STIPULATION AGAINST LIENS
THIS AGREEMENT made this .day of r~~ ~ 2008, by and between
D. CULLY, INC., D/B/A C 8~ C CONSTRUCTION, A Pennsylvania Corporation,
hereinafter referred to as Contractor,
AND
DAVID J. JENSEN AND KRISTINA N. JENSEN, husband and wife hereinafter
referred to as Owner, whereby the contractor undertook and agreed to erected
and construct a dwelling on the certain lot of ground situate in North Middleton
Township, Cumberland County, Commonwealth of Pennsylvania, known as Lot
G Cross Creek Estates, Carlisle, ,Cumberland County, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by
Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for itself, himself or
themselves and its, his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot
of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or themselves, its, his or their
subcontractors and others under them, hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the
said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

personally appeared Sean Cully who acknowledged himself to be the Secretary
of D. Dully, Inc. d/b/a C & C Construction and that he as such Secretary being
authorized to do so, executed the foregoing instrument for the purposes therein
contained by signing the name of the said Corporation by himself as such
Secretary.

All that certain tract of land situated in North Middleton Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the western right-of--way line of Conifer Ridge Drive, said point
being the northeastern corner of Lot `H'; thence, along Lot `H' N 69° 58'41" W a distance
of 621.38' to a point; thence, along lands now or formerly of Robert C. Stine Jr. N 49°
04'27" E a distance of 207.22' to a point; thence, along Lot `F' S 60° 43'48" E a distance of
477.34' to a point; thence, along the western right-of--way of Conifer Ridge Drive by a curve
to the left having a radius of 53.00', an arc length of 49.17' and a chord bearing of S 20°
55' 17" E a distance of 47.43' to a point; thence, by same by a curve to the right having a
radius of 11.00', an arc length of 10.71' and a chord bearing S 19° 36'57" E a distance of
10.29' to a point; thence, by same S 08° 16'11" W a distance of 47.01' to a point, thence, by
same by a curve to the right having a radius of 175.00', an arc length of 14.86' and a chord
bearing of S 10°42'06" W a distance of 14.85' to a point, the place of BEGINNING.
