COMPLAINT
AND NOW comes the Plaintiffs, Roger L. Gettel and Jay E. Gettel, by and through
their attorney, Anthony L. DeLuca, Esquire, and files this Complaint as follows:
I. Plaintiffs are Roger 1. Gettel, an adult individual, residing at 178 Walnut
Bottom Road, Shippensburg, Cumberland County, Pennsylvania 17257, and Jay E. Gettel, an
adult individual, residing at 180 Walnut Bottom Road, Shippensburg, Cumberland County,
Pennsylvania 17257.
2. Defendants are Donald L. McDermott and Margarita McDermott, adult
individuals, residing at 718 Walnut Bottom Road, Shippensburg, Cumberland County,
Pennsylvania 17257.
3. On or about August 12,2002, Plaintiffs and Ddendants entered into a written
Lease Agreement. A copy of said Lease Agreement is attached hereto, incorporated herein
by reference, and marked as Exhibit A.
4. In addition, the parties executed a Mobile Home Park Rules and Regulations
Agreement (hereinafter "Rules") on August 12, 2002. A copy of said Mobile Home Park
Rules and Regulations Agreement is attached hereto, incorpofalted herein by reference, and
marked as Exhibit B.
5. The leased premises are located at Lot 9 ofthe Jay E. Gettel Subdivision and
known as 718 Walnut Bottom Road, Shippensburg, Cumberland County, Pennsylvania
17257.
6. Under the terms ofthe Lease Agreement, Defendants were required to pay
Plaintiffs the sum of Two Hundred Twenty-five Dollars ($225.00) per month, beginning
September I, 2002.
7. Defendants commenced occupying the premises on or about August 12,2002.
8. The monthly rent of$225.00 was increased, effective February, 2004, to
$240.00 per month to take into account trash removal.
9. To date, Defendants have failed to pay Plaintiffs for the following rent
payments:
February I, 2004 $240.00
March 1,2004 $240.00
April I, 2004 $240.00
May 1, 2004 $240.00
June I. 2004 $240.00
Total Owed: $1,200.00
10. Under Paragraph I of the Lease, the premises are to be kept and maintained
by Defendants in as good a repair as at the signing of the Lease Agreement.
II. Defendants have not complied with paragraph 1 ofthe Lease Agreement as
follows:
A. Defendants have continuously driven their motor v,ehicles in the yard, causing
$2,000.00 in damages; and
B. Defendants store trash, scrap metal and junked vehicle on the premises.
12. The cost for removal ofthe trash, scrap metal and junked vehicle is $500.00.
13. Paragraph 2 of the Rules states that all homes must be skirted within sixty (60)
days of arrival.
14. To date, Defendants have not skirted their home.
15. Paragraph 7 of the Rules states that homeo~ners are responsible for keeping
water and sewer connections from freezing from the ground level.
16. Defendants failed to take proper steps to keep their water connection from
freezing.
17. On or about December 10, 2003, Plaintiffs served a letter on Defendants
instructing Defendants to vacate the premises.
18. Defendants have refused to vacate the premises.
19. Plaintiffs desire to repossess the premises.

increased or the insurance invalidated. Also: Lessee 8ha1l be responsible for
securing and maintaining Lessee's own insurance policy on the contents of the
mobile home unit as well as Lessee's on liability insurance policy, .
6, All real estate taxes on the subject real estate shall be responsibility of Lesser,
however, any real estate taxes attributable to the mobile home unit thereon shall
be the responsibility of Lessee,

7. No business contrary to any governmental law, regulations or ordinance shall at
any time be conducted on the premises. Lessee agrees that zoning or other
governmental requirements.
8, It is further agreed that the tenns and conditions of this lease agreement shall in
no way be changed or altered except by a writing signed by all the parties hereto.
If this lease agreement is executed by Lessor's agent Lessee waives any
requirement that such agent's authorily be in writing.
9. It is hereby understood by the parties that either Lesser or Lessee may terminate
this lease agreement upon the giving of thirty (30) days advance written notice to
the other party of it's intention to tenninate. Whe1l1er this written notice comes
from Lesser or Lessee, Lessee hereby agrees to fully vacate the lease premises,
Lot No. t::t , not later then the expiration of the aforesaid thirty (30) day
period.
10, In addition to the tenns and conditions of this leas,e agreement, Lessee hereby
agrees to fully comply with the rules and regulations of the Jay E. Gettel
subdivision, a copy of which Lessee hereby acknowledges receipt of
simultaneoUSly with the execution of this lease agreement.
I 1. If the Lessee shall continue in possession of the premises after the expiration of
the term of this lease, at the option of the Lesser, such holding over may be held
and deemed a reneWal of this agreement for another like tenn, the same as though

MOBLE HOME PARK RULES AND REGULATION
I, Mobil Home and Lot must be maintained in first class condition,
2, All Homes must be skirted within 60 (sixty) days of arrival.
3, All hitches must be removed or covered.
4. Homeowners are responsible for all blocking.
5. Any storage sheds or accessory building must be lesser-approved prior to
construction, And or placement
6. Lawns must install and maintained at all times by Lessee.
7. Homeowners are responsible for keeping his own water and sewer connections
from freezing from the ground level.
8, Clothesline must be of lesser approved.
9. Planting of flowers, shrubs and tress are encouraged, but must meet the
I1lllIUIgement's approval.
10, Management reserves the right to enter any lot at lmy time (not the home),
11. A check valve needs to be included in your water hook up. This. prevents the
water from draining from your hot water hot water heater, and burning out the
element if water is turned off for repairs.
12, Management is not responsible for any damage that occurs to homes.
13. Lot rent is to be paid on or before the first of every month---F AlLURE TO DO
SO WILL CAUSE YOU TO BE EVICTED FROM PARK.
14. Park will provide sanitary sewer and water unless water bill goes over the
minimum charges from Southem Cumberland Water Association then any
charges over the minimum will be paid by the lesser within 15 days of the billing,

type unless approved by lesser.
16. Parking in grass is prohibited at all times,
17, A fee of twenty dollars ($20.00) will be charged on any returned checks.

19. Management MUST approve any type of fencing.
20, No abrasive cleaners example: comet or go-joe cleaners. ..also no rubbery item
such as condoms allowed down in sewer system.

IN RE: PRETRIAL CONFERENCE
A pretrial conference was held Wednesday, June 1,
2005, before the Honorable Edward E, Guido, Judge. Appearing
for the Plaintiffs was Anthony DeLuca, Esquire. Mr. and Mrs.
McDermott appeared pro se.
This is an action in ejectment brought by the
Plaintiffs to have Defendants' trailer removed from their
trailer park. Defendants assert that the proper procedures
under the law have not been followed.
The parties estimate this case will take
approximately one half day to try. Defendants are directed to
provide a list of their witnesses and a brief statement as to
what they will say to Plaintiffs' counsel and this Court within
seven days of today's date. Trial in this matter will be held
on Wednesday, June 22, 2005, at 1:00 p.m.
The Defendants have been making payments of their
rent in the Prothonotary's Office. The parties have agreed that
these sums are to be released to the Plaintiffs, and we will
issue a separate Order to that effect.
