CIVIL ACTION - LAW COMMONWEALTH OF PENNSYLVANIA, DEPARTMENT OF TRANSPORTATION, BUREAU OF DRIVER LICENSING, 3027 Respondent NO. 08-20" CIVIL TERM RESPONSE TO RULE The Commonwealth of Pennsylvania, Department of Transportation (the "Department") through its undersigned attorney responds to the Court's Rule issued in the above-captioned matter, as follows: 1. Mr. Fry has an extensive record of violations of Pennsylvania's Vehicle Code. 2. Mr. Fry's operating privilege is currently revoked until June 16, 2028. 3. On July 10, 2008, the Department received from Steven Michael Fry a copy of his filing, entitled "Petition To Reinstate Appeal Rights Under The Pennsylvania Vehicle Code" (the "Petition"). 4. The Petition does not identify which of his many suspensions Mr. Fry intends to appeal; nevertheless, an appeal of a license suspension must be filed within thirty days of the mailing date of the Department's Notice of Suspension. See 75 Pa. C.S. § 1550 and 42 Pa. C.S. §§ 5571, 5572. See Hudson v. Department of Transportation, Bureau of Driver Licensing, 830 A.2d 594 (Pa. Cmwlth. 2003); Bye v. Department of Transportation, Bureau of Driver Licensing, 607 A.2d 325 (Pa. Cmwlth. 1992). 5. Failure to file the appeal within the thirty-day appeal period deprives the court of jurisdiction to entertain the merits of the case. See 42 Pa.C.S. § 5505; Hudson v. Department of Transportation, Bureau of Driver Licensing, 830 A.2d 594 (Pa. Cmwlth. ./ 2003); Kovalesky v. Department of Transportation, Bureau of Driver Licensing, 850 A.2d 26 (Pa. Cmwlth. 2004); Department of Transportation, Bureau of Motor Vehicles v. Shemer, 629 A.2d 1063 (Pa. Cmwlth. 1993), I, 536 Pa. 635, 637 A.2d 294 (1993), (appeal quashed when filed one day after the expiration of the 30 day appeal period). 6. An appeal taken after the right to take an appeal has expired is null and void and is subject to being quashed and dismissed for want of jurisdiction. See Maxion v. Department of Transportation, Bureau of Driver Licensing, 728 A.2d 442 (Pa. Cmwlth. 1999); McKeown v. Department of Transportation, 601 A.2d 486 (Pa. Cmwlth. 1991); See also Smith v. Department of Transportation, Bureau of Driver Licensing, 749 A.2d 1065 (Pa. Cmwlth. 2000), Department of Transportation, Bureau of Driver Licensing v. Gross, 540 A.2d 343 (Pa. Cmwlth. 1988). 7. An appeal nunc pro tunc may be allowed when the party requests to appeal nunc pro tunc and there is proof of fraud or breakdown of administrative or judicial system which caused the late filing. See Kovalesky v. Department of Transportation, Bureau of Driver Licensing, 850 A.2d 26 (Pa. Cmwlth. 2004). 8. An appeal nunc pro tunc may also be allowed when the party requests to appeal nunc pro tunc and there were extraordinary circumstances by which the petitioner was precluded from filing a timely appeal due to non-negligent, unforeseeable, and unavoidable consequences. See Schofield v. Department of Transportation, Bureau of Driver Licensing, 828 A.2d 510 (Pa. Cmwlth. 2003); Puckett v. Department of Transportation, Bureau of Driver Licensing, 804 A.2d 140 (Pa. Cmwlth. 2002). 9. On December 20, 2006, the Department imposed 2 consecutive, 2-year revocations of Mr. Fry's operating privilege as a consequence of his November 1, 2006 convictions for violating Sections 3802(c) (DUI, BAC over 0.16% - highest rate) and 1543(b)(1.1) (Driving while operating privilege is suspended or revoked DUI related). 10. The last day for filing a timely appeal after the mailing date of the Department's Notice of Suspension dated December 27, 2006, was January 26, 2007. 11. In the Petition, Mr. Fry states that he sent letters to the Department on July 17 and October 5, 2007 and again on May 12, 2008. The earliest of these letters is almost 6 months outside the 30-day appeal window. 12. Mr. Fry filed the Petition on May 21, 2008, which was more than a year after the December 27, 2006 mailing date of the Department's most recent Notice of Suspension. 13. Any appeal of Mr. Fry's suspensions would be untimely. 14. Mr. Fry asserts none of the circumstances required to permit nunc pro tunc appeals. WHEREFORE, the Department respectfully requests that the Petition To Reinstate Appeal Rights under the Pennsylvania Vehicle Code be quashed for lack of jurisdiction.
