HOFFMAN'S CUSTOM CONTRACTING, INC., hereinafter referred to as
Contractor,
AND
EDWARD S. HAM and STACY P. HAM, husband and wife, hereinafter
referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a single family dwelling situate in
Dickinson Township, Cumberland County, Pennsylvania and more fully
described in Exhibit "A" which is attached hereto and made a part
hereof known as Lot 81, Clarendon Ct. Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Hoffman's Custom Contracting, Inc., a corporation, and that he as
such President being authorized to do so, executed the foregoing
instrument for the purposes therein contained by signing the name
of said corporation by himself as such President.

Exhibit A
ALL THAT CERTAIN lot of land situate in Dickinson Township, Cumberland
County, Pennsylvania, bounded and described in accordance with Subdivision Plan
for Clarendon, prepared by Statler-Brehm Associates, Inc. dated June 10,1998
consisting of 14 pages, a copy of which was recorded in the hereinafter named
Recorder's Office on August 19,1998 in Plan Book 77, Page 56, which Subdivision
Plan for Clarendon is incorporated herein by reference, as follows:
BEGINNING at a point on the northern right of way line of 50 feet wide Bradford
Place at the dividing line between Lots Nos. 80 and 81; thence along said dividing
line, North 48 degrees 16 minutes 39 seconds East a distance of 384.47 feet to a point
at the dividing line between Lots Nos. 81 and 84; thence along said dividing line
South 40 degrees 16 minutes 18 seconds East a distance of 212.59 feet to a point at
the dividing line between Lots Nos. 81 and 83; thence along said dividing line South
54 degrees 14 minutes 42 seconds West 198.67 feet to a point at the dividing line
between Lots Nos. 81 and 82; thence along said dividing line South 61 degrees 45
minutes 13 seconds West 203.83 feet to a point in the northern right of way line of 50
feet wide Bradford Place; thence along said right of way line North 29 degrees 44
minutes 45 seconds West a distance of 15.00 feet; thence continuing along said right
of way line by a curve to the left with a radius of 625.00 feet a chord bearing North
35 degrees 44 minutes 03 seconds West, a distance of 130.41 feet to a point, the Place
of BEGINNING.
The above described lot of land is all of Lot No. 81 as shown on said Subdivision for
Clarendon.
The above described Lot No. 81 has the mailing address of 12 Bradford Place,
Carlisle, PA 17013.
