WAIVER OF RIGHT TO FILE LIEN--SEPARATE
STIPULATION OF MECHANICS' LIENS
WHEREAS, W. A. KLAWITTER CONSTRUCTION, INC., party of the
first part, hereinafter called Contractor, has entered into a
contract with Marlin R. McCaleb and Mary E. Kula, Co-Executors
under the Last Will and Testament of MARY D. McCALEB, Deceased,
parties of the second part, hereinafter called Owners, to provide
materials and perform labor necessary for the repair of the
chimney and the installation of a new roof at the residential
dwelling upon premises described as follows:
BEING the premises situate in the Borough of Mechanicsburg,
Cumberland County, Pennsylvania, being known and numbered as 213
West Maplewood Avenue.
NOW, THEREFORE, it is stipulated and agreed by and between
the said parties, as part of the said contract and for the
consideration therein set forth, that neither the undersigned
Contractor, any sub-contractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
this contract shall file a lien, commonly called a Mechanics'
Lien, for work done or material furnished to said building or any
part thereof .
This stipulation is made and intended to be filed with the
County Prothonotary within ten days after date, in accordance
with the requirements of the Act of Assembly of Pennsylvania, in
such case provided.
IN WITNESS WHEREOF, the parties hereto have caused this
document to be executed this 2nd day of April 2008, intending
to thereby legally bind themselves, their heirs, personal
representatives, successors and assigns.
