Carter is an adult individual with a current residence of 9501 Tregaron Place, Burke, Fairfax County, Virginia 22015. 2. Plaintiff Kelly-Marie H. Carter is an adult individual with a current residence of 9501 Tregaron Place, Burke, Fairfax County, Virginia 22015. 3. Defendant Krista K Baer, is an adult individual with a current residence of 71 Cold Springs Rd, Carlisle, Cumberland County, Pennsylvania. 4. On or about 6/9 July 2002 the Defendant, Krista K Baer leased a single family home, at 114 Dogwood Dr, Mt Holly Springs, Cumberland County to the Plaintiff for the term of 1 year. 1. BREACH OF CONTRACT- KRISTA K.BAER 5. Paragraphs 1 through 4 are incorporated herein by reference as though set fourth at length 6. Ms. Baer (land lord) entered into a residential lease contract with Mr. David D. Carter (tenant) on or about 6/9 July 2002. Ms. Baer let it be known at that time that her then husband - Ron Baer was to act as the property manager. 7. Several weeks later Mr. Carter assumed possession of the property. 8. Mr. / Ms. Baer were provided written notice on 19 Ju r1-2003 of Mr. Carter's intent to vacate the premises between 14 - 24 July 2003 due to his impending military transfer. An additional written update was provided to Mr. / Ms Baer by Mr. Carter on 29 June 2003 given the exact date of vacating the premises on 20 July 2003. 9. This notice is clearly within the scope of the lease between the plaintiff and the defendant (paragraph 3) and with in the scope of the military clause. 10. In the letter dated 29 June 2003 Mr. / Mrs. Carter clearly ask Ms Baer to come to the property upon move out to inspect the premises as necessary and to refund the security deposit and also provided their forwarding address. 11. In addition Mr. / Mrs. Carter tried to contact both Mr. / Mrs. Baer via telephone to arrange a time to meet to perform said inspection. Neither Mr. nor Ms. Baer could be contacted, messages were left but no calls were returned. 12. Mr. / Mrs. Carter left the premises at 114 Dogwood Dr, Mt Holly Springs, in significantly better condition than when they assumed it. The property was left ready for the next tenant to move-in without any work of any kind required by Mr. / Mrs. Baer. 13. After moving to Virginia Mr. / Ms. Carter made many attempts to contact Mr. / Ms. Baer In an effort to retrieve the security deposit in question. No correspondence of any kind was ever received. 14. Mr. / Mrs. Carter attempted to contact Ms. Baer by phone and email. Several phone messages including the forwarding address were left on Ms. Baer's home answering machine. No Calls were returned. No correspondence was received. 15. Mr. Carter was able to speak with a baby sitter and left a message also including his forwarding address. This call was not returned. No correspondence was received. 16. Mr. Carter was able to speak with Ms Baer's Mother and left a message also including his forwarding address. This call was not returned. No correspondence was received. 17. On 11 Sept 2003 Mr. / Mrs. Carter sent a certified letter to Ms. / Mr. Baer's home again requesting return of the security deposit. Normally certified letters are attempted to be delivered 3 times before being returned to the sender by the post office. The letter was returned because Ms. / Mr. Baer failed to accept delivery. Z 18. On 3 October 2003 Mr. / Mrs. Carter sent a certified letter to Ms. Baer's office again requesting return of the security deposit. This letter was signed for by Jane McClain on behalf of Ms. Baer. 19. Still no correspondence of any kind was received. 20. As a result of Ms. Baer's breach of contract Mr. tarter incurred losses of $2,236.00. Wherefore, the Plaintiff demands judgment against the defendant in the amount in excess of $2,236.00 plus interest, damage, delay and costs of suit. Krista K Baer, Defendant NO. 04-706 CIVIL CIVIL ACTION RESPONSE TO COMPLAINT We entered into a rental agreement with the Carters. At the time the duration of the intended lease was to be two years as Mr. Carter was stationed with Dickinson College in the ROTC department. Originally the intended lease was for two years. With this knowledge we did not relist the property. I received a letter indicating that they would be leaving as he was being relocated. I was left a forwarding address with the last months rent on an envelope when they gave notice of their impending departure in the middle of June. I relisted the property with the war college. It was however late in the "season" as most of the incoming class had already found housing. In the middle of July I was notified by Mr. Carter via phone that they would be leaving near the end of the month. I was asked about doing a walkthrough at that time. I had a planned vacation and informed them that I would be away but would agree to go through after I had returned and would get a hold of them if anything was out of order. This was agreeable to them as they had left the key in a designated area. I returned 5 days after their departure. I went and inspected the house and then tried to get a hold of them to discuss the trash that was left , the color of the rooms, and their share of of a $3400 bill from an issue earlier in the year. August 6`h - I received the first and only call of interest in the rental. However upon visiting they were not willing to move into the house unless the two bedrooms that had been the children's were repainted into neutral colors. Not being able to pass up renters since I didn't have it listed in time, and had only had this one call and could not afford to not have it rented, the rooms were repainted in great speed. In the meantime I attempted to get a hold of the Carters again so we could discuss this, the fact that there was a large volume of trash that had to be hauled away, and an issue that occurred earlier that year with some flooding in the basement. I left two messages for them to call. They returned my calls at work. I was working between two offices though and was missing their return calls. Near the end of August I sent them a letter explaining what I was willing to return to them based on the above mentioned issues. I heard nothing from them. I am assuming that they were unhappy with my letter and have pursued all of this action out of spitefulness. Rather than trying to resolve this amicably they have consumed a lot of time trying to discredit me with the rental department as well. As maintained in my letter in the late summer, I will return the difference between having the house painted, the trash hauled away, the portion of the bill from the night that Tuckey was called to respond to a sump pump not working that was actually due from Mr. Carter's negligence and failure to notice that the breaker was flipped on, and the extended time that Tuckey was unable to pick up their equipment after several attempts at contacting the Carters. This documentation of the number of times they tried to pick this up and call is all available from Tuckey Restoration. Tuckey had the same problem I apparently did trying to call the Carters.
