AND NOW, Michael P. Gardner, by and through his attorneys, Johnson, Duffie, Stewart
& Weidner, pursuant to the Pennsylvania Mechanics' Lien Law of 1963, 49 P.S. §§1101, et
seq., files and perfects this Mechanics' Lien Claim and in support thereof makes the following
statements:
1. The Plaintiff is Michael P. Gardner, whose address is 220 Regal View, Carlisle, PA
17013.
2. The Defendant is J. S. Investments, Inc., a Pennsylvania corporation, with
registered offices located at 1615 County Line Road, York Springs, PA 17372, being the owner
or reputed owner of the Property described in Paragraph 4 below.
3. The date on which Plaintiff completed the work for which claim is made was
March 15, 2008.

4. The improvements and property claimed to be subject to the lien consists of Lot
Nos. 4, 5 and 6 together with all of the land within the legal right of way of Glenwood Road (to
be dedicated) as shown on the Plan entitled "Final Subdivision Plan for Glenwood Terrace"
dated June 22, 2004, last revised August 4, 2004 and recorded in the Office of the Recorder of
Deed for Cumberland County, Pennsylvania in Plan Book 93, Page 75 (the "Property").
5. Plaintiff files this claim under an oral contract with Defendant whereby Plaintiff
agreed to furnish certain labor and materials utilized for the erection and construction of site
infrastructure improvements upon the Property. A true and correct listing setting forth the labor
and material expenses are attached hereto as Exhibit "A".
6. The amount claimed to be due is $7,897.90.
7. Glenwood Terrace is a single family residential subdivision developed by
WHEREFORE, Claimant, Michael P. Gardner, claims a Mechanics' Lien against the
property described above in the amount of $7,897.90 plus interest and court costs.

PETITION TO DISCHARGE MECHANICS' LIEN
UPON CASH DEPOSIT WITH THE PROTHONOTARY
1. Plaintiff filed a Mechanics' Lien Claim on or about May 27, 2008 as shown on
Exhibit "A" in the amount of Seven Thousand Eight Hundred Ninety Seven and
90/100 ($7,897.90) Dollars.
2. Defendant vigorously disputes that any sums are due or owing to the Plaintiff,
however, in order to discharge the lien in accordance with 49 P. S. § 1510 (see
Exhibit "B") the Defendant is prepared to place a cash deposit with the
Prothonotary of Cumberland County in the amount of $7,897.90.
3. A photocopy of the cashier's check for $7,897.90 payable to the Prothonotary of
Cumberland County is attached hereto as Exhibit "C" and is in the possession of
Defendant's counsel for its immediate provision to the Prothonotary.
4. The Mechanics' Lien Law specifically states that:
Cash deposit. Any claim filed hereunder shall, upon petition of
the owner or any party in interest, be discharged as a lien
against the property whenever a sum equal to the amount of
the claim shall have been deposited with the court in said
proceedings for application to the payment of the amount
finally determined to be due. 49 P.S. §1510 (a).
5. At the present time Defendant, who is a developer, has two real estate settlements
which are adversely affected by the present Mechanics' Lien for $7,897.90
including one going to settlement on Friday, May 30, 2008 at 1:00 PM.
6. A copy of this Petition was faxed to Plaintiff's counsel on Thursday, May 29, 2008

49 P.S. § 1510 (2007)
§ 1510. Discharge of lien on payment into court or entry of security
(a) Cash deposit. Any claim filed hereunder shall, upon petition of the owner or any party
in interest, be discharged as a lien against the property whenever a sum equal to the amount
of the claim shall have been deposited with the court in said proceedings for application to
the payment of the amount finally determined to be due.
(b) Pro-rata allocation. In any case where the claim or claims are limited in the manner
and to the extent provided in section 405, the owner may deposit with the court in separate
proceedings a sum equal to the total allowable amount of said claims determined in
accordance with said section, whereupon the court, on petition of such owner, shall order all
of said claims discharged as liens against the property, and the sum so deposited applied pro
rata to the payment thereof in the amounts finally determined to be due.
(c) Refund of excess. Any excess of funds paid into court as aforesaid, over the amount of
the claim or claims determined and paid therefrom, shall be refunded to the owner or party
depositing same upon application for the same.
(d) Security in lieu of cash. In lieu of the deposit of any such sum or sums, approved
security may be entered in such proceedings in double the amount of the required deposit, or
in such lesser amount as the court shall approve, which, however, shall in no event be less
than the full amount of such required deposit; and the entry of such security shall entitle the
owner to have such liens discharged to the same effect as though the required sums had
been deposited in court as aforesaid.
(e) Authority of court. The court, upon petition filed by any party, and after notice and
hearing, may upon cause shown:

(1) require the increase or decrease of any deposit or security;
(2) strike off security improperly filed;
(3) permit the substitution of security and enter an exoneration of security already given.

