PETITION FOR THE APPOINTMENT
OF GUARDIAN OF MINOR'S ESTATE
AND NOW, comes Kimberly S. Day, by and through her attorney, Michael A.
Scherer, Esquire, and respectfully represents as follows:
1. The petitioner is Kimberly S. Day, an adult individual residing at 2178
Newville Road, Carlisle, Cumberland County, Pennsylvania 17013.
2. The petitioner is the natural mother of the juvenile, Morgan E. Day, who is
eleven years old and she resides with her natural mother.
3. Morgan E. Day was born August 1, 1997 and her social security number is
4. Morgan E. Day's natural father, Dennis A. Day, died on December 4,
2007. Attached as "Exhibit A" is a copy of his death certificate.
5. Dennis A. Day had, prior to his death, been named as custodian of a
financial account for Morgan E. Day with Thrivent Mutual, which account has a value of
approximately $1,200.00.
6. Kimberly S. Day has contacted Thrivent Mutual and has been advised that
in order to have access to and control over the account, she must petition the court to
be named as the guardian of the estate of Morgan E. Day.
7. Kimberly S. Day has no adverse interest to her daughter Morgan E. Day.
8. There are no other known parties who may have an interest in this action.
WHEREFORE, petition prays this Honorable Court for an Order naming her as
guardian of the estate of Morgan E. Day.
