NO. ? n -2008( M L.D PENNSYLVANIA BUILDERS & DEVELOPERS MECHANICS' LIEN Owner MECHANICS' LIEN CLAIM Claimant, Armold & Son Excavation, LLC, by and through the undersigned counsel, files this claim against the improvements and property being designated as Red Oak Estates more fully described in accordance with the Plan of lots for Pennsylvania Builders & Developers, recorded October 15, 2007, in the Cumberland County Recorder of Deeds at Instrument Number 200739561 and fully set forth in Deed Book 274 Page 3043, recorded in the Cumberland County Recorder of Deeds on May 18, 2006, for the payment of a debt due to claimant as a contractor for labor/materials furnished by claimant in the erection and construction of the improvements. In support of the claim, the claimant makes the following statement: 1. The owner of the property is Pennsylvania Builders & Developers, with an address at 337 Lincoln Street, Carlisle, Cumberland County, Pennsylvania 17013. 2. The improvement and the property which are subject to this claim are designated as Red Oak Estates more fully described in accordance with the Plan of lots for Pennsylvania Builders & Developers, recorded October 15, 2007, in the Cumberland County Recorder of Deeds at Instrument Number 200739561 and fully set forth in Deed Book 274 Page 3043, recorded in the Cumberland County Recorder of Deeds on May 18, 2006. 3. The labor/materials for which the debt is due totals $30,135.64 and the invoices are attached hereto as Exhibit "A". 4. The labor/materials for which the debt is due consisted of excavation machine services, dump truck services, cement, interest charges, excavation machine moving charges, labor and the like. 5. The labor/materials for which the debt is due were furnished to Owner up front with no money down and was to be paid in a thirty (30) day billing cycle. 6. The labor/materials furnished consisted of the following: a. Hi Lift 963B Service at $100.00 per hour, an itemized list of the service and the dates when the service was performed is attached as Exhibit "A". b. John Deere Backhoe Service at $70.00 per hour, an itemized list of the service and the dates when the service was performed is attached as Exhibit "N'. c. Excavation labor at $45.00 per hour, an itemized list of the hours worked and the dates when the work was performed is attached as Exhibit "A". d. Tamper Service at $30.00 per hour, an itemized list of the service and the dates when the service was performed is attached as Exhibit "A". e. Truck and Trailor Service at $85.00 per hour, an itemized list of the service and the dates when the service was performed is attached as Exhibit "A". f. John Deere Moving charge at $70.00 per move, an itemized list of the service and the dates when the service was performed is attached as Exhibit "A". g. Single Axel Dump Truck Service at $45.00 per hour, an itemized list of the service and the dates when the service was performed is attached as Exhibit "A". h. Roller at $220.00 per rental, an itemized list of the service and the dates when the service was performed is attached as Exhibit "A". i. Stainless Steel Clamps at $77.50 each clamp, an itemized list of the material and the dates when the material was used is attached as Exhibit «A„ j. Cement at $6.18 per bag, an itemized list of the material and the dates when the material was used is attached as Exhibit "A". k. Concrete at $4.50 per bag, an itemized list of the material and the dates when the material was used is attached as Exhibit "A". 1. Service Charge at 1.5% of the balance due, an itemized list of the service charge is attached as Exhibit "A". 7. Because the properties are in a development and Claimant has been contracted by owner to complete all work for the development Claimant has stopped work on the development as Owner has failed to pay the substantial bills currently outstanding.
