'THIS AGREEMENT, made the 15th day of April , 2008, by and between

hereinafter referred to as Owner,
Whereby the former undertook and agreed to erect and co~astrud a single family dwelling on that certain lot
of ground situate in Lot 3, Plan for Jeffrey J. Schookxaft, South Middleton Township, Cumbcrlaad County,
known as 45 Old Town Road, Gardners, PA
Being further identified as Tax Parcel No. 40-15-0201-042
NOW 'TIiERF.FORE, THIS AGREEMENx' WTTNESSETH: That the said Contractor, for and in
consideration of the sum of TWO HUNDRED FIFTY THOUSAND SIX HUNDRED THItEE'AND
00/ I00 DOLLARS (5250,603.00) m him in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned is the ageemeat aforesaid, for themselves and their
subcontractors, and all parties acing through or under than, covenant and agree that no mechanic's liens or
claims shaII be filed or maintained by them or nay of them against the said buildings sad the lot of ground
appurtenant thereto for or oa account of any work done or materials fuzaished by them or nay of them under
said contract or otherwise, for, towards, m. or about the erection sad coastiucxion of the said buildings on the
lot about-descnlxd, and the said Contra,etor, for themselves, their subcontractors and others under them,
hereby expressly waive sad relinquish the right to have, fdc, sad maintain any mechanic's liens or claims
against the said buildings or any of hem, sad agree that this instrument, waiving the right of lien, shall be an
indepeadentcoveaant.
