WAIVER OF RIGHT TO FILE LIEN -SEPARATE STIPULATION OF
MECHANICS' LIENS /
WHEREAS, Sunnyrock Building & Design, LLC, party of the first part, hereinafter
called Contractor, has entered into a Construction Agreement with Shane C. Polson and Annette
Polson of Mechanicsburg, Cumberland County, Pennsylvania, parties of the second part,
hereinafter called Owners, to provide materials and perform labor necessary for the construction
of asingle-family residential structure with accessories thereto upon the premises described as
follows:
BEING the premises known as Lot No. 16, Willow Lake, Willow Lake
Drive, Plan Book 86, Page 13b, Tax Parcel Number 38-04-0369-033, Silver Spring
Township, Cumberland County, Pennsylvania.
NOW THEREFORE, it is stipulated and agreed by and between the said parties, as part
of the Construction Agreement for the consideration therein set forth, that neither the
undersigned Contractor or any sub-contractor or materialman, nor any other person furnishing
labor or materials to said Contractor under the Construction Agreement shall file a lien,
commonly known as a mechanics' lien, for work done or material furnished to said premises or
any part thereof. This limitation as described above shall also apply to any re-subdivided part or
portion of Lot 16 and any additions to Lot 16 by re-subdivision and conveyance by Deed from
adjoining Lot 15, if and whenever said re-subdivision may be accomplished.
This Stipulation is made and intended to be filed with the Prothonotary of Cumberland
County in accordance with the requirements of the laws of the Commonwealth of Pennsylvania.
IN WITNESS WHEREOF, the parties hereto have caused this document to be executed
