PETITION TO HAVE SATISFACTION
OF MORTGAGE STRICKEN FROM THE RECORD
AND NOW, here comes PNC Bank, National Association, formerly Pittsburgh National
Bank, by and through its attorney, Tucker Arensberg, P.C., and files this Petition stating as
follows:
1. Your Petitioner is a national banking association and a citizen of Pennsylvania with
its main office at Fifth Avenue and Wood Street, Pittsburgh, Pa. 15265.
2. The Respondents are individuals with a residence address of 1486 Clover Road,
Camp Hill, PA 17011.
3. That on or about August 10, 1998, a mortgage interest ("Mortgage") in real estate
was conveyed to your Petitioner by Robert H. Parker and Dolores A. Parker, to secure a debt
owed to your Petitioner in the amount of $50,000.00 and said Mortgage was recorded in the
Recorder's Office of Cumberland County, Pennsylvania at Mortgage Book No. 1477, Page 663.
4. That on or about January 24, 2008, your Petitioner inadvertently recorded, in the
above-referenced Recorder's Office, a Mortgage Satisfaction Piece declaring said Mortgage at
Mortgage Book Volume 1477, Page 663 to be satisfied in full, and the Mortgage Satisfaction
Piece is recorded in said Recorder's Office at Instrument No. 200803488. A true and correct copy
of the Satisfaction Piece is attached hereto, incorporated herein and identified as Exhibit "A".
5. That said Mortgage Satisfaction Piece was recorded by mistake, that your
Petitioner did not intend to have the above-referenced Mortgage marked satisfied.
6. There remains an unpaid balance owing on the Mortgage in the amount of
$30,612.22.
7. The Respondents have executed a Consent to this Petition and the said Consent
is attached hereto as Exhibit "B".
WHEREFORE, the Petitioner prays the Court enter an order striking off the Satisfaction of
Mortgage at Instrument No. 200803488, and direct the Recorder of Cumberland County to amend
the notation at Mortgage Book Volume 1477, Page 663 to show that the mortgage recorded there
is not satisfied.
