Plaintiff AGAR WELDING SERVICE & STEEL SUPPLY, INC. is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, with offices at 2815 Ritner Highway, Carlisle, Cumberland County, Pennsylvania 17013, 2. Defendant DONALD F. REISINGER is an adult individual who is trading and doing business as REISINGER CONSTRUCTION with offices at 1816 Sterretts Gap Avenue, Carlisle, Cumberland County, Pennsylvania 17013. 3. On or about November 20, 2003, Defendant contracted with Plaintiff for the WAYNE F. SHADE Altomey at Law 53 West Pomfret Street Carlisle, Pennsylvania 17013 fabrication, priming, finished painting and installation of approximately twenty lateral feet of radiused wrought iron railing on exterior stairs at the premises of Robert F. Long and Katherine G. Long at 300 Belvedere Street, Carlisle, Cumberland County, Pennsylvania 17013. A copy of the proposal therefor is attached hereto as Exhibit "A" and incorporated herein by reference as though fully set forth. 4. Plaintiff was a subcontractor to Defendant in said transaction. 5. The agreed price was Two Thousand Nine Hundred Fifty-Seven and 401100 ($2,957.40) Dollars. 6. On or about December 9, 2003, Plaintiff provided the agreed materials and performed the agreed labor. 7. The materials provided by Plaintiff were of satisfactory quality, and the labor was performed in a good and workmanlike fashion. 8. On or about December 9, 2003, Plaintiff forwarded its invoice for said labor and materials to Defendant. 9. The terms of the invoice were "Net 30 Days". WAYNE F. In spite of repeated demands therefor, Defendant has wholly failed and refused to make any payment on account of the foregoing labor and materials. WHEREFORE, Plaintiff demands judgment against Defendant in the amount of Two Thousand Nine Hundred Fifty-Seven and 40/100 ($2,957.40) Dollars plus costs and interest from the thirty-first day after the date of the invoice. COUNT 11 INTEREST, PENALTIES AND ATTORNEY FEES 11. The averments of ¶¶1 through 10 above inclusive are incorporated herein by reference as though fully set forth. WHEREFORE, Plaintiff demands judgment against Defendant, under the provisions of the Contractor and Subcontractor Payment Act, 73 Pa.C.S. §501, et seq., for interest at the rate of one (I%) percent per month or fraction of a month on the unpaid balance from the thirty-eighth day after the date of the invoice plus penalties at the rate of WAYNE F.
