Zazcone, husband and wife, of Pennsylvania, is about to execute contemporaneously herewith, a contract with Classic Communities Corporation, a Pennsylvania Corporation of Dauphin County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN lot, pazcel or tract of land located in East Pennsboro Township, Cumberland County, Pennsylvania in accordance with a Final Subdivision Plan of Penn Valley Phase VI, as recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 91, Page 74, more particulazly bounded and described as follows, to wit: BEGINNING at a point on the southern right-of--way line of Redwood Drive (a fifty footright-of--way) said also being the Northwest corner of Lot No. 22; thence along the dividing line between Lot No. 223 and Lot No. 222 South 19 degrees 11 minutes 39 seconds East, 112.28 feet to a point; thence along lands now or formerly of James Decinti and lands now or formerly of David J., Jr. and Lydia A. Johnson South 76 degrees 32 minutes 43 seconds West, 120.84 feet to an iron pin; thence along lands now or formerly of Jeffrey T. Zerby North 33 degrees 02 minutes 33 seconds West, 117.70 feet to a point; thence along the dividing line between Lot No. 223 and Lot No. 224 North 57 degrees 12 minutes O1 second East, 102.70 feet to a point on the Western right-of--way line of Redwood Drive; thence along the Western right-of--way line of Redwood Drive by a curve to the left having a radius of 50.00 feet with an arc length of 66.67 feet and a chord of South 70 degrees 59 minutes 49 seconds East, 61.84 feet to a point on the Southern right-of--way line of Redwood Drive, the Place of BEGINNING. CONTAINING 17,076.00 squaze feet or 0.3920 acres. BEING Lot No. 223 as shown on the Final Subdivision Plan of Penn Valley, Phase VI. Recorded in Plan Book 91, Page 74. ,. -,. UNDER AND SUBJECT, nevertheless, to easements, restrictions, reservations, conditions, and rights of way of record or visible upon inspection of premises. BEING THE SAME premises which DJH Penn Valley Associates Limited Partnership, a Pennsylvania Limited Partnership, by its deed dated the 12`~ day of March, 2008 and recorded March 20, 2008 in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Instrument No.: 200808444, granted and conveyed unto Michael W. Zazcone and Kelly L. Zazcone, husband and wife, MORTGAGORS herein. . Zazcone and Kelly L. Zazcone, husband and wife to the said Classic Communities Corporation, a Pennsylvania Corporation to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Classic Communities Corporation, a Pennsylvania Corporation and the further consideration of One Dollar, to Classic Communities Corporation, a Pennsylvania Corporation paid by Michael W. Zazcone and Kelly L. Zazcone, husband and wife it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
