RIDGEVIEW CUSTOM HOMES, LLC Contractor 1N THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA This instrument is executed this 28`" day of January, 2008, by Ridgeview Custom Homes, LLC ("Contractor") (or "Subcontractor"') in favor of Leo M. Goodman, Jr. and Constance Y. Goodman ("Owners") Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for the erection of a house upon a lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, being known as Lot No. 52, on the Final Subdivision Plan for Phase Number II, Nicholas Manor, as recorded in Cumberland County Plan Book 94, Page 96, more fully described as follows: ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County, Pennsylvania, bounded and described according to the Final Subdivision Plan for Phase Number 2, Nicholas Manor prepared by Dawood Associates, Engineers, Planners, Surveyors, dated June 6, 2005, revised through July 21, 2006, and recorded in Cumberland County, Pennsylvania Plan Book 94, Page 96, on July 2, 2007, as follows: BEGINNING at an iron pin set on the right-of--way line of Hawthorn Court (50' ROW) and the northwestern corner of Lot No. 51 on the above-referenced Plan; thence along said Lot No. 51, South 25 degrees 53 minutes 10 seconds East 313.55 feet to an iron pin set; thence along Lot No. 48 on the above-referenced Plan, South 56 degrees 47 minutes 28 seconds West 165.61 feet to an iron pin set; thence along the right-of--way line of Willow Lane (50' ROW) North 39 degrees 09 minutes 33 seconds West 29.16 feet to a point; thence along same on a line curving to the right having a radius of 975.00 feet, an arc length of 225.87 feet and a chord bearing of North 32 degrees 31 minutes 21 seconds West 225.36 feet to a point; thence along same, North 25 degrees 53 minutes 10 seconds West 42.43 feet to a point; thence along same on a line curving to the right having a radius of 40.00 feet, an arc length of 62.83 feet and a chord bearing of North 19 degrees 06 minutes 50 seconds East 56.57 feet to a point on the Southern right of way line of Hawthorn Court; thence along said right-of--way line of Hawthorn Court (50' ROW), North 64 degrees 06 minutes 50 seconds East 157.00 feet to an iron pin set, the point and place of BEGINNING. 1 BEING Lot No. 52 on the Final Subdivision Plan for Phase Number 2, Nicholas Manor and containing 1.378 net acres. UNDER AND SUBJECT to a drainage easement as set forth on said Plan. BEING a portion of the premises which Catharine E. Hock, widow, by her Deed dated October 1, 1986, and recorded in Cumberland County, Pennsylvania Deed Book F , Volume 32, Page 223, granted and conveyed unto Raymond E. Diehl and Donald E. Diehl. Now, at the time of and immediately before the execution of the construction contract aforesaid, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same, in consideration of the Owners making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
