Petition for Appointment of Successor Custodian
TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of Daniel Klain, Executor of the Estate of Phyllis Margaret Klain, by
and through his Atlomey, Louis R. Martin, Esquire, does hereby set forth as follows:
1 . The Petitioner is Daniel Klain, the Executor of the Estate of Phyllis
Margaret Klain, late of Lower Allen Township, Cumberland County, Pennsylvania, who
was appointed Executor by the Register of Wills of Cumberland' County, Pennsylvania on
May 16, 2007. The said Phyllis Margaret Klain died May 8, 2007 and her Will dated
June 5, 2000 was probated as No. 21-07-0482.
2. At the time of her death, the decedent, Phyllis Margaret Klain was the
custodian ofa Uniform Gift to Minors Act Account for the benefit of her granddaughter,
Abigail L. Peace. Said account was held by American Funds as Account No.
00075803869. She also was the custodian of the Uniform Gift to Minors Act Account for
the bendit of her granddaughter, Zoe Anna Peace. Said account was held by American
Funds as Account No. 00075803845.
3. In the Will of Phyllis Margaret Klain dated June 5, 2000, she did not
nominate or appoint a successor custodian of the above mentioned two accounts.
4. Both Abigail L. Peace and Zoc Anna Peace are still minors and they are
the children of Matthew N. Klain, M.D. who is a resident of Conemaugh Township,
Indiana County, Pennsylvania.
5. Your Petitioner wishes to have Matthew N. Klain, M.D., the father of
Abigail L. Peace and Zoe Anna Peace appointed as the successor custodian of the above
. .
mentioned two accounts for the benefit of his children, Abigail L. Peace and Zoe Anna
Peace.
WHEREFORE, Petitioner herein prays that your Honorable Court issue an Order
directed to American Funds that Matthew N. Klain be appointed as the successor
custodian of said accounts.
