NOTICE
NOTICE is hereby given that paragraph 16 of the Petition for Adjudication herein was in
error in averring that the decedent had not been adjudicated an incapacitated person. The
decedent was adjudicated an incapacitated person by Order of the Honorable Robert J. Eby, P.l.,
of the Court of Common Pleas of Lebanon County, Pennsylvania, docketed to No. 2002-527, a
true and correct copy of which is attached hereto and incorporated herein by reference as though
fully set forth. Decedent's Last Will and Testament was drafted by James R. Humer, Esquire.
The copy thereof that is attached to the Petition for Adjudication herein indicates that it was
executed by the decedent on December 7, 1982, that is nearly twenty years prior to the
adjudication of the decedent as an incapacitated person. The mother of the decedent died prior to
the decedent. The decedent was never married and left no issue, and there were no issue of the
parents of the decedent who survived the decedent other than the two siblings of the decedent,
both of whom are still living. Therefore, the testamentary distribution is the same as if the Last
Will and Testament of the decedent had been invalid due to the incapacity of the testator at the
date of execution and as if, as a result, the decedent had died intestate.

: Appointment of Guardian
ORDER
A..l\ID NOW, to wit, October 24, 2002, upon consideration of
the petition for adjudication of incapacity and the testimony presented in
support thereof, the Court finds as follows:
1. Charles E. Paxton, the alleged incapacitated person, was
properly served with the petition for adjudication of
incapacity in the within matter.
2. All proper parties were given due a..lld timely notice of the
hearing.
3. Charles E. Pap-ton is present at the time of the hearing in

court.
4. This Court has jurisdiction.
5. The Petitioner has presented clear and convincing evidence
that the alleged incapacitated person's ability to receive and
evaluate information effectively and communicate
decisions in any way is impaired to such a significant extent
that he is totally unable to manage his financial resources.
6. Charles E. Paxton has been diagnosed as suffering from
schizophrenia.
7. Charles E. Paxton is unable to handle his financial affairs
and is in the need of a guardian of his estate.
8. Failure to appoint a guardian for the proposed incapacitated
person will result in irreparable harm.
9. Fulton Financial Advisors of North America is an
appropriate choice to serve as guardian and has consented
to serve in that capacity.

Accordingly, Charles E. Paxton is hereby adjudicated as an
incapacitated person. Fulton Financial Advisors of North
America is appointed the guardian of his estate.
