and to continue living on his own where he can study in a much safer and healthier environment. Chris also ma'mtains a part time job. Since he has begun living on his own at the end of January, he has managed to grocery shop for himself, and find an affordable apartment and a roommate. He has attempted to re-enroll at Carlisle High School but has been denied by his parents that opportunity and can only return pending the filing of his petition. He certainly is capable and desirous of living on his own. I offer my full support to Christopher and welcome the opportunity to speak further in person on this issue. I currently have a job at the Subway Sandwich Shop located at 35 West High Street, Carlisle, PA. I have held my position there for six months. My supervisor's name is Brad Shamhaugh and can be reached during most days at Subway by calling (717) 249-3199. I currently receive six dollars per hour and have not worked less than ten hours in any previous week. When I lived closer to work, before my parents forced me to move, I worked between fifteen and eighteen hours per week. My Emancipation will allow me to make more money when I am not at school. This equivocates to about three hundred and forty dollars a month after taxes and I have the potential to work more this coming summer. I'm hoping to increase my hours to 26 hours a week, with twenty of those hours being on the weekend to still keep open plenty of time during the week to keep on top of school work and pursue academics with the same vigor that I had when I was originally back at Carlisle High school. Submitted with this declaration are copies of my roommates' bills (the most recent electric bill which shows a consistent charge, and several local phone bills to determine a range). I intend on paying for one third of our rent, electric and local phone bills. Water, heat and gas are all included in my rent bill. 1 will formally be added to the lease upon submission of this petition. I presume that my bills for supporting an apartment will be $180. That includes approximately $160 for rent, $10 for phone service, and $10 for electricity. I have investigated healthcare for myself and have been referred to the Sadler Clinic. I have little more than a year before I start College and from what I have learned through asking, they will cover my basic needs at affordable rates until I start school. My grocery bills are less than $100 per month. A grocery receipt for food for more than a week is copied and attached. Thus far, my limited salary at present more than covers my basic needs. Once my hours resume to normal, I will be able to save close to $200 a month for college. Declaration Explaining My Abilities to Manage My Social and Personal Affairs 1, Christopher Michael Morris, state the following facts in support of my social and personal independence. My education is my number one priority right now. I have already invested $900 in an SAT prep course that includes constructive criticism for college essays. I need emancipation granted, if fur any reason, to return to normal study habits and a normal routine at the library currently being denied to me. I work very hard to be a good student and hope that I might return to Carlisle High School where I have a strong social network, administrators and teachers 1 confide in and can rely on. One administrator offered to let me live with him if my Mom would grant him custody. She refused even though it was in my best interests. Returning to the familiar environment of Carlisle High School would also give me a chance to return to stable surroundings. I even recommend, if emancipation is granted having the court follow up on my case by checking my grades is the future. I am confident that my grades will return to the high standards I have set for myself and encourage the court to follow up on my progress. As for my social and personal affairs outside of School, I have a good friend base in Carlisle. My new apartment is more central to School, Work, the library and my friends who may just well be my greatest resource. I never felt alone at Carlisle High School and appreciated my old school as a source of my happiness and well-being. Whereas, living on Spring Road and attending Cumberland Valley High School, I felt alone and isolated. I think that my resolve to file this petition and to take the initiative to research these legal documents at the Dickinson Law School Library proves beyond a doubt that I am not just some fickle teenager but rather an individual who can and wants to take responsibility for my future and can plan and accomplish my chosen goals with the intelligence and integrity I have continually shown.