Adapted from Sections 25 (dealing with proceedings to obtain discharge of lien) and 50
(dealing with approval of security), Act of 1901, 49 P.S. 135, 242.
Subsection (a) eliminates the previous requirement of pleading a defense to the claim as a
prerequisite to the allowance of the petition to authorize payment into the court and to
claimant's discharge.
Subsections (b) and (c) are new but carry out prior practice.
Subsection (d) authorizing deposit of cash is new.
Subsection (e), while following the substance of Section 50, Act of 1901, supra, is taken from
the Rules of Civil Procedure.

PETITION FOR RELEASE OF FUNDS DEPOSITED WITH THE
PROTHONOTARY ON THE MECHANIC'S LIEN
AND NOW,comes Defendant J. S. Investments, Inc. by and through its attorney,David J.
Lanza,pursuant to the Pennsylvania Mechanic's Lien Law,files this Petition to release the money
that was deposited with the Prothonotary to discharge a mechanic's lien that had been filed on or
about May 27, 2008, in support thereof and avers as follows:
• 1. On or about May 27, 2008, Plaintiff filed a Mechanics' Lien docketed at 08-3298 MLD in
Cumberland County against Defendant.
2. The alleged improvements were done on Lots 4, 5 and 6 on Glenwood Road in Glenwood
Terrace.
3. A copy of the verified Mechanics' Lien Claim is attached hereto as Exhibit"A".
4. Said Mechanics' Lien Claim was filed on or about May 27, 2008.
5. On or about May 29,2008,Defendant filed a Petition to Discharge Mechanics' Lien Upon
Cash Deposit with the Prothonotary. A copy of the verified Petition is attached hereto as Exhibit
6. On or about May 30, 2008,this Court entered an Order stating that with a deposit of a sum
of $7,897.90 to the Prothonotary of Cumberland County by official check, the lien shall be
discharged as a lien against the property.
7. Pursuant to 49 P.S. Mechanics' Lien, §1701(b),Procedure to Obtain a Judgment,an action
to obtain a judgment upon a claim filed shall be commenced within two (2) years of the date of
the filing unless time is extended in writing by the owner.
8. Pursuant to 49 P.S. Mechanics' Lien, §1781(d), Procedure to Obtain a Judgment, a verdict
must be recovered or a judgment entered within five (5) years from the date of the filing of the
claim.
9. More than two (2)years have gone by without an action being commenced.
10. More than five(5)years have gone by without a final judgment on a verdict being rendered.
11. Plaintiff has not prosecuted the action.
12. Plaintiff is no longer entitled to recover on the mechanics' lien for his failure to prosecute
within the time limits required by the Pennsylvania Mechanics' Lien statute.
WHEREFORE,Defendant J. S. Investments,Inc.respectfully requests that this Court enter
a Rule upon Plaintiff to show cause why the $7,897.90 deposited with the Prothonotary should not
be immediately released to the Defendant.

seq., files and perfects this Mechanics' Lien Claim and in support thereof makes the following
statements:
1. The Plaintiff is Michael P. Gardner, whose address is 220 Regal View, Carlisle, PA
17013.
2. The Defendant is J. S. Investments, Inc., a Pennsylvania corporation, with
registered offices located at 1615 County Line Road, York Springs, PA 17372, being the owner
or reputed owner of the Property described in Paragraph 4 below.
3. The date on which Plaintiff completed the work for which claim is made was
March 15, 2008.

