Plaintiff, CACV OF COLORADO, LLC, by its attorney Harrison Ross Byck, by way of complaint
against defendant(s) GERI E BUSKEY, avers the following:
Plaintiff, CACV OF COLORADO, LLC, is a Colorado limited liability company doing
business at 4340 S. Monaco Street- 2nd Floor; Denver, Colorado 80237.
2. Defendant, GERI E BUSKEY, is an individuals residing at 209 MARKET STREET;
NEW CUMBERLAND, PA 17070.
3. Defendant, GERI E BUSKEY, is indebted to PROVIDIAN BANK on an account stated
by and between them in the amount of $6,788.07 which balance was due and unpaid
as of January 31, 2005 for credit card account number 4479 4816 0042 2097. <Exhibit
A>
4. On or about March 1, 2005, PROVIDIAN BANK sold the debt for good and valuable
consideration to plaintiff, CACV OF COLORADO, LLC. <Exhibit B>
5. Defendant (s) GERI E BUSKEY last tendered a payment on this account on or about
September 30, 2006 for $240.00.
6. A copy of the credit card agreement is attached hereto. <Exhibit C>
7. Plaintiff is entitled to charge-off account finance charges of $ -0-. <Exhibit A>
8. Plaintiff is entitled to pre-litigation charge-off interest of $5.58 per day from the
default date (29.99 annual percentage rate x $6,788.07/ 365 days) or $5.58 x 563 days
_ $3,140.06, which is accrued interest through the date of filing, plus an award of late
fees of $-0-, plus court costs $178.50 and reasonable attorneys fees of $600.00.

9. The defendant, being indebted to the plaintiff in the sum or $10,706.63 upon the
account stated by and between them did promise to pay said sums upon demand.
Demand has been made for payment of $10,706.63 and the defendant has failed to
remit payment.
WHEREFORE, plaintiff demands judgment against the defendant for $10,706.63 together with
other interest, costs of suit, and an award of reasonable attorney's fees.

AND NOW COMES Defendant, by and through her counsel, and files these Preliminary
Objections to Plaintiff's Amended Complaint, pursuant to Pa.R.C.P. 1019, Pa.R.C.P. 1024, and
the following:
1. INTRODUCTION
1. Plaintiff commenced the above-captioned action in this Honorable Court by filing a civil
Complaint on or about May 23, 2008.
2. Plaintiff seeks damages pursuant to a credit card agreement with Providian Bank credit
card and Plaintiff demands the amount of $10,706.63, plus costs, interest and attorney
fees. Paragraph 9 of the Complaint.
3. Plaintiff has no agreement with the Defendant, Plaintiff has no ascertainable loss of
money or property and gave no money or property to the Defendant.
4. Defendant made payments on a credit card, by way of electronic withdrawal, through a
collection agency and as such, disputes the amount of the alleged debt.
5. Plaintiff did not afford the Defendant the right to dispute the alleged debt in accordance
with state and federal laws.
6. Plaintiff asserts this Action based on a purported contract between the Defendant and
Providian Bank, however, the Plaintiff failed to provide a contract, signed by the
Defendant, that would demonstrate the terms and conditions that apply to this Action.
IL LEGAL ARGUMENT
7. The alleged consumer debt in question involves a credit card agreement between the
Defendant and a third party, Providian Bank. (Hereinafter Agreement)
8. There is no copy of the signed Agreement attached to Plaintiff's complaint and no
explanation of the terms and conditions that would apply to this Defendant.
9. Pennsylvania law requires that Plaintiff have a valid assignment of the alleged debt prior
to having authority to collect same. 18 Pa.C.S. §731 l (a)(1) and (2).
10. Pennsylvania law requires Plaintiff to have proper documentation in order to collect
interest, fees and/or costs. 18 Pa.C.S. §7311(b)(1).
11. Plaintiff failed to attach any written documentation showing how it calculated the alleged
debt.
12. Plaintiff failed to afford Defendant the opportunity to dispute the alleged debt, in
accordance with the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq.
13. Plaintiff failed to afford Defendant any rights in the collection of the alleged debt,
pursuant to 15 U.S.C. § 1692 et seq., as well as Pennsylvania Fair Credit Extension
Uniformity Act, 73 P.S. §2270 et seq.
14. Plaintiff alleged no facts to demonstrate that it has the legal authority to collect the
alleged debt.
15. The Plaintiff's Complaint should be dismissed because Plaintiff's Complaint is based on
various written documents, not attached to the Complaint.

