ORDER OF COURT
AND NOW, this 11th day of April, 2008, upon consideration of the Petition
for Appointment of Emergency Guardian for Robert Wayne Maxwell, pursuant to 20
Pa.C.S. Chapter 5513, and following a hearing held on this date, it is ordered, adjudged,
and decreed as follows:
1. Robert Wayne Maxwell lacks sufficient mental capacity to make or
communicate responsible decisions concerning his person and estate and is adjudicated
an incapacitated person on an emergency basis.
2. Petitioner William Donald Maxwell is appointed emergency plenary
guardian of the person and estate of Robert Wayne Maxwell.
3. The guardianship created herein on an emergency basis shall extend
for a period of 72 hours.
4. The guardian having requested a twenty (20) day extension of the
emergency order, given the testimony of Dr. Cotton that the prognosis of Robert Wayne
Maxwell is poor and that his condition will not improve, this request for extension is
granted.
5. By separate order, the final the hearing on the Guardianship shall take
place on May 5, 2008, at 9:30 a.m.
