Halbert, Owner JA Halbert Builder, LLC, a limited liability company, Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, Douglas Edward Halbert, of Cumberland, Pennsylvania, is about to execute contemporaneously herewith, a contract with JA Halbert Builder, LLC, a limited liability company of Dauphin County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: TRACT NO. 1 - UNIT NO. E-4 ALL THAT CERTAIN tract or parcel of land situate i n Hampden Township, Cumberland County, being more particularly bounded and described as follows, to wit: BEGINNING at a point on the northern right-of-way line of Cross Creek Drive at the common front property comer of Unit No. E-4 and Unit No. E-5 as shown on the hereinafter mentioned Plan of Lots; thence along said right-of-way line of Cross Creek Drive South 60 degrees 27 minutes 30 seconds West, a distance of 24.00 feet to a point at the dividing line between Unit No. E-3 and Unit No. E-4; thence along said dividing line North 29 degrees 32 minutes 30 seconds West, a distance of 102.00 feet to a point; thence North 60 degrees 27 minutes 30 seconds East, a distance of 24.00 feet to a point at the dividing line between Unit No. E-4 and Unit No. E-5; thence along said dividing line South 29 degrees 32 minutes 30 seconds East, a distance of 102.00 feet to a point, said point being the Place of BEGINNING. CONTAINING 2,443 square feet. BEING Unit No. E-4 on plan entitled "Final Subdivision Plan for Phase Three of The Townes of Cross Creek, Hampden Township, Cumberland County, Pennsylvania" prepared by Alpha Consulting Engineers, Inc. and recorded on April 24, 2003 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 87, Page 20. BEING Unit No. E-6 on plan entitled "Final Subdivision Plan for Phase Three of The Townes of Cross Creek, Hampden Township, Cumberland County, Pennsylvania" prepared by Alpha Consulting Engineers, Inc. and recorded on April 24, 2003 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 87, Page 20. UNDER AND SUBJECT to Planned Community Declaration For The Townes at Cross Creek as set forth in Miscellaneous Book 676, Page 481. UNDER AND SUBJECT to Amendment to Planned Community Declaration For The Townes at Cross Creek as set forth in Miscellaneous Book 680, Page 2666. UNDER AND SUBJECT to all conditions as set forth on the above referenced plan. NOW, the 2..~ %ay of January, 2OO4, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Douglas Edward Halbert, to the said JA Halbert Builder, LLC, a limited liability company to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with JA Halbert Builder, LLC, a limited liability company and the further consideration of One Dollar, to JA Halbert Builder, LLC, a limited liability company paid by Douglas Edward Halbert, it is agreed that no lien shall be filed against the building by the contractor, or any sub- contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. - 3 - WITNESS, our hand and seals the day and year aforesaid.
