THIS AGREEMENT made the 23rd day of February, 2004, by and between RIDGEVIEW
CUSTOM HOMES, LLC, a Pennsylvania limited liability company, hereinafter referred to as
Contractor, HERBERT G. WEAVER, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a custom built home on that certain lot of ground situate
at Lot 98, Indian Hills-Section III, South Middleton Township, Cumberland County, Pennsylvania,
known as more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WlTNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

On this, the 223rd day of February, 2004, before me the undersigned officer, personally
appeared Herbert G. Weaver, married man, known to me to be the person whose name is subscribed
to the within instrument, and who acknowledge himself to be the Owner of Lot 98, Indian Hills-
Section III, Boiling Springs, Pennsylvania and that he as such owner, executed the foregoing
statement for the purposes therein contained by signing his name.

purposes therein contained, and with the intent to bind Ridgeview Custom Homes, LLC.

BEGINNING at a point on the Southern right of way line of Shirley Lane (a 60 feet wide right of
way) at the point of the dividing line between Lot No. 98 and Lot No. 99 of the aforementioned
plan; thence along said Shirley Lane (a 60 feet wide right of way), North 86 degrees 41 minutes
44 seconds East a distance of 102.42 feet to a point at the comer of LOt No. 97 and Lot No. 98 of
the aforementioned Plan; thence along the dividing line between Lot No. 97 and Lot No. 98,
South 03 degrees 18 minutes 16 seconds East a distance of 149.29 feet to a point at the cute-
section of LOt No. 85, Lot No. 97 and Lot No. 98 of the aforementioned Plan; thence along the
dividing line between Lot No. 85, Lot No. 97 and Lot No. 89, South 89 degrees 50 minutes 23
seconds West a distance of 102.56 feet to a point at the intersection of LOt No. 84, Lot No. 98
and Lot No. 99 of the aforementioned Plan; thence along the dividing line between Lot No. 98

point on the Southern right of way line of Shirley Lane (a 60 feet wide right of way), the point
and place of BEGINNING.
CONTAINING 15,000.19 square feet.
LOT No. 98 is subject to all associated rights and provisions of a 30 feet wide Storm Drainage
Easement
LOT No. 98 is subject to all applicable notations and conditions set forth by final subdivision
plan approval of Indian Hills, Section No. III.
