COMPLAINT
Plaintiff State Farm Fire and Casualty Co. is an insurance company
licensed and authorized to conduct business in the Commonwealth of
Pennsylvania and having as one of its principal places of business the
above captioned address.
2. Donald O'Rynard is an adult individual who resided at 533 N. West Street,
Carlisle, PA 17013 on June 16, 2006, and at all time relevant hereto.
3. Jeanette Supinski is an adult individual who resided at 535 N. West Street,
Carlisle, PA 17013 on June 16, 2006, and at all times relevant hereto.
4. Defendant Kyle Megahan is an adult individual residing at 701 Sherwood
Drive, Carlisle, PA 17013.
5. On June 16, 2006, Plaintiff State Farm Fire and Casualty Co. insured
Donald O'Rynard with a homeowner's policy, number 38-GN-4798-3,
said policy carrying with same, structure and contents coverages of the
property located at 533 N. West Street, Carlisle, PA 17013.
6. On June 16, 2006, Plaintiff State Farm Fire and Casualty Co. insured
Jeanette Supinski with a homeowner's policy, number 38-EJ-8763-2, said
policy carrying with same, structure and contents coverages of the property
located at 535 N. West Street, Carlisle, PA 17013.
7. On or about July 16, 2006, Defendant Kyle Megahan was an
occupant and responsible for said premises, that being known as 535 N.
West Street, Carlisle, PA 17013.
8. On or about July 16, 2006, as a result of the negligent and or carelessness
of the defendant, a fire erupted at 535 N. West Street, Carlisle, PA and
spread to the neighboring property 533 N. West Street Carlisle, PA
resulting in extensive water and smoke damages to both properties,
including but not limited to structural and personal property.
9. The negligence of the Defendant consisted of.
a) Failing to use due care;
b) Improper use of a lighter;
c) Failing to warn the Plaintiff of danger;
d) failing to take proper safety precautions;
e) falling to promptly notify fire officials so as to avoid the spread of the
fire;
f) failing to promptly extinguish the fire;
g) other such negligence that may be developed through continuing
discovery and trial of this matter.
10. The aforesaid fire and resultant damages resulted solely from the negligent
acts and/or omissions on part of Defendant named herein and were due in
no manner whatsoever to any act and/or failure to act on part of Plaintiffs.
11. As a result of the aforesaid fire, Plaintiff State Farm Fire and Casualty Co.
settled the claim of Donald O'Rynard in the amount of $129, 252.07 (said
figure includes Donald O'Rynard's first party deductible) representing fair
and reasonable reimbursement for the damages sustained.
12. As a result of the aforesaid fire, Plaintiff State Farm Fire and Casualty Co.
settled the claim of Jeanette Supinski in the amount of $212,791.76 (said
figure includes Jeanette Supinski first party deductible) representing fair
and reasonable reimbursement for the damages sustained.
13. Pursuant to the aforesaid policy of insurance, Plaintiff State Farm Fire and
Casualty Co. is subrogated to Jeanette Supinski for this loss for this loss.
14. Pursuant to the aforesaid policy of insurance, Plaintiff State Farm Fire and
Casualty Co. is subrogated to Donald O'Rynard for this loss.
WHEREFORE, Plaintiffs demand judgment against the Defendant in the
amount of $342,043.83 plus costs, interest and such other relief this
Court finds equitable and just.
