It is understood this is a work in progress project. Following are items of interest based on a visual inspection of the garage and bathroom projects. Bathrooms: • The GFCI outlet in the main bathroom is not wired properly; the outlet is hot at all times and is a Major safety hazard. • The powder room electric outlet is dead. After the installation wall lighting, there was no power to this outlet. Garage to Den conversion: • The 3-way light switches for the interior lights do not work properly. • The 3-way dimmer switch is not working properly. • The exterior light was not working, and the light installation is not water tight (amateur installation) • Water has entered into the building under the exterior doorsill. This typically does not happen if the sill plate has been properly sealed when door was installed. This must be corrected and the OSB sub-floor dried and repaired of any damage before finished flooring is installed. • The difference in room temperature between the converted garage and the main house was considerable. o Did the contractor consult a heating contractor for furnace and duct sizing? o Was the ceiling insulation increased to R 38? o Was the wall insulation to current standards? o Was the insulation removed that was installed between the garage and house walls? It would be highly recommended the contractor provide documentation that the furnace will handle heating and cooling of the additional squaze footage. Also, that the supply and return ducts are adequate as well as provide R ratings of wall, floor and ceiling insulation. A certified electrician needs to correct all electrical issues. The GFCI, three way switches, dead powder room outlet, exterior light fixture watertight and verify recess lighting thermal protected. If you have any questions, I can be reached at 717-221-1004. Apt. 626 Washington, DC 20008 February 26, 2008 Mr. Gus Dorn Pennsylvania Office of the Attorney General Bureau of Consumer Protection 301 Chestnut Street, Suite 105 Harrisburg, PA 17101 Re: 30 Warwick Circle Mechanicsburg, PA 17101 Your file Reference: A005299-2007 Dear Mr. Dorn: I received your letter dated February 22, 2008, which in essence states that you can no longer help me in the mediation of this case. I fail to see why that is so, since you obviously heard back from the contractor in this case, Mike Wagner. There is no sentence or thought expressed in your letter as to what you attempted to do in order to mediate this case. Did you contact him personally? Did you propose any sort of settlement? Apparently not. I consider this extreme neglect on your part and that of your office as a whole. It was you who offered to mediate, yet you have done nothing. And the worst part is that this will happen again with this contractor, so you will have no doubt that there will bean "established pattern or practice of deceptive or unfair conduct." If I asked for your help, in my opinion, you should not have responded at all if you needed a "pattern". Why should you need it? I am the pattern; I am the one who lost the money for this job and have nothing to show for it. How many persons do you need to establish a pattern, when I am the person who asked for your help? Besides that, how do you know that there is not a "pattern." You have not told me you looked for one in any record whatsoever. You merely write a letter saying you can't help me. I can write a letter, and so can anyone else. I needed assistance, not evasion; a result, not an excuse. Moreoever, Mr. Wagner's letter to you indicates that he has doesn't understand the Silver Spring Township Inspector's report (which I ordered and he did not). He does not mention that there was an additional, independent inspection either. He, however, knows full well that there were two inspectors on the premise, since I notified him they were coming and sent him copies of their reports of what was and is wrong. His statement that he doesn't understand the Townshp Inspector is an outright fabrication. The reports indicate that the wiring is wrong, the heat is not established in the room, there is water coming in under the new door which Mr. Wagner installed, and, in addition, the wiring in the bathrooms is not correct, according to Code. The insulation on the concrete floor is not of the proper grade, either. All this work will have to be re-done, at considerable expense to me. If he had attended that inspection by both inspectors, he would have had to acknowledge that he knew his work was not correct. He did not even call for that final inspection, and it was not because the garage was not painted...it was because he was, by that time out of business, and had no intention of calling for another inspection. Furthermore, it is his duty to call for the inspection, and if the work had been completed, he should have done so. As matters stood in December, it was I who called for it and had it done. That is when I learned how bad things really were and what was necessary to fix the mistakes. However, he chose not to show up on December 3, although I had notified him that two inspectors were coming to the property and that he should join us. I had the two inspectors go over the renovations, as well as the owner of Leggett, Inc., who is going to fix the heating and wiring problems, at no small expense to me. In addition, the second contractor who came to visit and give me an estimte for the re-work of the concrete floor has stated that the concrete floor was not sealed as it should have been to form a water-vapor barmier. Mr. Wagner had to have known that, if he is a decent and experienced contractor. I am not the contractor, but he is, and he should have proposed that the concrete be sealed when he presented his estimate. Also, the insulation has not been done on the concrete floor, and if it has, as Mr. Wagner