16. The Plaintiff s Complaint lacks subject matter jurisdiction over the defendant as the
defendant does not owe any monies to the Plaintiff and Plaintiff has yet to prove that it
stands in the position as the original creditor.
17. Plaintiffs Complaint fails to conform to Pa.R.C.P. 1019 and 1024.
18. Plaintiff failed to provide sufficient information to verify its Complaint.
19. Plaintiff is time-barred from bringing this action and to date, has not shown that the
Action was filed within the 4 year statute of limitations.
20. Defendant requests that Plaintiff provide proof as to how the alleged debt was calculated
as well as the date of the last payment.
21. Plaintiffs documents are inconsistent with the allegations made in the Complaint.
22. The Rules of Professional Conduct require an attorney to conduct his/herself with candor
to the Court and unrepresented persons. Rule 2.1, 3.3 and 4.3.
WHEREFORE, the Defendant respectfully requests that this Honorable Court, dismiss
Plaintiffs complaint with prejudice and award Defendant attorney fees and costs as a sanction to
the Plaintiff and its attorney for failing to bring this Actio in cordance with Pennsylvania law.

An Answer to Preliminary Objections is required only to Preliminary Objections
raising issues under Pa.R.C.P. 1028(a)(1), (5), (6), (7) and (8) and only provided a Notice to
Plead is attached to the Preliminary Objections. An Answer does not need to be filed to
Objections raising issues under Rules 1028(a)(2), (3) and (4) since these preliminary objections
raise issues which may be determined from facts of record so that no further evidence or response
is required.. See Note to Pa.R.C.P. 1028(c)(2) and Philadelphia Local Rule 1028(c)(5).
2. Pa.R.C.P. 1029(d) states that averments in pleadings to which no responsive
pleading is required shall be deemed to be denied.
3. To the extent Defendant's preliminary objections raise issues under Pa.R.C.P.
1028(a)(1), (5), (6), (7) and (8) but noting that no Notice to Plead is attached to the Preliminary
Objections, Plaintiff is not filing a formal Answer and denies all averments in Defendant's
pleading pursuant to Pa.R.C.P. 1028(c)(2) and Pa.R.C.P. 1029(d).
4. To the extent Defendant's preliminary objections fall under subdivisions (a)(2),
(3) and (4); may be determined from facts of record; and require no response from Plaintiff,
Plaintiff is not filing a formal Answer and denies all averments in Defendant's pleading pursuant
to Pa.R.C.P. 1028(c)(2) and Pa.R.C.P. 1029(d).
5. Plaintiff further denies any and all of defendant's allegations which are the
subject of federal law and affirmative defenses which should be properly addressed as
counterclaims or new matters.
6. Plaintiffs Complaint and Exhibits establish the adequate, viable and sustainable
cause of action to move forward. All of Defendant's averments and requests can be resolved
through the discovery and trial process.
7. Without waiving the foregoing, the issuance of a credit card constitutes the offer
of a contract. See, e.g., Bank One, Columbus, N.A. v. Palmer, 63 Ohio App. 3d 491, 492, 579
N.E.2d 284, 285 (Ohio Ct. App. 1989). Use of a credit card constitutes acceptance of the terms of
the cardmember agreement. See, e.g.., Grasso v. First USA Bank, 713 A.2d 304 (Del. 1998); Read
v. Gulf Oil Corporation, 114 Ga. App. 21, 150 S.E.2d 319, 320 (1966); Petroleum Co. v.
McMillan, 168 S.W. 2d 881 (Tex. Civ. App. 1943). Even in the absence of such an agreement
the issuance of the credit card constitutes an offer of credit, and the use of the credit card
constitutes the acceptance of the offer of credit. Feder v. Fortunoff, 474 N.Y.S. 2d 937 (N.Y.
1984), citing Empire Nat'l Bank v. Monahan, 82 Misc. 2d 808, 370 N.Y.S.2d 840 (N.Y. County
Ct. 1975).
8. By using and/or authorizing the use of the credit card Defendant accepted the
contract with the Issuer and became bound to pay for all charges incurred with the credit card.
Defendant also became subject to all of the terms and conditions of the Issuer's cardholder
agreement.
9. Plaintiff directs the Court to Exhibit C of the Complaint, which contains the
Cardholder Agreement, Affidavit of Sale and Verification of the Complaint, where the provisions
of the cardholder agreement allow for sale of the account along with all rights and obligations
along with the provisions of the cardholder agreement allow for requiring the cardholder to pay
for costs incurred in any collection proceeding, including reasonable attorney's fees.
WHEREFORE, PREMISES CONSIDERED, Plaintiff prays that the Court deny and
dismiss Defendant's Preliminary Objections, together with all such other and further relief, at law
or in equity, as to which Plaintiff may be justly entitled.
