PAXTON, Deceased, Late of the Township of East Pennsboro, Cumberland County, Pennsylvania : IN THE COURT OF COMMON PLEAS OF : CUMBERLAND COUNTY, PENNSYLVANIA : ORPHANS' COURT DIVISION : NO. 21-07-417 NOTICE NOTICE is hereby given that paragraph 16 of the Petition for Adjudication herein was in error in averring that the decedent had not been adjudicated an incapacitated person. The decedent was adjudicated an incapacitated person by Order of the Honorable Robert J. Eby, P.l., of the Court of Common Pleas of Lebanon County, Pennsylvania, docketed to No. 2002-527, a true and correct copy of which is attached hereto and incorporated herein by reference as though fully set forth. Decedent's Last Will and Testament was drafted by James R. Humer, Esquire. The copy thereof that is attached to the Petition for Adjudication herein indicates that it was executed by the decedent on December 7, 1982, that is nearly twenty years prior to the adjudication of the decedent as an incapacitated person. The mother of the decedent died prior to the decedent. The decedent was never married and left no issue, and there were no issue of the parents of the decedent who survived the decedent other than the two siblings of the decedent, both of whom are still living. Therefore, the testamentary distribution is the same as if the Last Will and Testament of the decedent had been invalid due to the incapacity of the testator at the date of execution and as if, as a result, the decedent had died intestate.