claims it is, the right grade of insulation was not used. We will, however, know the truth about that very soon, since I intend to have the floor work started in March. He will also install a storm door and fix the problem with the water coming in under the side door. Since December 3, I have gotten the two estimates for fixing the wiring, the heat, the door, the concrete floor, etc. There will be two companies involved in the corrections. Their estimates tell the tale of the mistakes and general neglect shown by Mr. Wagner in his work at 30 Warwick Circle. This neglect to do the entire job properly is well documented by the inspectors' reports, and by the two estimates I now have. However, I do not have any satisfaction from your office whatsoever; the fact is that Mr. Wagner' message to me is that he intends to "open a new company in the spring," which he told me in his phone message to me (given previously to you). How on earth can your office allow him to do that? He is just going to rob someone else who is unsuspecting of the harm done to me and yet, you claim to have the power to "mediate" this situation. You have done nothing that I couldn't have done, except possibly get him to write you a return letter, which is a pack of lies. He has no fear about opening another business, you will not stop him, and he knows it. And if he is "deep in debt and has no cash floor and poor sales," still he is planning to open a new business in the spring. That means he has to declare some sort of bankruptcy. Your job, in my opinion, is to stop that from happening, so that the citizens will not have to experience a "pattern or practice of deceptive and unfair conduct." And you completely failed the test. Lastly, I will indeed take Mr. Wagner to the District Court, and I will indeed get a judgment against him if possible. He has practiced deceptively with this construction project and he will continue to do so with others if he is not stopped. If this conduct is legal in Pennsylvania, and I had known it when I bought that house, I would never have bought any property in that state. -2- And I will not hesitate to tell everyone I know, and possibly use the media to do so, that there are no prohibitions of any kind in the Commonwealth of Pennsylvania against such behavior. If you people in government cannot control this type of deception, (and in this case, don't even try to do so), perhaps more people who decide to move there will be dissuaded from doing so when they learn that there is such a lack of control and enforcement of regulations against contractors who practice in this manner. The only thing I can possibly be happy about is that you gave me the distinction between filing in the District Court and the Court of Common Pleas. I already had filled out a Civil Complaint, and will take it to the proper court and file it next week. Owner is responsible for the removal, security and storage of al personal and other property from the job site and affected work areas unless specifically agreed otherwise with the Contractor. 14. In the event of default by Owner or it becomes necessary for Contractor to turn this matter over to a collection agency or service or Contractor's attornies for collection and/or enforcement of the terms and conditions of this Agreement, Owner agrees to pay all fees, costs and expenses of collection including, but not limited to, collection agency fees, reasonable attorney's fees, court costs and expenses, as are incurred by Contractor for such collection or enforcement. 15. Contractor has no responsibility for any additional work or services pertormed under any agreement between the property Owner and the workmen, tradesmen or subcontractors of the Contractor. 16. OWNER WILL PROMPTLY NOTIFY CONTRACTOR OF ANY UNSATISFACTORY, DEFECTIVE OR SUSPECT WORK ON DIS- COVERY REGARDLESS OR OWNER'S OPINION OF THE IMPORTANCE OF SUCH WORK IN RELATION TO THE OWNER'S OVERALL SATISFACTION WITH THE PROJECT. CONTRACTOR WARRANTS ALL WORKMANSHIP PERFORMED BY OR ON BEHALF OF CONTRACTOR PURSUANT TO THIS AGREEMENT FOR THE PERIOD OF TWELVE (12) MONTHS FROM THE DATE OF SUBSTANTIAL COMPLETION. OWNER AGREES THAT CONTRACTOR MAY FULFILL ITS WARRANTY OBLIGATIONS BY CAUSING ITS SUPPLIERS OR SUBCONTRACTORS TO CURE ANY DEFECTS REACTING TO FAULTY WORKMANSHIP. THIS WARRANTY IS MADE VOID IF DEFECTS OF WORKMANSHIP OR MATERIALS OR CAUSED ORAG- GRAVATED BY ANY OF THE FOLLOWING: NEGLECT, MISUSE, DELAY IN NOTIFICATION TO CONTRACTOR OF DEFECT, CANCELLATION, RESCHEDULING, TERMINATION OF WORK, OR WORK STOPPAGE, BY THE OWNER; AND CIRCUM- STANCES BEYOND CONTRACTOR'S CONTROL, INCLUDING BUT NOT LIMITED TO STRIKES, INCLEMENT WEATHER, ACTS OF GOD, CASUALTY, UNAVAILABILITY OF MATERIALS, OR STOPPAGE OF WORK BY PUBLIC AUTHORITY NOT DUE TO ANY FAULT OF CONTRACTOR. NO OTHER WARRANTIES EXPRESS OR IMPLIED, ARE BEING PROVIDED, EXCEPT AS PROVIDED OTHERWISE SPECIFICALLY HEREIN. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, ARE EXPRESSLY DISCLAIMED AND DO NOT APPLY, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANT- ABILITY, FITNESS FOR ANY PARTICULAR PURPOSE AND HABITABILITY. 17. Any right of action or defense arising out of the transaction which gave rise to this contract which Owner has against Contrac- tor shall be cut off by assignment of this contract to any third person if the assignee gives notice of the assignment to Owner as provided in Section 208 of the Home Improvement Finance Act of Pennsylvania and within fifteen (15) days of the mailing of such notice receives no written notice of the facts giving rise to the claim or defense of the Owner. 18. In the event this Agreement is deemed to be a consumer credit contract, the following Notice is provided. NOTICE: ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS AND SERVICES OBTAINED HERETO OR WITH THE PROCEEDS HEREOF.
