Dear Mrs. Strasbaugh:
I have your Notice of Failure to File Certification concerning the above captioned
estate.
First, if you refer to my Petition which was filed on April 2, 2008, you will note Exhibit
A attached is a letter signed by the personal representative discharging me as attorney for
the estate and for the personal representative.
Additionally, on May 6,2008, I mailed a Motion and an Affidavit of Service to your
office and the proposed Order of Court attached to the Motion permits me to withdraw as
counsel for the estate as well as Mr. Marietta. When that Order is signed by the Court and
returned to me, I will in fact file my Praecipe withdrawing as counsel for both.
In Mr. Marietta's letter of January 28, 2008 he states that "I have retained a new
attorney to resolve any outstanding issues" although I have recently checked the records
and find that no other attorney has entered their appearance.
It would seem to me that you should deal directly with Mr. Marietta and I would
suggest that you send any correspondences to him to Bates College, 4 Andrews Road,
Lewiston, Maine 04240.
