IN THE COURT OF COMMON PLEAS OF THE 9T" JUDICIAL DISTRICT CUMBERLAND COUNTY -PENNSYLVANIA STOLTZFUS CONSTRUCTION, LLC., CIVIL ACTION - LAW Claimant No. 2008 - ~ Dl !~ r~ ~ v. MICHAEL ). CASSIDY, MECHANICS' LIEN JULIE A. CASSIDY, t/d/b/a G & C ASSOCIATES, Owner MECHANICS' LIEN CLAIM Claimant, Stoltzfus Construction, LLC., by and through Forest N. Myers, Esquire, filed this claim against the improvements and property at Lot No. 13 on Subdivision Plan of G & C Associates, said plan being recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Plan Book 200740665, being further located on Commerce Drive, for the payment of a debt due to a claimant as a contractor for labor and materials furnished by Claimant in the erection and construction of the improvements. In support of the claim, the Claimant makes the following statement: 1. The Claimant is Stoltzfus Construction, LLC., with its principal place of business at 11257 Weaver Road, Orrstown, Pennsylvania 17244. 2. The Owners of the property are Michael J. Cassidy and Julie A. Cassidy, trading and doing business as G & C Associates, with an address of 9974 Molly Pitcher Highway, Shippensburg, Pennsylvania 17257. 3. The work was completed on January 18, 2008. 4. The labor and materials for which the debt is due were furnished for the agreed sum of $117,700.00, pursuant to a written contract with the owner dated October 29, 2007, a copy of which is attached as Exhibit "A." 5. The amount due is $15,338.06, including interest to May 18, 2008. Page 1 of 3 6. The labor and materials for which the debt is due consisted of concrete blocks, poured concrete, steel roofing, doors, glassboard, insulation, excavation, and labor necessary to complete construction of the said building. 7. The improvements and the property which are the subject to this claim are car wash facility with appurtenant land at Commerce Drive, Shippensburg Township, Cumberland County, Pennsylvania, and described as follows: ALL that certain tract of land situate in the Township of Shippensburg, Cumberland County, Pennsylvania, bounded and described in accordance with the Shippensburg Car Wash Preliminary/Final Subdivision Plan prepared by Fischbach Morgan & Associates, LLC, dated August 20, 2007, revised through September 26, 2007 and recorded in Cumberland County Instrument No. 200740665 as follows: BEGINNING at a point on the dedicated right of way line of Commerce Drive between Lot Nos. 13 and 9 on the above Plan, North 44° 06' 46" East, 232.07 feet to a point; thence along lands now or formerly of G & C Associates, South 43° 12' 00" East, 259.70 feet along land now or formerly of ACL Realty Corporation, South 47° 1$' 12" West, 294.59 feet to a proposed marker; thence along Lot No. 5 on the above Plan, North 42° 49' 35" West, 204.69 feet to a point; thence along the dedicated right of way of Commerce Drive on a curve to the left having with a radius of 50.00 feet, an arc length of 87.43 feet, and a chord bearing of North 10° 25' 18" East with a chord length of 76.71 feet to a point, the point and place of BEGINNING. BEING Lot No. 13 on the Shippensburg Car Wash Preliminary/Final Subdivision Plan containing 1.67 acres. UNDER AND SUBJECT TO a 40' wide drainage easement along the northeastern side of Lot 13.
