COMPLAINT
Plaintiff, National Credit Acceptance, by and through its attorneys, Edwin A. Abrahamsen
& Associates, P.C., complains of the Defendant as follows:
1. Plaintiff, National Credit Acceptance, (hereinafter "Plaintiff") is a corporation
maintaining a business at 1731 Howe Avenue, #360, Sacramento, California, 95825.
2. The Defendant KEITH POMRANING (hereinafter "Defendant") is an adult
individual residing at 298A MCALLISTER CHURCH RD. CARLISLE PA 17015.
3. The Defendant Mountain Lakes Farm Inc. is a corporation with its principal place
of business located at 1800 Newville Rd. Carlisle, PA 17015.
4. At all relevant times herein, Plaintiff was engaged in the business of debt purchase
and collection.
5. Defendants applied for and received a credit card issued by WELLS BANK CARD
FRES with the account number 4856200600414794.
6. The within account was sold by WELLS BANK CARD FRES to National Credit
Acceptance for valuable consideration and all rights under said accounts were assigned to
National Credit Acceptance. (See, Bill of Sale attached hereto as Exhibit "A.")
7. Plaintiff was assigned all rights to certain credit card accounts from National Credit
Acceptance, including the account opened by Defendants with account number
4856200600414794.
8. Use of the WELLS BANK CARD FRES credit card was subject to the terms of the
Cardmember Agreement, a copy of which was sent to the Defendants along with the credit card.
(See, Copy of Cardmember Agreement, attached hereto and marked Exhibit "B.")
9. Defendants used the WELLS BANK CARD FRES credit card account number
4856200600414794, for purchases, cash advances and/or balance transfers.
10. The Defendants were mailed account statements relative to the Defendants' use of
the subject credit card.
11. The Defendants defaulted under the terms of the Agreement by failing and refusing
to make monthly payments on the account as they became due.
12. The account became delinquent on June 16, 2007.
13. The principal amount was $11,602.04 at the time it was received by Plaintiff.
14. Pursuant to the account agreement, any unpaid balance accrues interest at the rate
of 24.24%.
15. The total amount due and owing the Plaintiff including interest, is $12,002.70.
16. Pursuant to the terms of the Agreement, Defendants liable to Plaintiff court costs
and reasonable attorney's fees.
WHEREFORE, Plaintiff requests judgment in its favor and against Defendant in the
amount of $12,002.70 plus costs of suit, reasonable attorneys' fees $1,200.27 and any other relief
as the Court deems just and appropriate.

BILL OF SALE AND ASSIGNMENT OF ASSETS
The undersigned WELLS FARGO BANK, N.A. ("Assignor") hereby absolutely sells,
transfers, assigns, scls-over, quitclaims and conveys to National Credit Acceptance, Inc. a
corporation under the laws of Calilomia ("Amirnee'") on an "AS.1S" and "WITH ALL FAULTS"
basis, without recourse and without representations or warranties of any type, kind, character or
nature, express or implied, all of Assignors' tight, title and interest in and to each of the assets
identified in the Asset Schedule attached hereto as Exhibit B, together with the sole right to collect
and charge all principal, interest or other proceeds of any kind with respect to the Assets remaining
due and owing as of the date hereof (including but not limited to proceeds derived from the
conversion, voluntary or involuntary, of any of the Assets into cash or other liquidated property,
including, without limitation, insurance proceeds and condemnation awards), from and after the date
of this Bill of Sale and Assignment of Assets.

therefore, the Court orders judgment in favor of the Debtor/Movant, Keith L. Pomraning, and
against the Respondent, National Credit Acceptance, Inc., as to the relief requested in the
