STIPULATION AGAINST LIENS
WHEREAS, Premier Rental Associates, a Pennsylvania Limited Partnership, of
Dauphin County, Pennsylvania, is about to execute contemporaneously herewith, a contract with JA
HALBERT BUILDER, LLC, a limited liability company of 19~.~f Ix, & County, Pennsylvania,
for the erection of a dwelling upon a lot of land situate as follows:
TRACT NO. 1 - UNIT NO. E-1
ALL THAT CERTAIN tract or parcel o f land situate in Hampden Township,
Cumberland County, being more particularly bounded and described as follows, to wit:
BEGINNING at a point on the northern fight-of-way line of Cross Creek Drive at
the common fi'ont property comer of Unit No. E-1 and Unit No. E-2 as shown on the hereinafter
mentioned Plan of Lots; thence along said right-of-way line of Cross Creek Drive South 60 degrees
27 minutes 30 seconds West, a distance of9.16 feet to a point; thence continuing by a curve having
a radius of 175.00 feet and an arc length of 21.48 feet to a point at the dividing line between Unit No.
D- 1 and Unit No. E- 1; thence along said dividing line North 36 degrees 34 minutes 30 seconds West,
a distance of 27.89 feet to a point; thence North 29 degrees 32 minutes 30 seconds West, a distance
of 75.63 feet to a point; thence North 60 degrees 27 minutes 30 seconds East, a distance of 34.00 feet
to a point at the dividing line between Unit No. E- 1 and Unit No. E-2; thence along said dividing line
South 29 degrees 32 minutes 30 seconds East, a distance of 102.00 feet to a point, said point being
the Place of BEGINNING.
CONTAINING 3,433 square feet.
BEING Unit No. E- 1 on plan entitled "Final Subdivision Plan for Phase Three of The
Townes of Cross Creek, Hampden Township, Cumberland County, Pemasylvania" prepared by Alpha
Consulting Engineers, Inc. and recorded on April 24, 2003 in the Office of the Recorder of Deeds
in and for Cumberland County, Pennsylvania in Plan Book 87, Page 20.

ALL THAT CERTAIN tract or parcel of land situate in Hampden Township,
Cumberland County, being more particularly bounded and described as follows, to wit:
BEGINNING at a point on the northern right-of-way line of Cross Creek Drive at
the common front property comer of Unit No. E-2 and Unit No. E-3 as shown on the hereinafter

UNDER AND SUBJECT to Planned Community Declaration For The Townes at
Cross Creek as set forth in Miscellaneous Book 676, Page 481.
UNDER AND SUBJECT to Amendment to Planned Community Declaration For
The Townes at Cross Creek as set forth in Miscellaneous Book 680, Page 2666.
UNDER AND SUBJECT to all conditions as set forth qn the above referenced plan.
NOW, the C'7 dayofl~,2,COg, atthetimeofandimmediatelybefore
the execution of the principal contract, and before any authority has been given by the said Premier
Rental Associates, a Pennsylvania Limited Partnership, to the said JA HALBERT BUILDER, LLC,
a limited liability company to commence work on the said building, or purchase materials for the
same in consideration of the making of the said contract with JA HALBERT BUILDER, LLC, a
limited liability company and the further consideration of One Dollar, to JA HALBERT BUILDER,
LLC, a limited liability company paid by Premier Rental Associates, a Pennsylvania Limited
Parmership, it is agreed that no lien shall be flied against the building by the contractor, or any sub-

contractor, nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the fight to file
such liens being expressly waived.
