Dorsheimer ) In the Court of Common Please County of Owner ) Cumberland, Pennsylvania, versus ) Number OS -aq~ /rj/~ Term. 20 Yingst Homes, Inc. ) Contractor WHEREAS, Yingst Homes, Inc. of Harrisburg, Pennsylvania is about to execute contemporaneously herewith, a contract, with Diane S. Dorsheimer of Camp Hill, Pennsylvania, for the erection of a residential building upon a lot of land situate ALL THAT CERTAIN lot or tract of land and premises, situate in the Township of Lower Allen in the County of Cumberland and Commonwealth of Pennsylvania, more specifically described as follows: BEGINNING at an Iron Pin on the westerly Dedicated Right-of- way of Creek Road (SR-2033) at the southeast corner of Lot No. 2 of the above mentioned Subdivision Plan; thence, along the westerly Dedicated Right-of--way line of said Creek Road by a curve to the right having a Radius of 5.699.65 feet, an Arc Length of 160.06 feet, Chord of said curve bearing South 23 degrees 30 minutes 37 seconds West, a distance of 160.05 feet to a point, and, South 24 degrees 18 minutes 53 seconds West, a distance of 3.19 feet to a point in Cedar Run; thence, in and through Cedar Run North 54 degrees 07 minutes West, a distance of 78.62 feet, and, North 77 degrees 10 minutes West, a distance of 58.52 feet to a point; thence, along the easterly line of said Lot No. 1 of the above mentioned Subdivision Plan, North OS degrees 13 minutes 20 seconds East, a distance of 160.20 feet to an Iron Pin at the southwest corner of Lot No. 2 of the above mentioned Subdivision Plan; thence, along the southerly line of said Lot No. 2 South 67 degrees 40 minutes East, a distance of 185.09 feet to an Iron Pin, the place of BEGINNING. CONTAINING a Net Area of 24,418 Sq. Ft. or 0.560 Acre. SUBJECT however to a 20 foot wide Sanitary Sewer Easement as appears on the above mentioned Subdivision Plan lying west of and adjacent to the westerly Dedicated Right-of--way Line of Creek Road (SR- 2033) and a 30 foot wide Sanitary Sewer Easement traversing west to east along the existing sanitary sewer adjacent to and north of Cedar Run. ~~ !~ BEING Lot No. 3 of a Final Subdivision for Diane S. Dorsheimer, situate in Lower Allen Township, Cumberland County, PA, as recorded to Instrument #200746097. Now, r~~~ a 3 , 200,' at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Yingst Homes, Inc. to the said Diane S. Dorsheimer to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Diane S. Dorsheimer and the further consideration of one Dollar, to Yingst Homes, Inc. paid by Diane S. Dorsheimer it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
