Cumberland County Bar Association 2 Liberty Avenue Carlisle, PA 17013 ((800) 990-9108 (717) 249-3166 PRESBYTERIAN HOMES, INC. 1217 Slate Hill Road Camp Hill, PA 17011, t/d/b/a GREEN RIDGE VILLAGE, Plaintiff LORRAINE DIAS 209 Park Avenue Coming, NY 14830, Individually and as Plenary Guardian of the Person of JEAN DIAS, DECEASED, Defendant IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA No. COMPLAINT AND NOW, comes Plaintiff Presbyterian Homes, Inc,, t/d/b/a Green Ridge Village (hereinafter "PHI"), by and through its attorneys, Duane Morris LLP, and in support of this Complaint, avers the following: 1. Presbyterian Homes, Inc. is a Pennsylvania nonprofit corporation which operates a long-term care facility at Green Ridge Village, Swaim Health Center, 210 Big Spring Road, Newville, Pennsylvania, 17241-9486. 2. Defendant Lorraine Dias is an adult individual with an address of 209 Park Avenue, Coming, New York, 14830. 3. Defendant's mother, the late Jean Dias, was a private pay resident at Green Ridge Village. 4. The elder Ms. Dias died at Green Ridge Village on April 7, 2003. 5. At the time of Jean Dias' admission, Defendant Lorraine Dias signed an admission agreement as Jean Dias' guardian. 6. As such, Lorraine Dias agreed to apply her mother's funds to her care and treatment at Green Ridge Village. No payments have been received on this account since December 2002. At the present time, the balance due and owing is $23,468.37, plus attorneys' fees 8. and costs. 9. A true and correct copy of the agreement signed by Lorraine Dias as guardian for Jean Dias is incorporated hereby and attached hereto as Exhibit "A." Count I Breach of Contract 10. The averments of Paragraph 1 through 9 are incorporated hereby as if set forth fully and at length. Lorraine Dias had a contractual obligation to apply her mother's funds to her 11. mother's care. 12. 13. 14. Lorraine Dias has failed to do so. Lorraine Dias has breached the contract which she had with Plaintiff. Plaintiff has been damaged by that breach in the amount of $23,468.37, plus attorneys' fees and costs. WHEREFORE, Plaintiff Presbyterian Homes, Inc. respectfully requests this Honorable Court to grant judgment in its favor and against Defendant Lorraine Dias in the amount of $23,467.37, which amount is below the jurisdictional limit for compulsory arbitration, plus attorneys' fees and costs, and whatever other relief the Court may deem just and equitable. Count II Fraud The averments of Paragraph 1 through 14 are incorporated hereby as if set forth 15. fully and at length. 2 16. Upon information and belief, Defendant Lorraine Dias has retained the funds of her mother's, which should have been paid to Plaintiff for her mother's care. These funds have been fraudulently concealed and applied to Lorraine Dias' own 17. purposes. 18. care. 19. Lorraine Dias had an obligation to apply her mother's assets toward her mother's Her failure to do so, and her concealment and misrepresentation concerning those assets constitutes actual fraud. WHEREFORE, Plaintiff Presbyterian Homes, Inc. respectfully requests this Honorable Court to grant judgment in its favor and against Defendant Lorraine Dias in the amount of $23,467.37, which amount is below the jurisdictional limit for compulsory arbitration, plus punitive damages, attorneys' fees and costs, and whatever other relief the Court may deem just and equitable.
