KING VERSUS CONTRACTOR: ELAM G, STOLTZFUS, INC, NO. TERM FEBRUARY 4, 2004 WHEREAS, ROBERT R, KING, III and KATHRYN L. KING, HUSBAND AND WIFE of 6477 MOUNTAIN VIEW DRIVE, SLATINGTON, PENNSYLVANIA 18080, is about to execute conte~porap~ous~ herewith a contract with ELAM G. STOLTZFUS, INC. of , for the erection of a ,~/~'~lt"~ story building upon a lot of land situate SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PURPOSES NOW, FEBRUARY 4, 2004, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with OWNER and the further consideration of one Dollar, to CONTRACTOR paid by OWNER it is agree that no lien shall be flied against the building by the contractor, or any subcontractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. [Seal] Page I of 1 SMSNDC/OOO217-OOOO/P A/CO NSO I 61 ALL THAT CERTAIN lots or tracts of land situate in East Pennsboro Township, Cumberland County, Commonwealth of Pennsylvania more particularly bounded and described as follows, to wit: BEGINNING at a point on the northern extremity of an arc connecting the northern dedicated right-of-way line of Veronica Lane and the eastern dedicated right-of-way line of Crooked Drive; Thence by the eastern right-of-way line of Crooked Drive North 09 degrees 24 minutes 47 seconds West 6.65 feet to a point; Thence by same by a curve to the left having a radius of 175.00 feet and an arc length of 69,97 feet, said curve also having a chord bearing and distance of North 20 degrees 52 minutes 03 seconds West 69.51 feet to a point at the dividing line of Lot #13 and Lot #11; Thence by line of Lot #13 North 57 degrees 40 minutes 40 seconds East 91.27 feet to a point at the dividing line of Lot #12 and Lot #11; Thence by line of Lot #12 South 22 degrees 26 minutes 01 seconds East 110.01 feet to a point on the northern right-of-way line of Veronica Lane; Thence by said right-of-way line South 67 degrees 33 minutes 59 seconds West 78.69 feet to a point; Thence by same by a curve to the right having a radius of 15.00 feet and an arc length of 26,97 feet, said curve also having a chord bearing and distance of North 60 degrees 55 minutes 24 seconds West 23.48 feet to a point on the eastern right-of-way line of Crooked Drive, the place of BEGINNING. CONTAINING 9,129 square feet, BEING Lot #11 on the Final Subdivision Plan for Westwood Hills, Phase ][~A recorded in Plan Book 83, Page 32, UNDER AND SUBJECT nevertheless, to a 25-foot wide Drainage Easement as shown on the above-mentioned Subdivision Plan. BEING THE SAME PREMISES which Elam G. Stoltzfus, Jr., Inc., by deed to be recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Robert R. King, III and Kathryn L. King.
