CUSTODY COMPLAINT
AND NOW comes the above-named Plaintiff, DAVID DRAKE, by and through his
attorney, LESLEY J. BEAM, ESQ., and makes the following Complaint in Custody:
1. The Plaintiff is DAVID DRAKE, an adult individual who currently resides at 5865
Wertzville Road, Enola, Cumberland County, Pennsylvania 17025 (hereinafter "Plaintiff'
or "Father")
2. The Defendant is BOBBIE JO OTTEY, an adult individual who currently resides
at 5865 Wertzville Road, Enola, Cumberland County, Pennsylvania 17025 (hereinafter
"Defendant" or "Mother"). It is anticipated that Defendant will be moving from said
residence in the immediate future.
3. Plaintiff seeks shared physical and shared legal custody of the following
unemancipated children: Alicia Drake, born May 29, 1992; and Jared Drake, born June
23, 1998 (hereinafter the "children".)

4. The children were born out of wedlock.
5. The children currently reside with both parties at 5865 Wertzville Road, Enola,
Cumberland County, Pennsylvania 17025. It is anticipated that Mother will be relocating
from Father's residence in the immediate future.
6. During the past five years, the children have resided with the following persons
and at the following addresses:

7. The mother of the children is Bobbie Jo Ottey, residing at 5865 Wertzville Road,
Enola, Cumberland County, Pennsylvania 17025. She is single.
8. The father of the children is David Drake, residing at 5865 Wertzville Road,
Enola, Cumberland County, Pennsylvania 17025. He is single.
9. The relationship of Plaintiff to the children is that of Father. Father currently lives
with Mother and the children, although it is anticipated that Mother will be relocating
from Father's residence in the immediate future.
10. The relationship of Defendant to the children is that of Mother. Mother currently
resides with Father and the children, although it is anticipated that Mother will be
relocating from Father's residence in the immediate future.
11. Father has not participated as a party in previous litigation concerning the
custody of the children.

12. Father does not know of a person not a party to the proceeding who has physical
custody of the children or claims to have custody or visitation rights with respect to the
children.
13. Father is requesting shared legal and shared physical custody of the children.
14. The best interest and permanent welfare of the children will be served by the
granting relief requested because:
(a) Father has played an instrumental role in the raising of the children since
their respective births. As such, the children will benefit from continued constant
contact with Father;
(b) Father raised the eldest child by himself for a period of two years prior to
the birth of the parties' youngest child. As such, Father has created a significant
filial bond that should be maintained;
(c) Father is able to provide a stable home and emotional environment for the
children; and
(c) Father has the facilities to provide for the care, comfort and control of the
children, as well as the intention and desire to do so.
15. Each parent whose parental rights to the children have not been terminated and
the persons who have physical custody of the children have been named as parties to
this action.

WHEREFORE, Plaintiff requests that this Honorable Court award Plaintiff shared
physical and shared legal custody of the children.

AND NOW, Wednesday, April 30, 2008 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Tuesday, May 27, 2008 at 10:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearinp,.

IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL

1. The pertinent information concerning the Children who are the subject of
this litigation is as follows:

continued for 10 weeks giving Mother time to relocate.