4. The improvements and property claimed to be subject to the lien consists of Lot
Nos. 4, 5 and 6 together with all of the land within the legal right of way of Glenwood Road (to
be dedicated) as shown on the Plan entitled "Final Subdivision Plan for Glenwood Terrace"

dated June 22, 2004, last revised August 4, 2004 and recorded in the Office of the Recorder of
Deed for Cumberland County, Pennsylvania in Plan Book 93, Page 75 (the"Property").
5. Plaintiff files this claim under an oral contract with Defendant whereby Plaintiff
agreed to furnish certain labor and materials utilized for the erection and construction of site
infrastructure improvements upon the Property. A true and correct listing setting forth the labor
and material expenses are attached hereto as Exhibit"A".
6. The amount claimed to be due is $7,897.90.
7. Glenwood Terrace is a single family residential subdivision developed by
WHEREFORE, Claimant, Michael P. Gardner, claims a Mechanics' Lien against the
property described above in the amount of$7,897.90 plus interest and court costs.

I. Plaintiff filed a Mechanics' Lien Claim on or about May 27, 2008 as shown on
Exhibit"A" in the amount of Seven Thousand Eight Hundred Ninety Seven and
90/100($7,897.90) Dollars.
2. Defendant vigorously disputes that any sums are due or owing to the Plaintiff,
however, in order to discharge the lien in accordance with 49 P.S. §1510 (see
Exhibit"B")the Defendant is prepared to place a cash deposit with the
Prothonotary of Cumberland County in the amount of$7,897.90.
3. A photocopy of the cashier's check for$7,897.90 payable to the Prothonotary of
Cumberland County is attached hereto as Exhibit"C"and is in the possession of
Defendant's counsel for its immediate provision to the Prothonotary.
4. The Mechanics' Lien Law specifically states that:
Cash deposit. Any claim filed hereunder shall,upon petition of
the owner or any party in interest, be discharged as a lien
against the property whenever a sum equal to the amount of
the claim shall have been deposited with the court in said
proceedings for application to the payment of the amount
finally determined to be due. 49 P.S. §1510(a).
5. At the present time Defendant, who is a developer, has two real estate settlements
which are adversely affected by the present Mechanics' Lien for$7,897.90
including one going to settlement on Friday,May 30,2008 at 1:00 PM.
6. A copy of this Petition was faxed to Plaintiffs counsel on Thursday, May 29, 2008

49 P.S. § 1510 (2007)
§ 1510. Discharge of lien on payment into court or entry of security
(a) Cash deposit. Any claim filed hereunder shall, upon petition of the owner or any party
in interest, be discharged as a lien against the property whenever a sum equal to the amount
of the claim shall have been deposited with the court in said proceedings for application to
the payment of the amount finally determined to be due.
(b) Pro-rata allocation. In any case where the claim or claims are limited in the manner
and to the extent provided in section 405, the owner may deposit with the court in separate
proceedings a sum equal to the total allowable amount of said claims determined in
accordance with said section, whereupon the court, on petition of such owner, shall order all
of said claims discharged as liens against the property, and the sum so deposited applied pro
rata to the payment thereof in the amounts finally determined to be due.
(c) Refund of excess. Any excess of funds paid into court as aforesaid, over the amount of
the claim or claims determined and paid therefrom, shall be refunded to the owner or party
depositing same upon application for the same.
(d) Security in lieu of cash. In lieu of the deposit of any such sum or sums, approved
security may be entered in such proceedings in double the amount of the required deposit, or
in such lesser amount as the court shall approve, which, however, shall in no event be less
than the full amount of such required deposit; and the entry of such security shall entitle the
owner to have such liens discharged to the same effect as though the required sums had
been deposited in court as aforesaid.
(e) Authority of court. The court, upon petition filed by any party, and after notice and
hearing, may upon cause shown:

(1) require the increase or decrease of any deposit or security;
(2) strike off security improperly filed;

THE PROPERTY in accordance with 49 P.S. §1510(a). The Prothonotary of Cumberland
County shall mark the Mechanics' Lien filed by the Plaintiff against the Final Subdivision Plan
of Glenwood Terrace dated June 22,2004,last revised August 4,2004,located in Lower Allen
Township and recorded in Plan Book 93,Page 75 as DISCHARGED AS A LIEN AGAINST
THE PROPERTY.The Prothonotary of Cumberland County shall deposit this sum in an
interest bearing account.

1. On November 7th, 2013, this Court, by the Honorable Judge Kevin A. Hess, entered a Rule to
Show Cause, requiring an answer from Plaintiff within twenty days of service by the Court. A copy of this
Order is attached as Exhibit "A".
2. More than two months have elapsed since the entry of the aforesaid Order.
3. Plaintiff has failed to answer the aforesaid Order or Defendant's underlying Petition.
4. Defendant is entitlted to the relief requested in the underlying Petition.
